SHAH\n\t\t\n\t\n\n \n\nDate\n: 23\/08\/2010 \n\n \n\nORAL\nORDER<\/pre>\n<p>1.\t\tBy<br \/>\nway of these petitions under Article 226 of the Constitution of<br \/>\nIndia, the respective petitioners have prayed for the following main<br \/>\nreliefs:\n<\/p>\n<p> 14.[A]\tYour<br \/>\nLordships may be pleased to issue a writ of mandamus, or a writ in<br \/>\nthe nature of mandamus, or any other writ, order or direction<br \/>\nquashing and setting aside the impugned order dated 20.11.2009 as<br \/>\nwell as the impugned notice dated 14.10.2009, passed and issued by<br \/>\nthe Respondents and further be pleased to permanently restrain the<br \/>\nRespondents, their agents, servants, officers and\/or representatives<br \/>\nfrom demolishing the premises of the petitioners;\n<\/p>\n<p>\tIn<br \/>\nthe alternative<\/p>\n<p>[B]\tYour<br \/>\nLordships may be pleased to issue a writ of mandamus, or a writ in<br \/>\nthe nature of mandamus, or any other writ, order or direction<br \/>\ncommanding the Respondents herein to decide the representation dated<br \/>\n03.10.2009, 14.10.2009 and 08.07.2010 at the earliest in accordance<br \/>\nwith law.\n<\/p>\n<p>2.\t\tAfter<br \/>\nthe matter was argued for some time, Mr.S.I.Nanavati, learned Senior<br \/>\nAdvocate appearing on behalf of the respective petitioners, under the<br \/>\ninstructions received from the respective petitioners, has requested<br \/>\nto permit the petitioners to withdraw the present petitions and grant<br \/>\nthem time upto 29\/08\/2010 to remove the unauthorized construction in<br \/>\nquestion, which are pointed out in the Notice under Section 260 of<br \/>\nthe Bombay Provincial Municipal Corporations Act, in presence of the<br \/>\nOfficer of the respondent-Corporation so that there is no further<br \/>\ndamage to the goods and materials lying in the premises in question.\n<\/p>\n<p>\t\tIt<br \/>\nis further stated by Shri Nanavati that after demolishing all the<br \/>\nunauthorised construction in question, the respective petitioners<br \/>\npropose to submit appropriate representation before the<br \/>\nrespondent-Corporation to consider their request with respect to use<br \/>\nof the properties in question, as according to them, their<br \/>\napplications to regularise their unauthorized construction under the<br \/>\nGujarat Regularisation of Unauthorised Development Act is still<br \/>\npending and for which, necessary impact fees is already paid by the<br \/>\nrespective petitioners much prior to the relevant date.\n<\/p>\n<p>3.\t\tMr.S.N.Shelat,<br \/>\nlearned Senior Advocate appearing with Mr.R.M.Chhaya, learned<br \/>\nadvocate appearing on behalf of the respondent-Corporation has<br \/>\nsubmitted that there is no question of considering the<br \/>\nrepresentations of the respective petitioners, as according to the<br \/>\nCorporation, no further decision is required to be taken on the<br \/>\napplications submitted by the respective petitioners and\/or by the<br \/>\nBuilders to regularise their unauthorized construction under the<br \/>\nGujarat Regularisation of Unauthorised Development Act and the same<br \/>\nwas already conveyed by issuing Notice under Section 260 of the<br \/>\nBombay Provincial Municipal Corporations Act.\n<\/p>\n<p>\t\tBe<br \/>\nthat it may, undertakings filed by the respective petitioners are<br \/>\ndirected to be taken on record and the respective petitioners are<br \/>\nhereby granted time upto 29\/08\/2010 to remove all the unauthorized<br \/>\nconstruction in question as pointed out in the Notices under Section<br \/>\n260 of the Bombay Provincial Municipal Corporations Act, in presence<br \/>\nof the Officer of the Corporation (so as to avoid any allegations and<br \/>\ncounter allegations).\n<\/p>\n<p>4.\t\tIn<br \/>\nview of the above and considering the request made by<br \/>\nMr.S.I.Nanavati, learned Senior Advocate appearing on behalf of the<br \/>\nrespective petitioners, all these petitions are dismissed as<br \/>\nwithdrawn without expressing any opinion with respect to<br \/>\nentertainability and\/or maintainability of the representations to be<br \/>\nmade by the respective petitioners.
