             The petitioner  is  facing the accusation    for the<\/p>\n
offence   punishable   under   Section     376   IPC,   as   he   had<\/p>\n
committed rape on a minor girl, who is born to his wife  of<\/p>\n
her   first   husband.     After   the   delivery,     the   child   was<\/p>\n
thrown to the adjacent   tea estate.   With the intervention<\/p>\n
of the police,  the child was rescued.  The police registered<\/p>\n
the case against the minor girl,   who delivered the infant,<\/p>\n
as   well   as   her   mother   together   with   the     petitioner,   for<\/p>\n
different   offence.     The   petitioner   had   surrendered   on<\/p>\n
6.6.2006 in crime No.130\/2006 of Vizhinjam police station.<\/p>\n
He approached this Court for bail.\n<\/p>\n<\/p>\n
      2.     While the bail application was pending, without<\/p>\n
disclosing   the   same,           the   petitioner   filed   another<\/p>\n
application   for   statutory   bail.     The   learned   Magistrate,<\/p>\n
unaware of the pendency of the bail application before this<\/p>\n
Court,  granted bail to him on 18.8.2006.<\/p>\n

       3.     A   report   was   called   from   the   learned<\/p>\n
Magistrate.     He   informed   that   he   was   unaware   of   the<\/p>\n
pendency of the matter.  The matter show that a woman,<\/p>\n
by name Parvathy Sarojam,  was behind the filing of that<\/p>\n
petition   and   the   counsel   of   Neyyattinkara   Magistrate<\/p>\n
Court was also involved in it.\n<\/p>\n<\/p>\n
       4.     Finding   the   foul   play   in   the   entire   matter,   I<\/p>\n
had   directed   the   Registrar   of   Subordinate   Judiciary   to<\/p>\n
enquire into the whole episode and file a report, as it was<\/p>\n
stated     before   this   Court,   through   the   counter   affidavit<\/p>\n
filed by the  petitioner,    that the said   Parvathy Sarojam<\/p>\n
had   collected   huge   amount   of   Rs.24,000\/-   from   his<\/p>\n
mother   for   getting   bail.     But   she   did   not   pay   it   to   the<\/p>\n
counsel except for a paltry sum.   She claimed herself to<\/p>\n
be   the   clerk   of   an   advocate   practicing   before   the<\/p>\n
Magistrate Court.   She also filed an affidavit before this<\/p>\n
Court   along   with   this   application,   stating   that   she   is   a<\/p>\n
cousin of the petitioner.  However, this was being denied<\/p>\n
by the petitioner, when he appeared before me.<\/p>\n

      5.      On getting the entire facts,  I had directed the<\/p>\n
petitioner to be present before  this Court.   Accordingly,<\/p>\n
he   appeared   before   this   Court   on   12.9.2006,   on   which<\/p>\n
date   he   filed   a   statement   also.     After   considering   the<\/p>\n
materials,   I   had   directed   him   to   surrender   before   the<\/p>\n
Judicial   Magistrate   of   First   Class-II,   Neyyattinkara,   on<\/p>\n
19.9.2006 at 11.00 a.m.  Accordingly he surrendered and<\/p>\n
he remains in judicial custody.\n<\/p>\n<\/p>\n
      6.      When   the   application   came   up   for<\/p>\n
consideration,   the   learned   counsel   submitted   that   the<\/p>\n
petitioner   had   completed   90   days   in   judicial   custody,<\/p>\n
namely   from   6.6.2006   to   16.8.2006   and   from   19.9.2006<\/p>\n
till date.\n<\/p>\n<\/p>\n
      7.      After   hearing   both   sides   and   considering   the<\/p>\n
materials   that   are   placed   before   me,   without   affecting<\/p>\n
the further proceedings that may be initiated against the<\/p>\n
petitioner,   the   said   Parvathy   Sarojam,   the   counsel<\/p>\n
concerned and anyone else in this case, I grant bail and<\/p>\n
release   the   petitioner   from   jail,   subject   to   the   following<\/p>\n

