Respondents\n\n\n        Criminal Appeal is  directed  against  the  judgment  dated  14.6.2002\nrendered in  C.C.No.  5728 of 2000 by the Court of IX Metropolitan Magistrate,\nat Saidapet, Chennai, as stated therein.\n\n!For Appellant :  Mr.S.Venkatesan.\n\n^For Respondent:  No appearance.\n\n:JUDGMENT\n<\/pre>\n<p>        The above Criminal Appeal  is  directed  against  the  judgment  dated<br \/>\n14.6.2002  rendered  in  C.C.No.5728  of  2000 by the Court of IX Metropolitan<br \/>\nMagistrate, Saidapet, Chennai, thereby dismissing the complaint filed  by  the<br \/>\nappellant  against the respondents for an offence punishable under Section 138<br \/>\nand 141 of Negotiable Instruments Act, as amended with Section 200  &amp;  357  of<br \/>\nthe Cr.P.C.    and  acquitting the respondents under Section 204(4) of Cr.P.C.<br \/>\non account of the appellant having not  taken  proper  steps  in  the  private<br \/>\ncomplaint initiated by him.\n<\/p>\n<p>        2.      Heard  the  learned  counsel for the appellant and perused the<br \/>\nrecords.  Proof affidavit has been  filed  by  the  learned  counsel  for  the<br \/>\nappellant  for  having  served  notice  on  all  the respondents and hence the<br \/>\nservice is  held  sufficient.    Respondents  are  called  absent   since   no<br \/>\nrepresentation has  been  made on their behalf.  Hence this Court is left with<br \/>\nno choice but to decide the above appeal on  merits  in  accordance  with  law<br \/>\nhaving  regard  to the materials placed on record and upon hearing the learned<br \/>\ncounsel for the appellant.\n<\/p>\n<p>        3.  The lower Court has simply passed a  one  sentence  order  stating<br \/>\nthat,  since for a long time the complainant did not come forward to prosecute<br \/>\nthe complaint,it is revealed that he has no interest in prosecuting  the  case<br \/>\nagainst  the  respondents  and  hence  dismissed  the  said  complaint thereby<br \/>\nacquitting the respondents under  Section  204(4)  of  the  Cr.P.C.    without<br \/>\nassigning any other valid or tangible reason and hence, the appellant has come<br \/>\nforward  to  prefer the above Criminal Appeal on certain grounds as pleaded in<br \/>\nthe grounds of appeal.\n<\/p>\n<p>        4.  The learned counsel appearing on behalf  of  the  appellant  would<br \/>\nargue  that  Section  204(4)  is not applicable to the case in hand, factually<br \/>\nsince the Section warrants &#8216;when by any law for the time being  in  force  any<br \/>\nprocess  fees  or other fees are payable, no process shall be issued until the<br \/>\nfees are paid and if such fees are not paid  within  a  reasonable  time,  the<br \/>\nMagistrate may dismiss the complaint.&#8217;<\/p>\n<p>        5.   The  learned counsel would further argue that in the case in hand<br \/>\nthis situation is not present.  It is not at all the  case  of  the  appellant<br \/>\nthat  he  has  not  paid  the  fees  as ordered by the Court so as to make the<br \/>\nMagistrate to dismiss the complaint as he has done in the case in hand but  in<br \/>\nspite  of  having  taken the steps in paying the fees relevant for the service<br \/>\nbeing effected, but for other reasons the service is not able  to  be  carried<br \/>\nout and the Magistrate, under the wrong impression that it falls under Section<br \/>\n204(4) of Cr.P.C.  has passed the order which is not correct nor could such an<br \/>\norder passed by the Magistrate be sustained.\n<\/p>\n<p>        6.   There  is  force  in the arguments of the learned counsel for the<br \/>\nappellant.  Moreover, in the absence of any  counter  arguments  coming  forth<br \/>\nfrom  the other side and since no one appeared on behalf of the respondents in<br \/>\nspite of they having been served, in consideration of  the  arguments  of  the<br \/>\nlearned  counsel  for  the  appellant  and the order of the lower Court passed<br \/>\nwhich has no bearing on the Section 204(4) of the Cr.P.C., this  Court  is  of<br \/>\nthe  view  that  dismissing  the  complaint filed by the petitioner under this<br \/>\nSection is neither proper nor could the same be sustained in law and hence the<br \/>\nonly course open for this Court, under these circumstances, is  to  set  aside<br \/>\nthe  order  of  the  trial  Court and remand the same for carrying on with the<br \/>\nusual procedures established by law so as to  deliver  the  judgment  in  full<br \/>\nconsideration  of the facts and circumstances encircling the whole case and in<br \/>\naccordance with the law and hence the following order:\n<\/p>\n<blockquote><p>        In result,\n<\/p><\/blockquote>\n<blockquote><p>        (i) the above Criminal Appeal succeeds and the same is allowed;<\/p><\/blockquote>\n<p>        (ii) the judgment dated 14.6.2002 rendered in C.C.No.  5728 of 2000 by<br \/>\nthe Court of IX Metropolitan Magistrate, at Saidapet, Chennai, is  hereby  set<br \/>\naside;\n<\/p>\n<p>        (iii) the case is remanded to the trial Court for continuing the trial<br \/>\nprocedures  from where it has been left with and to deliver the judgment after<br \/>\nfull trial in full consideration of the facts and circumstances  of  the  case<br \/>\nand in accordance with law.\n<\/p>\n<p>        (iv) Consequently Crl.O.P.No.30802 OF 2002 is also allowed.\n<\/p>\n<p>27-12-2002<br \/>\ngr.\n<\/p>\n<p>Index:  Yes<br \/>\nInternet:  Yes<\/p>\n<p>To\n<\/p>\n<p>1.
