APPEAL No. 209 of 1997\n\n                              BHAGWAN LAL\n                                  V\/S\n                              RANJIT SINGH\n\n\nDate of Judgment                   :          6.11.2008\n\n\n                             PRESENT\n                    HON'BLE SHRI N.P.GUPTA,J.\n\n\nMr. Dilip Kawadia, for the appellant.\nMr. Sanjeev Johari, the respondent.\n\n\nBY THE COURT:<\/pre>\n<p>          These two appeals have been filed by the claimants<\/p>\n<p>against the award of the Motor Accident Claims Tribunal<\/p>\n<p>No.2,   Udaipur     dated     31.1.1997   deciding   three   claim<\/p>\n<p>petitions, being claim No.133\/90 &#8220;Bhagwan Lal Vs. Ranjeet<\/p>\n<p>Singh &amp; Ors.&#8221;, claim No.134\/90 &#8220;Prakash Vs. Ranjeet Singh &amp;<\/p>\n<p>Ors.&#8221; and claim No.135\/90 &#8220;Kachru Lal Vs. Ranjeet Singh &amp;<\/p>\n<p>Ors&#8221;. It appears that no appeal has been filed against the<\/p>\n<p>award passed in claim No.135\/90 &#8220;Kachru Lal Vs. Ranjeet<br \/>\n<span class=\"hidden_text\">                                                                                                 2<\/span><\/p>\n<p>Singh    &amp;    Ors.&#8221;,          and    these       two     appeals            have    been   filed<\/p>\n<p>against the award passed in Claim No.133 and 134.<\/p>\n<p>              Learned Tribunal has awarded a lump sum amount of<\/p>\n<p>Rs.25,000\/-        in        claim    No.134\/90,            and    awarded         a   lump   sum<\/p>\n<p>amount of Rs.55,000\/- in claim No.133\/90.<\/p>\n<p>              A look at the findings of the learned Tribunal<\/p>\n<p>shows    that      in    claim       No.133,       a    sum       of    Rs.2,19,000\/- was<\/p>\n<p>claimed      under       different         heads       in    which          medical    expenses<\/p>\n<p>were claimed at Rs.20,000\/-, loss of income was claimed at<\/p>\n<p>Rs.24,000\/-,         mental          pain     and      agony           was     quantified      at<\/p>\n<p>Rs.20,000\/-,         and       a     compensation            for       permanent       loss    of<\/p>\n<p>income       was   claimed           at     Rs.1,45,000\/-.               The       injuries    as<\/p>\n<p>appeared in Ex.5, the X-Ray report are that the injured<\/p>\n<p>Bhagwan Lal sustained fracture of tibia and fibula in left<\/p>\n<p>leg, and has suffered 3% permanent disablement as appears<\/p>\n<p>from disablement certificate Ex.107.                               The learned Tribunal<\/p>\n<p>has only observed that the bills for medical expenses as<\/p>\n<p>have     been      produced           totaled       to       Rs.5908\/-.            With    this,<\/p>\n<p>considering        the        fact,       that    in     cases         of    fractures,       the<\/p>\n<p>minimum       compensation                awardable           is        Rs.25,000\/-,          and<\/p>\n<p>therefore, a total amount of Rs.55,000\/- has been awarded.<\/p>\n<p>              Similarly,             coming       to        claim       No.134,        a   total<\/p>\n<p>compensation            of     Rs.1,39,000\/-            has        been       claimed      under<\/p>\n<p>different heads. The claimant Prakash sustained fracture of<br \/>\n<span class=\"hidden_text\">                                                                                  3<\/span><\/p>\n<p>upper    1\/3rd      of     the   left    femur,    apart    from   other    simple<\/p>\n<p>injuries. The learned Tribunal found that the medical bills<\/p>\n<p>produced totalled to Rs.633\/-, and found from the statement<\/p>\n<p>of the claimant that he has not suffered any future loss of<\/p>\n<p>income. With this, a lump sum compensation of Rs.25,000\/-<\/p>\n<p>has been awarded.\n<\/p>\n<\/p>\n<p>               In my view, the order of the learned Tribunal<\/p>\n<p>cannot be appreciated, inasmuch as, where specific evidence<\/p>\n<p>was      led        regarding      nature         of   injuries,      treatment,<\/p>\n<p>disablement, etc., compensation was required to be assessed<\/p>\n<p>under different head as may be admissible to the claimant,<\/p>\n<p>to the extent, as may be established by the evidence on<\/p>\n<p>record. The award of claim is not to be made as an ex-<\/p>\n<p>gratia payment, as appears to have been done by learned<\/p>\n<p>Tribunal, by making a lump sum award.\n<\/p>\n<\/p>\n<p>               In the totality of circumstances, I do not stand<\/p>\n<p>advised    to       undertake      the    exercise     of   threshing    out   the<\/p>\n<p>entire    evidence          over   again    myself     in   this     appeal,   and<\/p>\n<p>arrive at a different figure of compensation payable under<\/p>\n<p>different heads, and stand better advised to remand the<\/p>\n<p>matters        to    the    learned      Tribunal      to   decide    the   claim<\/p>\n<p>petitions afresh on the aspect of quantum, keeping in view<\/p>\n<p>the observations already made above, and on the basis of<\/p>\n<p>the material already available on record.<br \/>\n<span class=\"hidden_text\">                                                                                      4<\/span><\/p>\n<p>            Accordingly, the appeals are allowed. The impugned<\/p>\n<p>awards are set aside, and the matters are remanded back to<\/p>\n<p>the learned Tribunal to decide the claim petitions afresh<\/p>\n<p>on the aspect of quantum, keeping in view the observations<\/p>\n<p>already    made    above,        and   on   the     basis    of      the     material<\/p>\n<p>already     available       on     record.        Records       of    the    learned<\/p>\n<p>Tribunal     be    returned       forthwith.        The    parties      to     appear<\/p>\n<p>before     the    learned     Tribunal       on     8.12.2008.
