KATRIAR\n\n                          Date: 07.07.2010\n\n                          ORAL ORDER<\/pre>\n<p>              (Per: HONOURABLE THE CHIEF JUSTICE)<\/p>\n<p>ORDER IN INTERLOCUTORY APPLICATION:\n<\/p>\n<p>         This application under Section 5 of the Limitation Act is<\/p>\n<p>filed by the appellant State of Bihar for condonation of delay of<\/p>\n<p>1066 days occurred in filing the letters patent appeal. The learned<\/p>\n<p>Advocate Mr. Pramod Kumar Sinha has appeared for the<\/p>\n<p>respondent writ petitioner. He has contested the application.<br \/>\n<span class=\"hidden_text\">                                        2<\/span><\/p>\n<p>                      This Court (Coram- Dipak Misra, C.J.; and Mihir Kumar<\/p>\n<p>              Jha, J.) while issuing notice to the respondent recorded the reasons<\/p>\n<p>              why the Court was inclined to interfere in spite of the gross delay on<\/p>\n<p>              the part of the State of Bihar. The Court had noticed that the<\/p>\n<p>              appellant had first filed application being M.J.C. No.3424 of 2009<\/p>\n<p>              for modification of the order and that the writ petition was filed by<\/p>\n<p>              the daughter of the deceased employee long after the death of the<\/p>\n<p>              employee.\n<\/p>\n<p>                          For the very reasons we are inclined to condone the<\/p>\n<p>              delay and to examine the matter on merits. For the aforesaid reasons,<\/p>\n<p>              the delay in filing the L.P.A. No. 863 of 2010 is condoned. The<\/p>\n<p>              interim application stands allowed.\n<\/p>\n<p>              ORDER IN LETTERS PATENT APPEAL:\n<\/p>\n<p>                      The learned Advocate Mr. Rajesh Kumar Singh appears for<\/p>\n<p>              the appellant State of Bihar and the learned Advocate Mr. Pramod<\/p>\n<p>              Kumar Sinha appears for the respondent writ petitioner.<\/p>\n<p>                      At the request of the learned Advocates let the appeal be<\/p>\n<p>              posted for admission hearing and final disposal on 28th of July,<\/p>\n<p>              2010.\n<\/p>\n<\/p>\n<p>                                                    (R.M.
