Singhvi, Aftab Alam<\/div>\n<pre>                         IN THE SUPREME COURT OF INDIA\n\n               CIVIL APPELLATE JURISDICTION\n\n               CIVIL APPEAL NO.2759 OF 2002\n\n\nKarturi Prasad Rao                         ...Appellant(s)\n\n\n                          Versus\n\n\nKarturi Surya Kanthamma                   ...Respondent(s)<\/pre>\n<p>                      O   R   D   E   R<\/p>\n<p>       The plaintiff-appellant filed a suit for specific<br \/>\nperformance of agreement dated 29th May, 1976 whereby the<br \/>\ndefendant-respondent agreed to purchase 3 acres and 6-1\/2<br \/>\nguntas of land for a sum of Rs.42,000\/-.         The appellant<br \/>\nclaimed that even though he was always ready and willing<br \/>\nto perform his part of the contract, the respondent did<br \/>\nnot pay the balance amount and did not get the sale deed<br \/>\nexecuted.   By judgment dated 30th June, 1988, the trial<br \/>\ncourt decreed the suit and directed the respondent to pay<br \/>\nto the appellant Rs.45,105\/- together with interest at the<br \/>\nrate of sixteen per cent per annum from the date of suit<br \/>\ntill the date of decree and interest at the rate of six<br \/>\nper cent per annum from the date of decree till the date<br \/>\nof payment on the amount of Rs.31,000\/-.       The trial court<br \/>\nfurther directed the respondent to obtain sale deed in<br \/>\nterms of the agreement within a period of three months.\n<\/p>\n<p>                                                        &#8230;2\/-\n<\/p>\n<p>                                     &#8211; 2 &#8211;\n<\/p>\n<p>          The respondent challenged the judgment and decree<br \/>\nof the trial court by filing an appeal.                      She also applied<br \/>\nfor the interim relief, but her prayer for staying the<br \/>\njudgment and decree of the trial court was not granted.<br \/>\nNotwithstanding       this,    the        respondent        neither   paid       the<br \/>\namount in terms of the decree of the trial court nor made<br \/>\nany attempt to get the sale deed executed.                     Therefore, the<br \/>\nappellant filed an application under Section 28 of the<br \/>\nSpecific    Relief    Act,     1963       [for     short,     &#8220;the    Act&#8221;]      for<br \/>\nrescinding the contract and for issuance of a direction to<br \/>\nthe respondent to deliver possession of the suit property<br \/>\nto him.         The latter contested the application.                        After<br \/>\nhearing the parties, the trial court passed order dated 3rd<br \/>\nAugust, 1993, whereby it directed that the agreement dated<br \/>\n29th May, 1976 shall stand rescinded.                 The trial court also<br \/>\ndirected the respondent to restore possession of the suit<br \/>\nproperty to the appellant within a period of two months<br \/>\nfrom the date of the order.\n<\/p>\n<p>          The    appeal   filed      by    the     respondent      against       the<br \/>\njudgment    and    decree     dated       30th    June,     1988   was   finally<br \/>\ndismissed by the Ist Additional District Judge at Raichur<br \/>\nvide   judgment      dated    29th    September,          1997.       The    lower<br \/>\nappellate   court     confirmed       the        findings    recorded       by   the<br \/>\ntrial court on the issue of readiness and willingness of<br \/>\nthe appellant to perform his part of the contract and that<br \/>\nthe respondent neither paid the balance amount in terms of<br \/>\nthe agreement nor made any effort to obtain the sale deed.<br \/>\nThe lower appellate court also took cognizance of order<br \/>\ndated 3rd August, 1993 passed by the trial court and the<br \/>\nfact that the said order has not been challenged by the<br \/>\nrespondent.\n<\/p>\n<p>                                                                            &#8230;2\/-\n<\/p>\n<p>                                       &#8211; 3 &#8211;\n<\/p>\n<p>          Feeling          aggrieved      by     appellate          judgment,       the<br \/>\nrespondent filed second appeal under Section 100 of the<br \/>\nCode of Civil Procedure, which was registered as RSA No.<br \/>\n12\/1998.    By the impugned judgment, the High Court allowed<br \/>\nthe second appeal, set aside the decree passed by the<br \/>\ntrial court to the extent it contained a direction to the<br \/>\nrespondent to pay interest on Rs.45,105\/- and substituted<br \/>\nthe same by directing the respondent to pay interest at<br \/>\nthe rate of sixteen per cent per annum from the date of<br \/>\nsuit till the date of decree.                         The High Court granted<br \/>\nthree months&#8217; time for making the payment and directed the<br \/>\nappellant to hand over possession of the suit property to<br \/>\nthe    respondent      and     execute       sale      deed     within      a   month.<br \/>\nHence, this appeal by special leave.\n<\/p>\n<p>          We have heard learned counsel for the parties and<br \/>\ncarefully gone through the impugned judgment as also the<br \/>\njudgments       and    decrees       of    the        trial    court      and     lower<br \/>\nappellate court.            In our opinion, the High Court committed<br \/>\ngrave error by interfering with the concurrent findings of<br \/>\nfact     recorded      by      the     two      courts,        after      threadbare<br \/>\nconsideration         of    the   factual        matrix       of    the    case     and<br \/>\nevaluation of evidence produced by the parties, that even<br \/>\nthough    the    appellant        herein        was    ready       and    willing    to<br \/>\nperform his part of the contract, the respondent herein<br \/>\nneither paid the balance amount nor made any effort to get<br \/>\nthe sale deed executed and registered.                             In the impugned<br \/>\njudgment    the       High     Court      has     nowhere       found      that     the<br \/>\nfindings    recorded         by   the     courts        below      were    perverse.<br \/>\nTherefore, there was no occasion for it to upset those<br \/>\nfindings.\n<\/p>\n<p>                                                                                &#8230;4\/-\n<\/p>\n<p>                                   &#8211; 4 &#8211;\n<\/p>\n<p>        We are further of the view that the High Court<br \/>\ncommitted serious error in observing that order dated 3rd<br \/>\nAugust, 1993 passed by the trial court under Section 28 of<br \/>\nthe Act, was subject to the final judgment of the appeal<br \/>\npreferred     by    the   respondent       against       the   judgment      and<br \/>\ndecree of the trial court.               The High Court ought to have<br \/>\ntaken   note    of    the   fact    that     in     the      absence    of   any<br \/>\nchallenge to order dated 3rd August, 1993, the direction of<br \/>\nthe trial court that the contract shall stand rescinded<br \/>\nbecame final and, in that view of the matter, no decree<br \/>\ncould   have       been   passed   in      favour       of   the    respondent<br \/>\nenabling her to secure possession of the suit property by<br \/>\npaying the balance consideration and that too after 26<br \/>\nyears of execution of the agreement of sale.\n<\/p>\n<p>        Accordingly,        the     appeal        is     allowed,      impugned<br \/>\njudgment rendered by the High Court in second appeal is<br \/>\nset aside and the judgment and decree of the trial court,<br \/>\nwhich   was    confirmed     by    the    lower        appellate    court,    is<br \/>\nrestored.\n<\/p>\n<p>        No costs.\n<\/p>\n<p>                                              &#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;.J.\n<\/p>\n<p>                                              [B.N.