conditions:-\n<\/p>\n<\/p>\n
          (a).    The petitioner shall execute a bond<\/p>\n
          for Rs.25,000\/-, with two solvent sureties,<\/p>\n
          each for the like sum, to the satisfaction<\/p>\n
          of   the   Judicial   Magistrate   of   First   Class-<\/p>\n
          II, Neyyattinkara.\n<\/p><\/blockquote>\n
\n<\/blockquote>\n
          (b).    The   petitioner   shall   report   before<\/p>\n
          the Investigating Officer, once in a week<\/p>\n
          on every Wednesday, between 10.00 a.m<\/p>\n
          and   11.00   a.m.,   for   a   period   of   three<\/p>\n
          months,   starting   from   25.10.2006,   and<\/p>\n
          thereafter,   on   the   first   working   day     of<\/p>\n
          every month, between the same timings,<\/p>\n
          till   the   completion     of  the   trial   and   final<\/p>\n
          disposal of the case.\n<\/p><\/blockquote>\n
\n<\/blockquote>\n
          (c).    The   petitioner   shall   not   cause   any<\/p>\n
          threat   to   the   victim,     her   mother   or   to<\/p>\n
          any   witnesses   using   his   influence   and<\/p>\n
          control over them,   while he is on bail.<\/p><\/blockquote>\n
          (d).    The   petitioner   shall   not   leave   the<\/p>\n

          State   of   Kerala,     till   the   disposal   of   the<\/p>\n
          cases   as   well   as   the            proceedings<\/p>\n
          thereon, that  may be  initiated basing  on<\/p>\n

          The application is allowed as above.<\/p>\n

The application under Section 439 Cr.P.C., was pending<\/p>\n
before   this   Court.     The   petitioner   is   the   accused,   who<\/p>\n
committed rape on a sixteen  year old girl,   who is none<\/p>\n
other than the daughter of his second wife.  She became<\/p>\n
pregnant   and     delivered   a   child.     The   child   was<\/p>\n
abandoned.           Accordingly   crime   No.115\/2006   of<\/p>\n
Vizhinjam  Police   station,   was  registered  for   abandoning<\/p>\n
the child, against the sixteen year old girl, who delivered<\/p>\n
the child, as well as her mother, the wife of the petitioner<\/p>\n
herein.  The same is  under investigation.  Meanwhile, on<\/p>\n
the   statement   of   the   victim,   the   sixteen   year   old   girl,<\/p>\n
crime No.130\/2006 of Vizhinjam Police Station, was also<\/p>\n
registered.\n<\/p>\n<\/p>\n
      2.     When the bail application came up before this<\/p>\n
Court, I heard the learned counsel Mr. Sasthamangalam<\/p>\n
S.Ajithkumar.  Considering the seriousness of the matter,<\/p>\n

the   bail   was   not   instantly   granted   on   7.8.2006     and<\/p>\n
posted to this date.\n<\/p>\n<\/p>\n
      3.     When   the   application   came   up   today,   the<\/p>\n
learned counsel submitted that the petitioner had moved<\/p>\n
the   bail   before   the   Magistrate   Court   and   the   learned<\/p>\n
Magistrate   had   granted   bail.     Therefore,   the   counsel<\/p>\n
seeks   permission   to   withdraw   the   application.     The<\/p>\n
counsel also submits that as the brief has been entrusted<\/p>\n
to  another   counsel   of    the   Mofussil  station,   he   no   more<\/p>\n
holds the brief of the petitioner.\n<\/p>\n<\/p>\n
      4.     The learned Public  Prosecutor submitted that<\/p>\n
the   C.D   file,   in   respect   of     crime   No.130\/2006   of<\/p>\n
Vizhinjam   Police   Station,   is   in   his   possession   from<\/p>\n
26.7.2006   onwards.     Thus   it   is   clear   that   the   learned<\/p>\n
Magistrate   had  passed the   order   without   the  perusal   of<\/p>\n
the C.D file,  and going through the facts in detail.<\/p>\n
      5.     In   the   above   facts   situation,   I   direct   the<\/p>\n
learned   Magistrate   to   send   a   detailed   report   together<\/p>\n
with the copy of the order passed by him, granting bail to<\/p>\n

