Gupta, J.  <\/p>\n<p>1. This appeal has been directed by Raj Kumar,<br \/>\naccused, against the judgment and order dated 17.4.2002<br \/>\npassed by Special Judge, Fatehgarh Sahib, whereby he was<br \/>\nfound guilty and convicted under Section 7 read with<br \/>\nSection 13(2) of the Prevention of Corruption Act and was<br \/>\nsentenced to undergo R.I. for six months and a fine of<br \/>\nRs. 200\/- under Section 7 of the Act; in default of<br \/>\npayment of fine, he was further sentenced to undergo R.I.<br \/>\nfor one month; to undergo R.I. for one year and a fine<br \/>\nof Rs. 300\/- under Section 13(2) of the abovesaid Act and<br \/>\nand in default of payment of fine, the appellant was<br \/>\nfurther sentenced to undergo R.I. for one month.<br \/>\nHowever, both the substantive sentenced were ordered to<br \/>\nrun concurrently.\n<\/p>\n<p>2. Briefly stated, the facts are that on<br \/>\n10.7.1996, Labh Singh son of Kirpal Singh, resident of<br \/>\nVillage Bibipur filed an application before the Senior<br \/>\nSuperintendent of Police, Fatehgarh Sahib. He stated in<br \/>\nthat application that he was farmer by profession. On<br \/>\n6.7.1996, there was a dispute between his wife, Surjit<br \/>\nKaur and Jatinder Kaur wife of Swaran Singh son of Sukhdev<br \/>\nSingh. Jatinder Kaur got herself admitted in Civil<br \/>\nHospital, Fatehgarh Sahib, on account of receipt of<br \/>\ninjuries. On 7.7.1998, he (Labh Singh) and his wife went<br \/>\nto Civil Hospital, Fatehgarh Sahib to enquire about the<br \/>\nincident narrated by Jatinder Kaur. Raj Kumar, appellant<br \/>\n(accused) met them and told that in case they wanted to<br \/>\ninvolve the opposite party in some serious offence, then<br \/>\nthey should pay him Rs. 9,000\/- and would get the needful<br \/>\ndone. Thereafter the appellant got tem introduced to<br \/>\nDr. Jaswant Singh and the bargain was settled at Rs. 8500\/-.<br \/>\nAt the asking of the said doctor, the appellant inflicted<br \/>\ntwo injuries on the person of Surjit Kaur with a blade<br \/>\ni.e. on her left hand and left leg. Thereafter,<br \/>\nDr. Jaswant Singh and Dr. Madan Singh got prepared<br \/>\nmedico-legal report of Surjit Kaur.\n<\/p>\n<p>3. Labh Singh, complainant, in his application<br \/>\nfurther stated that he had got prepared false medico-legal<br \/>\nreport of his wife with regard to the injuries in order to<br \/>\nfalsely implicate his brothers and he had committed a<br \/>\nblunder, so, the amount be got refunded to him. The said<br \/>\napplication was marked to S.P. (Head Quarter). Labh<br \/>\nSingh also filed his affidavit, Ex. PD. S.P. (Head<br \/>\nQuarter) conducted the enquiry and submitted his report,<br \/>\nEx.PJ, and he found the contents of the application moved<br \/>\nby Labh Singh to be correct. Consequently, a case under<br \/>\nSection 420, 120-B IPC read with Sections 7 and 13(2) of<br \/>\nthe Prevention of Corruption Act (hereinafter referred to<br \/>\nas &#8220;the Act&#8221;) was registered against the appellant and the<br \/>\ndoctors.\n<\/p>\n<p>4. The appellant was apprehended and he was<br \/>\ninterrogated on 13.7.1996 and in pursuance of his<br \/>\ndisclosure statement, Rs. 1500\/- were recovered from the<br \/>\ntrunk kept at his residential house in a room. The same<br \/>\nwere taken into possession vide memo Ex.PH attested by<br \/>\nTarlochan Singh, ASI, Des Raj and Head Constable Manjit<br \/>\nSingh on 13.7.1996. The statement of Labh Singh was<br \/>\nrecorded under Section 164 Cr.P.C. by the Ilaqa<br \/>\nMagistrate.\n<\/p>\n<p>5. Later on Labh Singh filed an affidavit to the effect that he<br \/>\ndid not pay any amount to Dr. Jaswant Singh and in fact, he<br \/>\ndid not know him. So, the names of the doctors were shown<br \/>\nin Column No. 2.\n<\/p>\n<p>6. After the completion of the investigation, the<br \/>\nchallan was put up in the Court against the appellant.\n<\/p>\n<p>7. Having made out a prima-facie case, the<br \/>\nappellant was charged under Section 7 read with Section 13(2) of the Act, to which he pleaded not guilty and claimed<br \/>\ntrial.\n<\/p>\n<p>8. In order to prove the allegations, the<br \/>\nprosecution examined 12 witnesses.\n<\/p>\n<p>9. After the closure of the prosecution evidence,<br \/>\nthe statement of the appellant was recorded under Section<br \/>\n313 Cr.P.C. wherein he denied the allegations of the<br \/>\nprosecution and pleaded false implication.\n<\/p>\n<p>10. After hearing learned PP for the State and the<br \/>\ndefence counsel, the learned Special Judge, Fatehgarh<br \/>\nSahib, vide judgment dated 17.4.2002 found the appellant<br \/>\nguilty and convicted him under Section 7 read with Section<br \/>\n13(2) of the Act and sentenced vide order of even date as<br \/>\nstated in the earlier part of the judgment.