ABDUL REHIM, J\n               -------------------------------\n              WP(C) NO. 30707 OF 2010\n             -------------------------------------\n         Dated this the 11th day of October, 2010\n\n\n                       JUDGMENT\n<\/pre>\n<p>    Petitioner is the builder of a residential apartment<\/p>\n<p>complex consisting of 16 apartments. According to him,<\/p>\n<p>even prior to starting construction of the complex, 14<\/p>\n<p>agreements were entered with 14 intending purchasers<\/p>\n<p>who came forward for buying apartments in the complex.<\/p>\n<p>Ext.P1 is one of such agreements, wherein it is revealed<\/p>\n<p>that the construction was undertaken by the builder on<\/p>\n<p>behalf of the purchaser and the undivided share in the<\/p>\n<p>land was transferred into his name. It is the specific case<\/p>\n<p>of the petitioner that the cost of construction of the<\/p>\n<p>apartments were met such individual owners jointly.<\/p>\n<p>    2.    The petitioner had produced Ext.P2 series<\/p>\n<p>documents which will indicate that each such persons<\/p>\n<p>have paid tax due under the KVAT Act with respect to the<\/p>\n<p>works contract undertaken.\n<\/p>\n<p>    3.    It is stated that the 3rd respondent had<\/p>\n<p><span class=\"hidden_text\">                               2<\/span><br \/>\nWP(C) No. 30707\/2010<\/p>\n<p>completed assessment under the Kerala Building Tax Act,<\/p>\n<p>1975 against the petitioner, treating the entire apartment<\/p>\n<p>complex as a single unit, to the tune of Rs.2,93,400\/-.<\/p>\n<p>Aggrieved by the assessment the petitioner filed an appeal<\/p>\n<p>before the second respondent. Ext.P5 is the order issued by<\/p>\n<p>the appellate authority. The appeal was rejected finding<\/p>\n<p>that the building in question is not liable to be assessed<\/p>\n<p>under explanation 2 to Section 2 (e) of the Kerala Building<\/p>\n<p>Tax Act. It is observed by the appellate authority that, it is<\/p>\n<p>revealed from the records that the electricity bills and<\/p>\n<p>municipality taxes are in the name of the petitioner and<\/p>\n<p>separate bills are not available in the name of individual flat<\/p>\n<p>owners.\n<\/p>\n<p>     4.     The question raised by the petitioner is with<\/p>\n<p>respect to claim for separate assessment on individual<\/p>\n<p>owners of each apartments.            Crucial aspect to be<\/p>\n<p>considered is as to whether the petitioner had constructed<\/p>\n<p>the entire building by expending his own funds or as to<\/p>\n<p><span class=\"hidden_text\">                                3<\/span><br \/>\nWP(C) No. 30707\/2010<\/p>\n<p>whether the individual purchasers have met the cost of<\/p>\n<p>construction jointly.    The criteria in allowing separate<\/p>\n<p>assessment in such cases, on the basis of explanation 2 to<\/p>\n<p>sub section (e) of Section 2 of the Kerala Building Tax Act,<\/p>\n<p>has been considered elaborately by this Court in the<\/p>\n<p>decision in M\/s. Bava Sons Constructions Pvt. Ltd. Vs.<\/p>\n<p>Tahsildar [2007 (3) KLT 101].\n<\/p>\n<p>     5.     It is noticed that the assessment order Ext.P3<\/p>\n<p>does not reflect any application of mind by the assessing<\/p>\n<p>authority on the question regarding claim for separate<\/p>\n<p>assessment. The said order is issued on a printed format<\/p>\n<p>and it is not discernible as to whether any notice was issued<\/p>\n<p>to the petitioner before finalising the assessment or as to<\/p>\n<p>whether the petitioner had submitted any objections against<\/p>\n<p>the assessment being completed against him.         Going by<\/p>\n<p>Ext.P5 it is evident that the appellate authority has also not<\/p>\n<p>considered the matter in its real perspective. The reason<\/p>\n<p>for rejecting the claim for separate assessment enumerated<\/p>\n<p><span class=\"hidden_text\">                               4<\/span><br \/>\nWP(C) No. 30707\/2010<\/p>\n<p>under Ext.P5 is not the real criteria to be looked into. As<\/p>\n<p>stated above, the prime consideration ought to have been as<\/p>\n<p>to whether the cost of construction was met by owners of<\/p>\n<p>individual apartments jointly.\n<\/p>\n<p>     6.     Under the above circumstances, I am of the view<\/p>\n<p>that the matter requires reconsideration at the hands of the<\/p>\n<p>assessing authority. Ext.P3 order of assessment as well as<\/p>\n<p>Ext.P5 appellate order are hereby quashed.             The 3rd<\/p>\n<p>respondent Tahsildar is directed to finalise the assessment<\/p>\n<p>afresh, after issuing notice to the petitioner as well as to all<\/p>\n<p>the owners of the individual apartments, and after affording<\/p>\n<p>them a reasonable opportunity of hearing.<\/p>\n<p>     7.     The question whether the assessment need be<\/p>\n<p>completed treating individual apartments as separate units<\/p>\n<p>shall be decided on the basis of the observations made<\/p>\n<p>above and having regard to the parameters fixed in the<\/p>\n<p>decision of this Court cited above. Fresh assessment in this<\/p>\n<p>regard shall be completed as early as possible, at any rate<\/p>\n<p><span class=\"hidden_text\">                             5<\/span><br \/>\nWP(C) No. 30707\/2010<\/p>\n<p>within a period of three months from the date of receipt of a<\/p>\n<p>copy of this judgment. Needless to say that amount if any<\/p>\n<p>remitted by the petitioner shall be appropriated in<\/p>\n<p>accordance with outcome of the fresh assessment to be<\/p>\n<p>completed.\n<\/p>\n<\/p>\n<p>                                  C.K.
