The\n\nA \":0.\"Tri1f)LIna1 by its impugned judgmerlt and award awarded\n\n   comperisaiiion 0f?37,394\/A urider different heads with\n\n\n\n3\n\ninterest at 8% per zmmtni from the date of pet.it.ion till\nrealization on account of injuries sustained in the road\ni:1*aff\u00a7c accident- The claimant felt necessary to present\nthis appeal on the ground that compensation awe-rded\n\nis on lower side and needs enhancement.\n\n2. The brief facts of the case are:\n\nThe appellant claims thattehe \n\nyears and a student. He \"studying 6\"'  E \n\n(Mechanical) in JCE Co1legeA,_.M:ys_orep. He\u00abxtz;ts_}5a1e and\n\nhealthy prior to the   thus stood.\n\nthat till  2.00 p.m., when the\n\nappella'nt\"with  proceeding from their village\n\n pp Heb3bsl;iguppe;\"*--HV.ptpKot.e taluk, Mysore district in order\n\n\"(<1tt\u20acfIld'\u00a31ylf't1i'1CtiOIl by a Telo Maxi Cab (Tata Sumo)\n\n No.KA 11. 8080, driven by the first\n\n respondent. in rash and negligent manner moved on the<\/pre>\n
A   side of the road and fell into 20 feet pit towards<\/p>\n
right, side of the road. Due to the impa_ct., he sustained<\/p>\n

injuries, on account: of which, the appellant. was<\/p>\n
admitted to the hospital on 26.04.2005 and discharged<\/p>\n
after three days. The appellant has lost. 6″” <\/p>\n
that academic year. it is the case of the  *<\/p>\n
he has spent considerable amoun’t”‘towar?dsco1*ivr3yance’., 0′<\/p>\n
nourishing food and a1t.tendantl’l’clia_i’Agllesland._<\/p>\n
expenses.\n<\/p>\n
3. On account  Ain}u;i’ies*–sustained in the road
\ntraffic accident,.athe app-e.l.1:ant– yvasideorisptrlained to file a
\nclaim  ‘ltlie M.V.Aci; before
\nthe Tr”i_bu–.r1al,l’sveekingl’compensation for a sum against<\/p>\n
the respo’n_dents”. _ >Flie.jT’;;?ii:>u11ai after assessing the oral<\/p>\n
 ane:1\u00a7docLm1ent’aryV_ evidence and other relevant material<\/p>\n
‘a\\fail.able~cori”the file allowed the claim petition in part<\/p>\n
avtra1*ding-‘Vcornpensation of ?3’7,394\/~ with interest at 6%<\/p>\n
 frorn   of claim petition till the date of realisation.<\/p>\n
A  :Noit”~being satisfied with the quantum of compensation<\/p>\n
awarded by the Tribunal. the appellant has presented<\/p>\n

inadequate and the Tribunal has not  *<\/p>\n
compensation towards loss of .an’1e.nAities, H’diseon;.fQ_rt.s._V V<\/p>\n
and unhappiness.\n<\/p>\n

‘   t.hatwmthe Tribunal has rightly awarded<\/p>\n
 ?20,000\/– towards injury pain and<\/p>\n

 per the Lmedieal bills produced and does not call for<\/p>\n

conveyance, nourishing food and attendant: <\/p>\n
loss of one academic year and in not ax\u00a7*eirding[j”‘arty?A~<\/p>\n
compensation towards loss of .arne_nities, “‘cii\u00a7;eo’rnt’ort.e_ V<\/p>\n
and unhappiness. Having regard <\/p>\n
injuries sustained as per  ce”rti__\ufb01Cate._at.;’E:\u00bb\u00a7;P.E36, ”<\/p>\n
