Justice M.SASIDHARAN NAMBIAR\n\n Dated :16\/01\/2009\n\n O R D E R\n              M.SASIDHARAN NAMBIAR,J.\n\n              ------------------------------------------\n               CRL.R.P.NO.3918 OF 2008\n              ------------------------------------------\n\n               Dated       16th January 2009\n\n\n                           O R D E R\n<\/pre>\n<p>           Revision      petitioner          is     the   accused  and<\/p>\n<p>second respondent, the complainant                in C.C.230\/2005 on<\/p>\n<p>the  file  of   Judicial          First       Class      Magistrate-I,<\/p>\n<p>Chengannur.  Revision       petitioner          was     convicted and<\/p>\n<p>sentenced to simple imprisonment for three months and<\/p>\n<p>compensation of Rs.1,50,000\/- an in default simple<\/p>\n<p>imprisonment  for two months                for the offence under<\/p>\n<p>Section 138 of Negotiable Instruments Act. Revision<\/p>\n<p>petitioner   challenged the conviction and sentence<\/p>\n<p>before the Additional Sessions court, Mavelikara in<\/p>\n<p>Crl.A.667\/2006. Learned Additional Sessions Judge                   on<\/p>\n<p>re-appreciation of evidence confirmed the                   conviction<\/p>\n<p>and  sentence   and      dismissed          the      appeal.   It   is<\/p>\n<p>challenged in the revision.\n<\/p>\n<p>    2.   Learned     counsel          appearing         for   revision<\/p>\n<p>petitioner and learned counsel appearing for second<\/p>\n<p>respondent were heard.\n<\/p>\n<p>    3.   Learned     counsel        appearing           for   revision<\/p>\n<p>CRRP 3918\/08<br \/>\n<span class=\"hidden_text\">                              2<\/span><\/p>\n<p>petitioner submitted that in view of the evidence on<\/p>\n<p>record and the concurrent findings of fact, revision<\/p>\n<p>petitioner   is  not  challenging  the   conviction  but<\/p>\n<p>sentence may be modified and time may be granted to make<\/p>\n<p>payment.\n<\/p>\n<p>     4.    On going through the judgments of the courts<\/p>\n<p>below,   I  find  no   reason  to  interfere  with   the<\/p>\n<p>conviction. Evidence establish that revision petitioner<\/p>\n<p>borrowed Rs.1,50,000\/-    from second    respondent and<\/p>\n<p>issued Ext.P1 cheque dated 3\/1\/2005 for repayment of<\/p>\n<p>that  amount,     which  was  dishonoured  for  want  of<\/p>\n<p>sufficient funds when presented for encashment. It is<\/p>\n<p>also proved that second    respondent had complied with<\/p>\n<p>all statutory formalities provided under Sections 138<\/p>\n<p>and  142     of  Negotiable  Instruments  Act.  In  such<\/p>\n<p>circumstances conviction of revision petitioner for the<\/p>\n<p>offence under Section 138 of Negotiable Instruments Act<\/p>\n<p>is perfectly legal.\n<\/p>\n<p>     5.    Then the question is regarding the sentence.<\/p>\n<p>Ext.P1 cheque is for Rs.1,50,000\/-. Learned Magistrate<\/p>\n<p>awarded   a  compensation  of  Rs.1,50,000\/-  to  second<\/p>\n<p>respondent.    Considering   the   entire   facts    and<\/p>\n<p>circumstances of the case,   interest of justice will be<\/p>\n<p>CRRP 3918\/08<br \/>\n<span class=\"hidden_text\">                             3<\/span><\/p>\n<p>met, if the sentence is modified to imprisonment till<\/p>\n<p>rising of court and fine with a direction        to pay<\/p>\n<p>compensation out of the fine to second respondent on<\/p>\n<p>realisation.\n<\/p>\n<p>      Revision petition is allowed in part. Conviction<\/p>\n<p>of revision petitioner   for the offence under Section<\/p>\n<p>138 of Negotiable Instruments Act is confirmed. Sentence<\/p>\n<p>is  modified.   Revision  petitioner  is  sentenced   to<\/p>\n<p>imprisonment   till  rising  of   court  and   fine   of<\/p>\n<p>Rs.1,60,000\/- and in default simple imprisonment for two<\/p>\n<p>months. On realisation of fine Rs.1,50,000\/- to be paid<\/p>\n<p>to second respondent as compensation under Section   357<\/p>\n<p>(1)(b)    of  Code  of  Criminal   Procedure.   Revision<\/p>\n<p>petitioner is granted    five months time to pay the<\/p>\n<p>fine.
