        Plaintiffs in O.S No.145 of 2008 on the<\/p>\n
file of Additional Munsiff Court-I, Neyyattinkara<\/p>\n
have filed this writ petition challenging the order<\/p>\n
passed by the learned Additional Munsiff to the<\/p>\n
extent, the amendment application moved by them was<\/p>\n
declined.   The above suit was one for permanent<\/p>\n
prohibitory injunction. The respondents\/defendants<\/p>\n
resisted the suit claim disputing the title of the<\/p>\n
plaintiffs over ‘D’ schedule property in respect of<\/p>\n
which the decree of injunction was sought for.<\/p>\n
After    the    suit    came    up    for    trial,<\/p>\n
petitioners\/plaintiffs moved   an  application  for<\/p>\n
amendment to seek additional relief of declaration<\/p>\n
of their title over ‘D’ schedule property and also<\/p>\n
right  of  prescriptive  easement  over  a  pathway<\/p>\n
W.P.(C).No.31441 OF 2009     Page numbers<\/p>\n
running    through     the  property   of  the  defendants<\/p>\n
seeking inclusion of that pathway as ‘C’ schedule in<\/p>\n
the plaint.         The application     for amendment  was<\/p>\n
opposed    to   by    the  respondents\/defendants.     The<\/p>\n
learned Additional Munisiff allowed the        application<\/p>\n
in part permitting the plaintiffs to amend the plaint<\/p>\n
for seeking the additional relief of declaration of<\/p>\n
their    title     over   ‘E’   schedule   property   with<\/p>\n
consequential      amendments   to    the  plaint.     The<\/p>\n
application in respect of the declaration of right of<\/p>\n
prescriptive easement and the consequential amendment<\/p>\n
sought thereof in the plaint, was disallowed. Ext.P8<\/p>\n
is   the    order     passed  by   the   learned  Munsiff.<\/p>\n
Propriety and correctness of Ext.P8 order to the<\/p>\n
extent it was disallowed is challenged in the writ<\/p>\n
petition invoking the supervisory jurisdiction vested<\/p>\n
with this court under Article 227 of the Constitution<\/p>\n
of India.\n<\/p>\n<\/p>\n
          2.     I heard the learned counsel for the<\/p>\n
petitioners\/plaintiffs.         Having    regard  to   the<\/p>\n

submissions made and taking note of the facts and<\/p>\n
circumstances presented      with   reference  to  Ext.P8<\/p>\n
order and also other exhibits tendered in the writ<\/p>\n
petition, I find no notice to the respondents is<\/p>\n
necessary and hence it is dispensed with.         At the<\/p>\n
time    of   hearing,    the learned    counsel for   the<\/p>\n
petitioners submitted that the trial of the suit has<\/p>\n
not commenced and no prejudice will be caused to the<\/p>\n
defendants by allowing the proposed amendment sought<\/p>\n
for   by    the   petitioners  and    that  the  proposed<\/p>\n
amendment is       essential to  avoid   multiplicity  of<\/p>\n
proceedings between the parties. Cause of action for<\/p>\n
seeking the amendment relating to the declaration of<\/p>\n
right of      prescriptive  easement    over the  pathway<\/p>\n
running through the property of the defendants arose<\/p>\n
subsequent to the institution of the present suit and<\/p>\n
in that contextual background to avoid multiplicity<\/p>\n
of proceedings the relief thereof was canvassed by<\/p>\n
way   of   amendment    in  the  present   suit, is  the<\/p>\n
submission of the counsel.         Perusing Ext.P8 order<\/p>\n
passed by the learned Munsiff I find that the learned<\/p>\n

Munsiff was correct in holding that the adjudication<\/p>\n
of the dispute canvassed relating to the right of<\/p>\n
prescriptive      easement  over   a   pathway   allegedly<\/p>\n
running through the property of defendants in the<\/p>\n
present suit, by way amending the plaint, cannot be<\/p>\n
granted.      Since the cause of action for canvassing<\/p>\n
the relief      claimed  under  that    amendment  can  be<\/p>\n
agitated by the plaintiffs by a separate suit it is<\/p>\n
open to the plaintiffs to do so. In the pending suit<\/p>\n
if the proposed amendment is allowed at this stage,<\/p>\n
naturally it will cause hardship and injury to the<\/p>\n
defendants.      So much so, reserving the right of the<\/p>\n
respondents to seek appropriate relief in respect of<\/p>\n
their claim of right of prescriptive easement over<\/p>\n
the alleged way running through the property of the<\/p>\n
defendants the writ petition is closed.<\/p>\n
