No.27539 of 2010\n                  RAM ISHWAR YADAV SON OF LATE DHANESHWAR YADAV\n                                            Versus\n                                     STATE OF BIHAR\n                                          -----------\n<\/pre>\n<p>2.   16.8.2010                Heard learned Counsel for the petitioner and the State.<\/p>\n<p>                              The petitioner seeks bail in a case instituted for the<\/p>\n<p>                 offence under Section 3 of the R.P. (U.P.) Act.\n<\/p>\n<p>                              Considering that the petitioner is in custody since<\/p>\n<p>                 9.6.2010 and there is no other case of similar nature pending<\/p>\n<p>                 against him, which fact will be verified by the Magistrate concerned<\/p>\n<p>                 before releasing the petitioner on bail, let the petitioner above<\/p>\n<p>                 named be released on bail on furnishing bail bond of Rs.5,000\/-<\/p>\n<p>                 (Five thousand) with two sureties of the like amount each to the<\/p>\n<p>                 satisfaction of Railway Judicial Magistrate, Gaya in connection with<\/p>\n<p>                 R.P.F. Post Jehanabad P.S.case No.1 of 2010, subject to the<\/p>\n<p>                 conditions (i) That one of the bailors will be a close relative of the<\/p>\n<p>                 petitioner who will give an affidavit giving genealogy as to how he<\/p>\n<p>                 is related with the petitioner. The bailor will undertake to furnish<\/p>\n<p>                 information to the court about any change in the address of the<\/p>\n<p>                 petitioner, (ii) that the bailor shall also state on affidavit that he will<\/p>\n<p>                 inform the court concerned if the petitioner is implicated in any<\/p>\n<p>                 other case of similar nature after his release in the present case<\/p>\n<p>                 and thereafter the court below will be at liberty to initiate the<\/p>\n<p>                 proceeding for cancellation of bail on the ground of misuse, (iii) that<\/p>\n<p>                 the petitioner will give an undertaking that he will receive the police<\/p>\n<p>                 papers on the given date and be present on date fixed for charge<br \/>\n<span class=\"hidden_text\">                                   -2-<\/span><\/p>\n<p>            and if he fails to do so on two given dates and delays the trial in<\/p>\n<p>            any manner, his bail will be liable to be cancelled for reasons of<\/p>\n<p>            misuse and (iv) that the petitioner will be well represented on each<\/p>\n<p>            date and if he fails to do so on two consecutive dates, his bail will<\/p>\n<p>            be liable to be cancelled.\n<\/p>\n<\/p>\n<p>                                   ( Anjana Prakash, J. )<\/p>\n<p>Narendra\/\n <\/p>\n","protected":false},"excerpt":{"rendered":"<p>Patna High Court &#8211; Orders Ram Ishwar Yadav vs State Of Bihar on 16 August, 2010 IN THE HIGH COURT OF JUDICATURE AT PATNA Cr.Misc.
