JUSTICE MOHIT S. SHAH)<\/p>\n<p>\tMr<br \/>\nShelat, learned counsel for the appellants states, under<br \/>\ninstructions, that application Exh.47 is fixed for hearing on<br \/>\n23.9.2008. Mr Shelat, however, submits that application Exh.50 was<br \/>\nalso filed by the appellants on the same day when application Exh.47<br \/>\nwas filed and both applications Exh.47 and 50 are required to be<br \/>\nheard together.\n<\/p>\n<p>\tWe<br \/>\nalso find reference to injunction application Exh.50 in paragraph<br \/>\n16.1 of the judgment of the learned Single Judge.\n<\/p>\n<p>\tIn<br \/>\nthe facts and circumstances of the case, without going into the<br \/>\nmerits of the controversy between the parties, we dispose of this<br \/>\nappeal with a direction that the trial Court shall hear both<br \/>\napplications Exh.47 and 50 as expeditiously as possible and<br \/>\npreferably on 23rd September 2008 and thereafter decide<br \/>\nboth the applications expeditiously.\n<\/p>\n<p>\tSubject<br \/>\nto the above direction, the appeal is disposed of.\n<\/p>\n<p>\tSince<br \/>\nthe appeal is disposed of, the civil application also stands disposed<br \/>\nof.\n<\/p>\n<p>\tThis<br \/>\norder shall be brought to the notice of the trial Court as well as<br \/>\nthe learned Advocate appearing for the defendants before the trial<br \/>\nCourt at the earliest and in any case by 18th September<br \/>\n2008.\n<\/p>\n<p>\tDirect<br \/>\nservice is permitted today.\n<\/p>\n<p>\t\t\t\t\t\t(M.S.\n<\/p>\n<p>SHAH, J.)\t\t<\/p>\n<p>\t\t\t\t\t\t(AKIL<br \/>\nKURESHI, J.)<\/p>\n<p>zakir\/-\n<\/p>\n<p>\t\t   \u00a0\u00a0\u00a0<\/p>\n<blockquote><p>\t\t   Top<\/p>\n<\/blockquote>\n","protected":false},"excerpt":{"rendered":"<p>Gujarat High Court Virendrasinh vs Urmiladevi on 15 September, 2008 Author: Mohit S.