              The   petitioner   preferred   the   application   for<\/p>\n
bail,     under   Section     439   Cr.P.C.,   as   he   was   in   judicial<\/p>\n
custody   from   6.6.2006,   the   date   of   his   surrender,   in<\/p>\n
crime   No.130\/2006   of   Vizhinjam   police   station.     The<\/p>\n
application   was   pending   before   this   Court,                    for<\/p>\n
consideration.     However,     without   disclosing   the   same,<\/p>\n
the   petitioner   moved   an   application   before   the   Court<\/p>\n
below,     and   obtained   the   bail.     Hence,     I   called   for   a<\/p>\n

statement   of   the   Magistrate.   As   per   the   report,   the<\/p>\n
Judicial   Magistrate   of   First   Class-II,   Neyyattinkara,<\/p>\n
stated that the pendency of the application before   High<\/p>\n
Court, was not brought to his notice and he granted bail,<\/p>\n
as the petitioner was in judicial custody for over 60 days.<\/p>\n
      2.     The   facts   of   the   case   are   that   the   petitioner<\/p>\n
was living with a woman by name Mary.   She was above<\/p>\n
40 years,  whereas the petitioner is below 30.  Mary was<\/p>\n
married earlier.    She had a minor girl,    below of age of<\/p>\n
16   years,     born   to   Mary,     in   her   first   marriage   with<\/p>\n
another   man.     The   petitioner,     while   living     with   Mary,<\/p>\n
impregnated the minor girl and the girl delivered a male<\/p>\n
child   in   the   S.A.T   hospital,   Thiruvananthapuram.     The<\/p>\n
petitioner took the girl to the house,  where he was living<\/p>\n
with   Mary.     Thereafter,     the   child   was   thrown   in   an<\/p>\n
adjacent property.  On the complaint of the local people,<\/p>\n
the police took the child to the hospital.   Thereafter,   it<\/p>\n
was   traced   that   the   child   was   born   to   the   minor   girl,<\/p>\n
consequent   on   the   rape,   committed   on   her,   by   the<\/p>\n

petitioner.     Therefore,   crime   No.130\/2006   had   been<\/p>\n
registered   against   the   petitioner   for   the   offence<\/p>\n
punishable   under   Section   376   IPC.     Another   crime<\/p>\n
No.115\/2006 was also registered against Mary as well as<\/p>\n
her daughter.  Both the cases are under investigation, by<\/p>\n
the Investigating Officer.   That was the reason why this<\/p>\n
Court did not grant bail, even after 60 days, and posted<\/p>\n
the matter, thereafter.\n<\/p>\n<\/p>\n
      3.     The turn of the events show that one Parvathy<\/p>\n
Sarojam,   aged   48   years,   Geetha   Bhavan,   Oadamkuzhi,<\/p>\n
Thirumala   P.O.,   Thiruvananthapuram,   who   claims   to   be<\/p>\n
the cousin of the petitioner,  had filed an affidavit before<\/p>\n
this   Court   for   obtaining   bail   to   the   petitioner.     It   is<\/p>\n
submitted   by   the   petitioner   before   this   Court   that<\/p>\n
Parvathy   Sarojam   is   not   related   to   him   and   she<\/p>\n
approached   his   mother   for   arranging   bail   to   the<\/p>\n
petitioner.  As per the statement dated 12.9.2006 filed by<\/p>\n
him.     On   the   orders   of   this   Court,   Parvathy   Sarojam<\/p>\n
collected Rs.24,000\/-, claiming that she is the clerk of the<\/p>\n

