SINHA\n                                           Versus\n                                THE STATE OF BIHAR\n                                         -----------\n<\/pre>\n<p>2.   07.03.2011             Heard        learned        counsels       for     the<\/p>\n<p>                  petitioners and the State.\n<\/p>\n<p>                            The    petitioners          being   the      husband<\/p>\n<p>                  and    family     members        of    the    husband         are<\/p>\n<p>                  apprehending their arrest in complaint case<\/p>\n<p>                  in    which    cognizance     has      been     taken       under<\/p>\n<p>                  Section 498A of the I.P.C.\n<\/p>\n<p>                            Learned counsels for the petitioners<\/p>\n<p>                  and the complainant on instructions submit<\/p>\n<p>                  that both the husband and wife are ready to<\/p>\n<p>                  resume the conjugal life.\n<\/p>\n<p>                                However,     learned      counsel       for    the<\/p>\n<p>                  petitioners        submits            that      in         solemn<\/p>\n<p>                  affirmation the complainant has stated that<\/p>\n<p>                  she does not want to stay with the husband.<\/p>\n<p>                            Considering         the        stand        of     the<\/p>\n<p>                  parties, let the petitioners, Jagdish Singh,<\/p>\n<p>                  Bindhawashni Devi, Subhash Singh @ Subhash<\/p>\n<p>                  Chandra       Singh,    Chandra       Shekhar    Singh        and<\/p>\n<p>                  Subodh    Singh        @   Subodh       Kumar        Sinha     be<br \/>\n<span class=\"hidden_text\">                            2<\/span><\/p>\n<p>        released on bail in the event of arrest or<\/p>\n<p>        surrender    before          the    learned      court        below<\/p>\n<p>        within a period of twelve weeks from today<\/p>\n<p>        in connection with complaint case no. 91C of<\/p>\n<p>        2009 on furnishing bail bond of Rs.10,000\/-<\/p>\n<p>        (Ten Thousand)each            with two sureties of the<\/p>\n<p>        like amount each to the satisfaction of the<\/p>\n<p>        learned     C.J.M.       Khagaria,         subject       to     the<\/p>\n<p>        conditions as laid down under Section 438(2)<\/p>\n<p>        of the Code of Criminal Procedure.<\/p>\n<p>                  The     husband&#8217;s         bail     bond       will     be<\/p>\n<p>        provisionally accepted.\n<\/p>\n<p>                  Let     the        husband       and    complainant<\/p>\n<p>        appear    before       the    learned      court     below       on<\/p>\n<p>        28.03.2011        when        the        complainant           will<\/p>\n<p>        accompany    the       husband       to    her    matrimonial<\/p>\n<p>        house.\n<\/p>\n<p>                    The   provisional            bail    bond    of     the<\/p>\n<p>        petitioner will be finally accepted in two<\/p>\n<p>        eventualities of substantial restoration of<\/p>\n<p>        matrimonial       life       or     on    refusal       of      the<\/p>\n<p>        complainant to accompany the husband.<\/p>\n<pre>U.
