D. Singh, Dean,Faculty of\n                Sciences, BHU.\nPoint no. 5: Certified copies of all the memos issued to Dr. R. K. Pandey, Ex-Reader\n                of the department by the university authorities\n\nPIO's Reply:\nNot enclosed.\n\nGrounds for First Appeal:\nIn respect of Point no. 1;\n    i.      Whether an employee can be sanctioned leave other than applied for.\n    ii.     Under which rule Pro. Alok Jha was sanctioned different leave (Duty Leave) from\n            that he requested (one time special causal leave) after nearly one month of his letter\n            In respect of Point no. 5; the last hearing of the fact Finding Committee was on\n            16\/03\/2009. In this regard following information is needed:\n    i.      Any request letter issued to chairman regarding submission of report, if yes, give a\n            copy of his reply.\n    ii.     If not, it will indicate that university is not serious about the charges raised against\n            Prof. Jha.\n                                                                                        Page 1 of 3\n Order of the First Appellate Authority:\nNot enclosed.\n\nReply after First Appeal:\nAppellant was informed by Dy. Registrar (Admin.)-I\/CAPIO vide letter dated 09\/09\/2009 that\napplication was forwarded to FAA.\n\nGrounds for the Second Appeal:\nAppellant requested to provide the information as sought.\n\nRelevant Facts<\/pre>\n<p> emerging during Hearing held on 08\/02\/2010:\n<\/p>\n<p>The following were present<br \/>\nAppellant: Absent<br \/>\nRespondent: Mr. Rajan Srivastava (PIO).\n<\/p>\n<p>The PIO states that in response to the Appellant&#8217;s RTI application dated 18\/08\/2009 (received on<br \/>\n19\/08\/2009) he had asked the Appellant to deposit Rs 16 as additional fees on 15\/09\/2009. The<br \/>\nAppellant paid this amount on 23\/09\/2009 and the information was provided to him on<br \/>\n05\/10\/2009. Mr R Srivastava had provided information related to queries 2, 5 and 6. It appears<br \/>\nthe information has not been provided to queries 1, 3 and 4.\n<\/p>\n<p>The PIO claims that he has given information on the queries raised in RTI application dated<br \/>\n29\/08\/2009 by his letter of 03\/10\/2009. The PIO states that the report of fact finding committee<br \/>\nset up on 05\/04\/2007 regarding alleged plagiarism has not been received so far. It is a very<br \/>\ndeplorable state of affairs if a University takes over 2 years on a fact finding mission where<br \/>\nallegations of plagiarism are involved. By such actions a University can only be encouraging<br \/>\nplagiarism.\n<\/p>\n<p>Decision dated 08\/02\/2010:\n<\/p>\n<p>The Appeal was allowed.\n<\/p>\n<p>The PIO was directed to give information to the Appellant on query 1, 3 and 4 of the RTI<br \/>\napplication of 18\/08\/2009. This information had to be provided to the Appellant before<br \/>\n25\/02\/2010. The Commission directed the PIO to provide the terms of reference of the fact<br \/>\nfinding committee to the Appellant.\n<\/p>\n<p>Facts leading to Adjunct decision:\n<\/p>\n<p>The Commission received a letter dated 26\/02\/2010 from the Appellant wherein he stated that he<br \/>\nseeking information on Query No. 5 and not Query No. 4.\n<\/p>\n<p>The Commission has also received a letter dated 19\/02\/2010 from Dy. Registrar (Dev.), Banaras<br \/>\nHindu University stating that the requisite information under Query No. 1 could not be provided<br \/>\nin accordance with the exemption of Section 8(1) (h) of the RTI Act and under Query No. 2<br \/>\nbecause investigation is underway under the CCS (CCA) Rules.\n<\/p>\n<p><span class=\"hidden_text\">                                                                                    Page 2 of 3<\/span><\/p>\n<p> Announcing Adjunct decision on 26\/03\/2010:\n<\/p>\n<p>There has been an inadvertent typographical error in the Commission&#8217;s order dated 08\/02\/2010<br \/>\nwherein the PIO was directed to provide information on query No. 4 instead of query No. 5.<br \/>\nThus the Commission directs the PIO to provide information to the Appellant on query No. 5 of<br \/>\nthe RTI application dated 18\/08\/2009 before 13\/04\/2010.\n<\/p>\n<p>Furthermore, the Commission does not find the Respondent&#8217;s submissions with regard to<br \/>\nexemption tenable as exemptions cannot be claimed after the order of the Commission. The<br \/>\nrespondent could have given his reasons for claiming the exemptions during the hearing, which<br \/>\nhe did not do. With regard Query No.2, the PIO is hereby informed that the mere fact that an<br \/>\ninvestigation is underway through a committee is not enough to claim any exemption under the<br \/>\nRTI Act. The PIO is duty bound to implement the directions given to him by the Commission<br \/>\nwithin the time specified in the order. Since the PIO has not followed the directions given by the<br \/>\nCommission, it is initiating penalty proceedings against the PIO for willful defiance of the<br \/>\nCommission&#8217;s order.\n<\/p>\n<p>The PIO is directed to provide the information on query1,3 and 5 to the appellant before 10 April<br \/>\n2010.\n<\/p>\n<p>The issue before the Commission is of not supplying the complete, required information by<br \/>\nthe PIO within 30 days as required by the law.\n<\/p>\n<p>From the facts before the Commission it is apparent that the PIO is guilty of not furnishing<br \/>\ninformation within the time specified under sub-section (1) of Section 7 as per the requirement of<br \/>\nthe RTI Act. He has further refused to obey the orders of the Commission which raises a<br \/>\nreasonable doubt that the denial of information may also be malafide. It appears that the PIO&#8217;s<br \/>\nactions attract the penal provisions of Section 20 (1).\n<\/p>\n<p>A showcause notice is being issued to him, and he is directed give his reasons to the Commission<br \/>\nto show cause why penalty should not be levied on him.\n<\/p>\n<p>He will present himself before the Commission at the above address on 29 April 2010 at<br \/>\n2.30pm alongwith his written submissions showing cause why penalty should not be imposed on<br \/>\nhim as mandated under Section 20 (1).
