Justice M.SASIDHARAN NAMBIAR\n\n Dated :19\/10\/2009\n\n O R D E R\n              M.SASIDHARAN NAMBIAR,J.\n\n              ------------------------------------------\n               CRL.M.C.NO. 3356 OF 2009\n              ------------------------------------------\n\n              Dated       19th     October 2009\n\n\n                           O R D E R\n<\/pre>\n<p>           Petitioners are the accused 2 and 3 in<\/p>\n<p>C.C.715\/2005 on the file of Judicial First Class<\/p>\n<p>Magistrate-III,   Thiruvananthapuram               taken   cognizance<\/p>\n<p>for the offence under Sections 379, 465, 468, 471 and<\/p>\n<p>120 B read with Section 34 of Indian Penal Code on<\/p>\n<p>Annexure-I complaint filed by first respondent. This<\/p>\n<p>petition  is  filed     under       Section        482   of Code  of<\/p>\n<p>Criminal Procedure     to quash the complaint contending<\/p>\n<p>that first respondent was the accused in                 C.C.251\/2002<\/p>\n<p>filed by second petitioner herein and C.C.123\/2003<\/p>\n<p>complaint filed by first petitioner, alleging that<\/p>\n<p>first respondent committed offence under Section 138<\/p>\n<p>of Negotiable Instruments Act. It is contended that<\/p>\n<p>evidenced by Annexures-II and III judgments in those<\/p>\n<p>cases first respondent had raised the same contentions<\/p>\n<p>as raised in Annexure-I complaint and the learned<\/p>\n<p>Magistrate did not accept the contentions and in the<\/p>\n<p>light of  Annexures-II and III judgments, continuation<\/p>\n<p>Crmc 3356\/09<br \/>\n<span class=\"hidden_text\">                               2<\/span><\/p>\n<p>of the proceedings is only an abuse of process of<\/p>\n<p>court.\n<\/p>\n<p>            2.  Learned  counsel  appearing  for   the<\/p>\n<p>petitioners    and  learned  Public  Prosecutor   were<\/p>\n<p>heard.\n<\/p>\n<p>            3.  Argument of the learned counsel is<\/p>\n<p>that   even     though  appeals  are  pending  against<\/p>\n<p>Annexures-II and III judgments, only the sentence<\/p>\n<p>was   suspended   and   so  long   as  conviction   in<\/p>\n<p>Annexures-II and III are not varied or modified,<\/p>\n<p>petitioners cannot be convicted, even if they are<\/p>\n<p>tried   and   therefore,  the  proceedings is   to  be<\/p>\n<p>quashed.\n<\/p>\n<p>            4.  When admittedly appeals are pending<\/p>\n<p>as against Annexures-II and III judgments, it cannot<\/p>\n<p>be  said    that  criminal  case  pending  before  the<\/p>\n<p>learned Magistrate is to be quashed, based on the<\/p>\n<p>findings    in  the  said  judgments.  If   ultimately<\/p>\n<p>appeals are to be allowed and the findings of the<\/p>\n<p>learned Magistrate is to be reversed    and meanwhile,<\/p>\n<p>proceedings before the learned Magistrate is to be<\/p>\n<p>quashed, it    will not be in the interest of justice<\/p>\n<p>at all.      Learned counsel then submitted that as<\/p>\n<p>Crmc 3356\/09<br \/>\n<span class=\"hidden_text\">                               3<\/span><\/p>\n<p>second petitioner was not in India      he could not<\/p>\n<p>appear and seek regular bail, learned Magistrate has<\/p>\n<p>issued non bailable warrant     and  direction may be<\/p>\n<p>issued    to consider the application for bail on the<\/p>\n<p>date of their surrender.\n<\/p>\n<p>            Petition  is    disposed  permitting  the<\/p>\n<p>petitioners to raise all the contentions raised<\/p>\n<p>herein at the time of trial. If second petitioner<\/p>\n<p>surrenders and files      an application    for bail,<\/p>\n<p>Magistrate to pass    appropriate order in accordance<\/p>\n<p>with law without delay. I find no reason to believe<\/p>\n<p>that Magistrate is unaware of the   provisions of law<\/p>\n<p>or the decision of this court or the    Apex court or<\/p>\n<p>that the Magistrate will not act in accordance with<\/p>\n<p>law.
