2.\tHeard
\nlearned advocate Mr.Shirish Joshi for the petitioners.  The learned
\nadvocate invited attention of the Court to the order passed by this
\nCourt (Coram: D.N. Patel, J.) dated 29.11.2005 in Special Civil
\nApplication No.16327 of 2005, a copy of which is produced at pages 55
\nand 56.  Paras 2 and 3 of the said order read as under:\n<\/p>\n
“2.\t\tThe
\nlearned Senior Advocate Mr. Kamal Trivedi, appearing with Mr.
\nR.M.Chhaya, Advocate for the petitioner submitted that the petitioner
\nhas already stated in her reply before Board of Nominees that the
\napprehension on the part of the respondent no.1 society (original
\nplaintiff) was uncalled for and unwarranted.  In fact, the
\napprehension on the part of the respondent no.1 (original plaintiff)
\nwas thoroughly baseless. Never the petitioner (original defendant)
\never thought of transfer of the premises in question without
\npermission of the respondent no.1
\nsociety (original plaintiff). Nonetheless, the learned Senior
\nAdvocate appearing for the petitioner submitted that as and when the
\npetitioner will think of transfer of the property in question,
\ninducting anybody else in the premises or putting the property to
\ncommercial use,  she will obtain necessary permission of the
\nrespondent society and therefore, the orders passed by the Board of
\nNominees as well as by the Gujarat State
\nCo-operative Tribunal deserve to be quashed and set aside which
\nimposes absolute ban upon the petitioner for transfer of the premises
\nin question.\n<\/p>\n
3.\t\tI
\nhave heard the learned counsel for the respondent no.1 society who
\nhas submitted that if the petitioner is surrendering to the authority
\nof the respondent society for taking prior permission before transfer
\nof the premises in question or otherwise, inducting anybody else in
\nthe premises in question or putting the property to commercial use,
\nthe  respondent no.1 (original plaintiff) has no much objection even
\nin withdrawing Lavad case no.1511 of 2003 pending before Board of
\nNominees, Surat,  especially in view of the facts stated by the
\npetitioner in para-8 of the written statement in Lavad suit no. 1511
\nof 2003.”\n<\/p>\n
3.\tThe
\nlearned advocate then invited attention of the Court to Annexure ‘I’,
\npages 67 and 68 thereof, wherein the District Registrar, Cooperative
\nSocieties, Surat has passed order dated 22.02.2008 to issue duplicate
\nshare certificates No.226 to 230 to Shri Hasmukhbhai N. Vakil without
\nany charges and give him NOC.  Besides, the District Registrar has
\nalso issued a direction directing the petitioner-society to issue NOC
\nto one Smt.Snehlataben Jagdishbai. The learned advocate for the
\npetitioners submitted that said  Smt.Snehlata J. Raval was the
\npetitioner in Special Civil Application No.16327 of 2005. The very
\nparty has agreed before this Court that she is surrendering to the
\nauthority of the respondent-society for taking prior permission
\nbefore transfer of the premises in question or otherwise, inducting
\nanybody else in the premises in question or putting the property to
\ncommercial use.\n<\/p>\n
4.\tDespite
\nthat this direction is given.\n<\/p>\n
The
\nlearned advocate for the petitioners submitted that if the society
\ndoes not carry out this direction in a time frame it is the District
\nRegistrar who can issue NOC on behalf of the society and can also
\nissue duplicate share certificates.  The learned advocate for the
\npetitioners submitted that Shri Hasmukhbhai Vakil  has not filed any
\naffidavit disclosing as to what has happened to the original share
\ncertificates.  The learned advocate for the petitioners submitted
\nthat in absence of any such affidavit disclosing about the original
\nshare certificates there is no reason for the District Registrar to
\nissue duplicate share certificates.\n<\/p>\n
5.\tThe
\nlearned advocate for the petitioners submitted that the direction to
\nissue NOC to Smt.Snehalataben J. Raval is running into the face of
\nthe order passed by this Court wherein this Court has recorded that
\nSmt.Snehalataben J. Raval has submitted to the authority of
\nrespondent-soceity as recorded hereinabove.\n<\/p>\n
6.\tThe
\nmatter requires consideration.   RULE.   NOTICE
\nas to interim relief returnable on 24th January 2001.  Ad
\ninterim relief in terms of para 23(B).  Direct service is permitted.\n<\/p>\n