\n<\/p>\n<p>11. Aggrieved by the said judgment and order dated<br \/>\n17.4.2002, the accused has filed the present appeal.\n<\/p>\n<p>12. I have heard Shri Sandeep Majithia, Advocate,<br \/>\ncounsel for the appellant, Ms. R.K. Nihalsinghwala, DAG,<br \/>\nPunjab, and carefully gone through the record.\n<\/p>\n<p>13. PW-1 Labh Singh is the complaint in this<br \/>\ncase. He has not supported the prosecution version. He<br \/>\ncategorically stated that he did not know the appellant<br \/>\nbut his wife knew him. He further stated that nobody had<br \/>\ndemanded any amount from him and he did not withdraw any<br \/>\namount from the bank. He further stated that he did not<br \/>\npay any amount to the appellant. He further stated that<br \/>\nthe appellant did not cause any injury to his wife. He<br \/>\nwas declared hostile but the learned Public Prosecutor<br \/>\ncould not get any benefit to the prosecution out of his<br \/>\ncross-examination. In cross-examination by the defence<br \/>\ncounsel, he stated that he was made to sit in the police<br \/>\nfor 12-13 days before he was produced before the<br \/>\nMagistrate for recording his statement under Section 164<br \/>\nCr.P.C. Thus, according to the complainant he had neither<br \/>\npaid any amount to the appellant, nor, he had demanded any<br \/>\namount.\n<\/p>\n<p>14. It is the further case of the prosecution that<br \/>\nthe appellant, on interrogation, had made disclosure<br \/>\nstatement, Ex.PG, which was attested by PW-3 Manjit Singh,<br \/>\nHead Constable, PW-4 Kishore Chand, SP, IRB, Patiala, PW-5<br \/>\nTarlochan Singh, Sub Inspector and PW-7 Des Raj and then<br \/>\nhe led the police party to his house in Village Talian and<br \/>\ngot recovered Rs. 1500\/- from the trunk which was lying in<br \/>\nhis house and the said currency notes were taken into possession<br \/>\nvide memo Ex.PH attested by Manjit Singh, Tarlochan Singh<br \/>\nand Des Raj. PW-7 Des Raj, the independent witness in<br \/>\nthis case, has not supported the prosecution version. He<br \/>\ncategorically stated that he did not know any person of<br \/>\nthe name of Raj Kumar and the appellant did not make any<br \/>\nstatement in his presence nor he got recovered Rs. 1500\/-<br \/>\nin his presence. He further stated that his thumb<br \/>\nimpressions were obtained by the police on some papers.<br \/>\nIn the absence of independent evidence, the testimony of<br \/>\npolice officials cannot be believed. Even if it is<br \/>\npresumed that from the statement of PW-3 Manjit Singh,<br \/>\nHead Constable, PW-4 Kishore Chand, SP, IRB, Patiala and<br \/>\nPW-5 Tarlochan Singh, Sub Inspector, it is proved that<br \/>\nRs. 1500\/- were recovered from the trunk of the appellant<br \/>\nplaced in his residential room in pursuance of his<br \/>\ndisclosure statement, then also it is not proved that this<br \/>\namount, alongwith other amount, he had taken as bribe from<br \/>\nLabh Singh. PW-1 Labh Singh did not state that he had<br \/>\npaid any amount to the appellant. It is not the case that<br \/>\nthe complainant had noted down the numbers of the notes<br \/>\nand the same allied with the numbers  of 15 currency notes<br \/>\nrecovered from the trunk of the appellant. The appellant<br \/>\nwas employed as a Peon. There is nothing improbable in it<br \/>\nif the appellant had kept Rs. 1500\/- at his house<br \/>\nbecause it is a very small amount and it cannot be said<br \/>\nthat it is a bribe amount. It is further stated that<br \/>\nRs. 7000\/- were paid to the doctors. The Doctors have not<br \/>\nbeen examined to prove this fact that they had received<br \/>\nRs. 7000\/-. Smt. Surjit Kaur wife of Labh Singh has not<br \/>\nbeen examined to prove that the appellant had caused her<br \/>\ntwo injuries with a blade with a view to get the<br \/>\nmedico-legal report to falsely implicate her opponents and<br \/>\nthe appellant had done so by getting Rs. 8500\/-. At the<br \/>\ncost of repetition. I may state that mere recovery of<br \/>\nRs. 1500\/- does not connect the appellant with the offence<br \/>\nunder Sections 7 and 13(2) of the Act.\n<\/p>\n<p>15. In view of the discussion above, I hold that<br \/>\nthe prosecution has not been able to bring home guilt to<br \/>\nthe appellant beyond reasonable shadow of doubt.<br \/>\nConsequently, the appeal is accepted and the appellant is<br \/>\nacquitted of the charges levelled against him by giving<br \/>\nhim benefit of doubt.
