SHAH\n\t\t\n\t\n\n \n\nDate\n: 08\/07\/2010 \n\n \n\nORAL\nORDER<\/pre>\n<p>1.\tShri<br \/>\nBaiju Joshi, learned advocate appearing on behalf of the petitioner<br \/>\ndoes not press the present petition, however has requested to extend<br \/>\nthe time to  deposit the amount of Rs. 1,50,000\/-  as ordered by the<br \/>\nlearned Board of Nominees confirmed by the learned tribunal.  Shri<br \/>\nBaiju Joshi, learned advocate appearing on behalf of the petitioner<br \/>\nhas submitted that the petitioner shall deposit a sum of Rs. 75,000\/-<br \/>\n with respondent no. 1 Bank on or before 22\/07\/2010 and the balance<br \/>\namount of Rs. 75,000\/-  shall be deposited with respondent no. 1 Bank<br \/>\non or before 05\/08\/2010.\n<\/p>\n<p>2.\tIn<br \/>\nthe facts and circumstances of the case and considering the request<br \/>\nmade by Shri Baiju Joshi, learned advocate appearing on behalf of the<br \/>\npetitioner, time to deposit the sum of Rs. 1,50,000\/-, as ordered by<br \/>\nthe learned Board of Nominees confirmed by the learned tribunal, is<br \/>\nhereby extended up to 05\/08\/2010.  Out of the aforesaid amount   of<br \/>\nRs. 1,50,000\/-, the petitioner shall deposit a sum of Rs. 75,000\/-<br \/>\nwith respondent no. 1 Bank on or before 22\/07\/2010 and the balance<br \/>\namount of Rs. 75,000\/-   shall be deposited by the petitioner with<br \/>\nrespondent no. 1 Bank on or before 05\/08\/2010.  The petitioner shall<br \/>\nfile an undertaking to the aforesaid effect with this Court within a<br \/>\nperiod of one week from today.  On aforesaid deposit of Rs.<br \/>\n1,50,000\/- on or before 05\/08\/2010 as ordered hereinabove, the suit<br \/>\nshall be restored to file as ordered by the learned Board of Nominees<br \/>\nand the aforesaid shall be considered as compliance of the order<br \/>\npassed by the learned Board of Nominees while restoring the suit to<br \/>\nfile.  In view of the above, the petitioner does not challenge the<br \/>\njudgement and decree passed by the learned Board of Nominees.
