Justice M.L.JOSEPH FRANCIS\n\n Dated :03\/02\/2010\n\n O R D E R\n          K.M.JOSEPH &amp; M.L.JOSEPH FRANCIS, JJ.\n        ------------------------------------------------------\n                W.P.(C) No.35647 of 2009-A\n           ----------------------------------------------\n           Dated, this the 3rd day of February, 2010\n\n                         J U D G M E N T\n<\/pre>\n<p>K.M.Joseph, J.\n<\/p>\n<p>            Petitioner has approached this Court seeking the<\/p>\n<p>following reliefs:\n<\/p>\n<blockquote><p>      &#8220;i)   to issue a writ of mandamus or other<\/p>\n<p>      appropriate writ, order or direction commanding<\/p>\n<p>      the 4th respondent or any other officer at the<\/p>\n<p>      instance of 4th respondent not to harass and<\/p>\n<p>      intimidate the petitioner on the mere allegations<\/p>\n<p>      of purchase of stolen Gold Ornaments by stating<\/p>\n<p>      that the 4th respondent is duty bound to follow<\/p>\n<p>      Ext.P2 instructions of Ist respondent in dealing<\/p>\n<p>      with recovery of gold or ingots.\n<\/p><\/blockquote>\n<blockquote><p>      ii) to issue necessary order or direction to the<\/p>\n<p>      respondents not to harass the petitioner in<\/p>\n<p>      running his small jewelery shop in a lawful<\/p>\n<p>      manner.&#8221;\n<\/p><\/blockquote>\n<blockquote><p>            2.   Briefly put, the case of the petitioner is as<\/p>\n<p>follows:&#8211;Petitioner is the proprietor of a small jewellery shop<\/p>\n<p>in Thiruvananthapuram.       The petitioner has been running the<\/p>\n<p>shop for the past 15 years. It is stated that, on 7.12.2009 the<\/p>\n<p>3rd respondent with two police constables went to the jewellery<\/p>\n<p><span class=\"hidden_text\">WPC 35647\/2009                   -2-<\/span><\/p>\n<p>shop of the petitioner and demanded 5 sovereigns of gold<\/p>\n<p>ornaments from him stating that he            had purchased 5<\/p>\n<p>sovereigns of gold ornaments from a thief. It is stated that<\/p>\n<p>the petitioner told the 3rd respondent that he did not purchase<\/p>\n<p>even a gram of stolen gold ornaments from any thief till date.<\/p>\n<\/blockquote>\n<p>It is also stated that the police party told the petitioner that if<\/p>\n<p>the petitioner does not give 5 sovereigns of gold ornaments<\/p>\n<p>to the 3rd respondent he will be implicated in several cases<\/p>\n<p>under Section 411 IPC and he will not be allowed to sleep<\/p>\n<p>peacefully. Petitioner was asked to go to the police station on<\/p>\n<p>the next day itself.      Petitioner filed Ext.P1 representation<\/p>\n<p>before the 2nd respondent.     Ext.P2 is an order issued by the<\/p>\n<p>Government in the wake of the complaints received from the<\/p>\n<p>gold merchants about the practices of the police authorities.<\/p>\n<p>Ext.P3 is the interim order passed by this Court.<\/p>\n<p>             3.    A statement has been filed by the 4th<\/p>\n<p>respondent inter alia stating as follows:&#8211; A person was found<\/p>\n<p>in a suspicious circumstance and on questioning him he failed<\/p>\n<p>to explain his presence there.     On further questioning it was<\/p>\n<p>revealed that he is an ex-convict and his motive was<\/p>\n<p><span class=\"hidden_text\">WPC 35647\/2009                  -3-<\/span><\/p>\n<p>committing theft. A case was registered against him. There is<\/p>\n<p>reference to various other theft cases.     It is stated that he<\/p>\n<p>was remanded to police custody and the 4th respondent took<\/p>\n<p>up the investigation. It is stated that as per the confession of<\/p>\n<p>the accused the 4th respondent along with police party and<\/p>\n<p>the accused went to           Chalai, Thiruvananthapuram on<\/p>\n<p>7.12.2009. As pointed out by the accused the 4th respondent<\/p>\n<p>reached on LR jewelery at Valayachetty Theruvu, Chala. It is<\/p>\n<p>stated that while he reached at L.R.Jewellery it was opened<\/p>\n<p>and no one was there. He waited there with accused for more<\/p>\n<p>than two hours to see the owner of the jewelery but he could<\/p>\n<p>not find anybody and he could not know anything about the<\/p>\n<p>owner of the said jewelery except the confession of accused.<\/p>\n<p>It is also stated that on the same day some stolen properties<\/p>\n<p>were recovered from another jewellery as per the confession<\/p>\n<p>of the accused.\n<\/p>\n<p>             4. In paragraphs 6 and 7 of the statement it is<\/p>\n<p>stated as follows:\n<\/p>\n<blockquote><p>      &#8220;6.    The accused produced before JFMC II,<\/p>\n<p>      Attingal on 8.12.2009 after police custody and<\/p>\n<p>      the Hon&#8217;ble Court remanded him under judicial<\/p>\n<p><span class=\"hidden_text\">WPC 35647\/2009                  -4-<\/span><\/p>\n<p>     custody. The case 461\/06 of Kilimanoor Police<\/p>\n<p>     Station crime and 91\/09 Pallikkal Police Station<\/p>\n<p>     were treated as UN and now they are re-opened<\/p>\n<p>     on the strength of the confession of the accused.<\/p>\n<p>     All the above three cases are now under<\/p>\n<p>     investigation.\n<\/p><\/blockquote>\n<blockquote><p>     7.    In this cases remaining accused are to be<\/p>\n<p>     arrested    and    stolen  properties   are  to   be<\/p>\n<p>     recovered.      Investigation is going on in this<\/p>\n<p>     regard. On my enquiry, it is revealed that, the<\/p>\n<p>     shop is running smoothly till date without any<\/p>\n<p>     interference from the part of police.&#8221;<\/p>\n<\/blockquote>\n<blockquote><p>             We record the statement filed by the 4th<\/p>\n<p>respondent and close the writ petition.