Advocate   at   Neyyattinkara.     Of   Rs.24,000\/-,   Rs.1,000\/-<\/p>\n
was   paid   to   the   advocate   S.Sunil   Raj   at   Neyyattinkara<\/p>\n
and   Rs.2,000\/-   to   advocate   Sasthamangalam                    S.<\/p>\n
Ajithkumar,         who   appeared   before   this   Court,   in<\/p>\n
B.A.No.4289\/2006.\n<\/p>\n<\/p>\n
      4.     One   Jayakumar   Abraham   was   the   advocate<\/p>\n
who   was   appearing   before   the   Magistrate   Court,<\/p>\n
Neyyattinkara,   and moved an application for bail before<\/p>\n
that Court.  However, from the order sheet refusing bail,<\/p>\n
I   find   that   name   of   the   advocate   shown   is<\/p>\n
Sasthamangalam   S.   Ajithkumar.     No   name   of   the<\/p>\n
advocate   is   shown   in   the   order,     granting   bail   by   the<\/p>\n
learned Magistrate dated 16.8.2006.<\/p>\n
      5.     However,     the   submissions   made   before   this<\/p>\n
Court   show   that   Sasthamangalam   S.   Ajithkumar   was<\/p>\n
unaware of the filing of the application  before the Court<\/p>\n
below,  while the bail application was pending before this<\/p>\n
Court.     Though   in   the   statement   dated   12.9.2006   the<\/p>\n
petitioner states that he had not committed any fraud but<\/p>\n

the fact remains that there is a foul play in obtaining bail<\/p>\n
without  disclosing  the  pendency of the  petition    as well<\/p>\n
as not granting of the bail after completion of 60 days, by<\/p>\n
this   Court,   because   of   the   peculiar   facts   of   this   case,<\/p>\n
involving   the   petitioner.     In   the   above   facts   situation,   I<\/p>\n
pass the following orders.\n<\/p>\n<\/p>\n
       (a).      The   petitioner   shall   surrender   before   the<\/p>\n
       Judicial Magistrate of First Class-II, Neyyattinkara,<\/p>\n
       on 19.9.2006 at 11.00 a.m.<\/p>\n
       (b).      The   learned   Magistrate   shall   remand   him   to<\/p>\n
       judicial custody until further orders.<\/p>\n
       (c).      The   Registrar   of   Subordinate   Judiciary,   shall<\/p>\n
       conduct a  fact finding enquiry,  as to who filed the<\/p>\n
       application   before   the   Judicial   Magistrate   of   First<\/p>\n
       Class-II,   Neyyattinkara,     in   crime   No.130\/2006   of<\/p>\n
       Vizhinjam   police   station,   praying   for   bail   of   the<\/p>\n
       petitioner,     which   led   to   the   passing   of   the   order<\/p>\n
       dated   16.8.2006,   without   disclosing   the   pendency<\/p>\n
       of B.A.No.4289\/2006,  before this Court.<\/p>\n

        (d).     The     Registrar   shall   also   collect   all   the<\/p>\n
        required   informations   from   advocate   Jayakumar<\/p>\n
        Abraham   and   S.Sunil   Raj   of   Neyyattinkara,     and<\/p>\n
        also from other advocates and persons from whom,<\/p>\n
        the true facts could   be gathered for arriving at a<\/p>\n
        right conclusion on the matter.  The involvement of<\/p>\n
        Parvathy   Sarojam   and   the   facts   stated   by   her,     in<\/p>\n
        the   affidavit,     dated   9.7.2006   as   well   as   in   the<\/p>\n
        statement   filed   by   the   petitioner   on   12.9.2006,<\/p>\n
        shall   also   be   taken   into   consideration,     by   the<\/p>\n
        Registrar.\n<\/p>\n<\/p>\n
        6.      The   report   shall   be   filed   by   the   Registrar<\/p>\n
within 15 days from the date of the receipt of the copy of<\/p>\n
