SHAH\n\t\t\n\t\n\n \n\nDate\n: 13\/10\/2010 \n\n \n\nORAL\nJUDGMENT<\/pre>\n<p>1.\tBy<br \/>\nway of this petition under Article 227 of the Constitution of India,<br \/>\npetitioner has prayed for an appropriate writ, direction or order<br \/>\nquashing and setting the impugned judgment and award dated 19.06.2002<br \/>\npassed by the Labour Court, Junagadh in Reference (LCJ) No.266\/1993,<br \/>\nby which the Labour Court partly allowed the said reference directing<br \/>\nthe petitioner to reinstate the respondent with 30% back wages and<br \/>\nwith continuity of service.\n<\/p>\n<p>2.\tRespondent<br \/>\nwas serving as a daily wager as cow herd (Goval) with the petitioner.<br \/>\n It is the case on behalf of the petitioner that he was very<br \/>\nirregular in service and he was in habit of remaining unauthorizedly<br \/>\nabsent without leave.  That the respondent raised industrial dispute<br \/>\nchallenging its alleged termination\/retrenchment by submitting that<br \/>\nhis services have been terminated on and from 07.03.1993 without<br \/>\nfollowing any procedure and without issuing notice, notice pay and\/or<br \/>\nretrenchment compensation.  The said dispute was referred to the<br \/>\nLabour Court, Junagadh, which was numbered as Reference (LCJ)<br \/>\nNo.266\/1993.  It was the specific case on behalf of the petitioner<br \/>\nthat there was no termination and\/or retrenchment by the petitioner<br \/>\nand that the respondent himself stopped coming to the work on and<br \/>\nfrom 08.04.1993.  It was also specifically contended that his<br \/>\nservices came to be terminated and\/or he came to be retrenched on and<br \/>\nfrom 07.03.1993.  It was submitted that thereafter he worked for six<br \/>\ndays in the month of April 1993.  It was also submitted on behalf of<br \/>\nthe petitioner that despite various notices to resume duty, the<br \/>\nrespondent did not resume the duty and therefore, as there was no<br \/>\ntermination and\/or retrenchment by the petitioner, there was no<br \/>\nquestion of following any procedure required under Section 25F of the<br \/>\nIndustrial Disputes Act, 1947.  That the Labour Court by impugned<br \/>\njudgment and award partly allowed the said reference by directing the<br \/>\npetitioner to reinstate the respondent with 30% back wages by holding<br \/>\nthat the notices were issued by the petitioner calling upon the<br \/>\nrespondent to resume his duty, were not served upon the respondent<br \/>\nand if the respondent was remaining absent unauthorizedly and\/or he<br \/>\nabandoned the work, departmental inquiry ought to have been initiated<br \/>\nagainst him.  Therefore, the Labour Court held that there was a<br \/>\nbreach of Section 25F of the Industrial Disputes Act, 1947 and<br \/>\ntherefore, directed the petitioner to reinstate the respondent with<br \/>\n30% back wages and continuity of service.  Being aggrieved and<br \/>\ndissatisfied with the judgment and award dated 19.06.2002 passed by<br \/>\nthe Labour Court, Junagadh in Reference (LCJ) No.266\/1993, petitioner<br \/>\nhas preferred the present petition under Article 227 of the<br \/>\nConstitution of India.\n<\/p>\n<p>3.\tShri<br \/>\nD.G. Chauhan, learned advocate appearing on behalf of the petitioner<br \/>\nhas submitted that as such there was no termination and\/or<br \/>\nretrenchment of the respondent by the petitioner on and from<br \/>\n07.03.1993 as alleged by the respondent.  It is submitted that even<br \/>\nthereafter the respondent worked for six days in the month of April<br \/>\n1993 and therefore, the contention on behalf of the respondent that<br \/>\nhe was retrenched and\/or his services were terminated from<br \/>\n07.03.1993, cannot be accepted.  It is further submitted that even<br \/>\nthe finding given by the Labour Court that the notices produced at<br \/>\nExhs.35 to 40 were not served upon the respondent is factually<br \/>\nincorrect.  It is submitted that in fact the acknowledgment receipts<br \/>\nestablishing that the aforesaid notices were served upon the<br \/>\nrespondent were already on record and still the Labour Court has<br \/>\ngiven the aforesaid finding which is contrary to the evidence on<br \/>\nrecord.  Therefore, it is submitted that when despite several notices<br \/>\nthe respondent did not resumed the duty and he abandoned the work,<br \/>\nthere was no retrenchment and\/or termination by the petitioner and<br \/>\ntherefore, there was no question of following procedure as required<br \/>\nunder Section 25F of the Industrial Disputes Act, 1947 and therefore,<br \/>\nit is requested to allow the petition.\n<\/p>\n<p>4.\tWhen<br \/>\nShri Vasavda, learned advocate appearing on behalf of the respondent<br \/>\nwas shown the certified copies of the acknowledgment receipts of the<br \/>\nnotices at Exhs.35 to 40 served upon the concerned respondent, he is<br \/>\nnot in a position to dispute the same, therefore, the finding given<br \/>\nby the Labour Court that the notices calling upon the respondent to<br \/>\nresume the duty were not served upon the respondent, cannot be<br \/>\nsustained and the same is contrary to evidence on record.\n<\/p>\n<p>5.\tOnce<br \/>\nhaving found that despite various notices served upon the respondent<br \/>\ncalling upon him to resume the duty and when he did not resume the<br \/>\nduty, there was no termination\/retrenchment by the petitioner for<br \/>\nwhich the provisions of Section 25F of the Industrial Disputes Act,<br \/>\n1947, is required to be followed.  It was the respondent who<br \/>\nabandoned the work and there was no retrenchment and\/or termination<br \/>\nby the petitioner at all.  It is required to be noted that according<br \/>\nto the respondent, his services came to be terminated and\/or he was<br \/>\nretrenched on and from 07.03.1993, however, from the register<br \/>\nproduced on record, it has come on record that even thereafter he<br \/>\nworked for six days in April 1993.  Therefore, the contention on<br \/>\nbehalf of the respondent that his services were terminated and\/or<br \/>\nretrenched on and from 07.03.1993, is factually incorrect.\n<\/p>\n<p>6.\tConsidering<br \/>\nthe aforesaid facts and circumstances, when there was no retrenchment<br \/>\nand\/or termination of the petitioner and despite various notices, the<br \/>\nrespondent did not resume the duty, the Labour Court has materially<br \/>\nerred in allowing the said reference directing the petitioner to<br \/>\nreinstate the respondent with 30% back wages and continuity of<br \/>\nservice and there was no question of following any procedure required<br \/>\nunder Section 25F of the Industrial Disputes Act, 1947.\n<\/p>\n<p>7.\tIn<br \/>\nview of the above and for the reasons stated above, petition<br \/>\nsucceeds.  Impugned judgment and award  dated 19.06.2002 passed by<br \/>\nthe Labour Court, Junagadh in Reference (LCJ) No.266\/1993, is hereby<br \/>\nquashed and set aside.
