He has no criminal antecedents. He is unlikely to jump the<br \/>\n\tbail. The allegations pertain to dying declaration recorded against<br \/>\n\thim many years back. He, therefore, prayed that the applicant be<br \/>\n\tenlarged on bail.\n<\/p>\n<p>On<br \/>\n\tthe other hand learned A.P.P. as well as learned Counsel Shri Sharma<br \/>\n\tfor H.L.Patel Advocates appear for the State and the complainant<br \/>\n\trespectively opposed the bail application contending that<br \/>\n\tinvestigation is not yet over and the applicant has allegedly<br \/>\n\tcommitted serious offence.\n<\/p>\n<p>In<br \/>\n\tso far as bail application is concerned, I do not see any reason to<br \/>\n\tdetain the applicant in custody, particularly when being a<br \/>\n\tgovernment servant and not having any previous criminal antecedents,<br \/>\n\tthere is no apprehension voiced by the prosecution that he is likely<br \/>\n\tto jump the bail.\n<\/p>\n<p>Under<br \/>\n\tthe circumstances, the applicant is ordered to be released on bail<br \/>\n\tin connection with FIR being C.R.No.I-304 of 2004 registered before<br \/>\n\tGodhara Town Police Station, Godhra on his furnishing bond of<br \/>\n\tRs.50,000\/- (Rupees Fifty Thousand Only) with one surety of the like<br \/>\n\tamount to the satisfaction of the lower court and subject to the<br \/>\n\tfollowing conditions that he shall:\n<\/p>\n<p>(a)\tnot take undue<br \/>\nadvantage of his liberty or abuse his liberty;\n<\/p>\n<p>(b)\tnot act in a manner<br \/>\ninjurious to the interest of the prosecution;\n<\/p>\n<p>(c)\tmaintain law and<br \/>\norder;\n<\/p>\n<p>(d)\tnot leave the State<br \/>\nof Gujarat without prior permission of the Sessions Judge concerned;\n<\/p>\n<p>(e)\tfurnish the address<br \/>\nof his residence at the time of execution of the bond and shall not<br \/>\nchange the residence without prior permission of this Court;\n<\/p>\n<p>(f)\tmark presence in<br \/>\nDahod Police Station on every 1st and 15th day<br \/>\nof English Calendar month between 11:00 am to 2:00 pm;\n<\/p>\n<p>(g)\tnot enter in the<br \/>\nlimit of Godhra District without permission of the trial court,<br \/>\nexcept to attend the court case;\n<\/p>\n<p>(h)\tsurrender his<br \/>\npassport, if any, to the Lower Court immediately.\n<\/p>\n<p>If<br \/>\n\tbreach of any of the above conditions is committed, the Sessions<br \/>\n\tJudge concerned will be free to take appropriate action in the<br \/>\n\tmatter.\n<\/p>\n<p>Bail<br \/>\n\tbefore the Lower Court having jurisdiction to try the case.\n<\/p>\n<p>Rule<br \/>\n\tis made absolute.
