(ORAL)\n<\/pre>\n<p>           The petitioner seeks a direction to the respondents to<\/p>\n<p>allot him a plot measuring One kanal under the oustees quota in<\/p>\n<p>Sector 27, Panchkula on deposit of 10% earnest money. The<\/p>\n<p>petitioner&#8217;s case is that he fulfills all the eligibility conditions laid<\/p>\n<p>down in the Oustees Policy (Annexure P-2) and is entitled for<\/p>\n<p>allotment of a One kanal plot as the land measuring 13 kanals 13<\/p>\n<p>marlas owned by him and situated within the revenue limits of<\/p>\n<p>village Ram Garh, was acquired by the respondents for the<\/p>\n<p>development of Sectors- 25, 26, 27 and 28, Panchkula. The<\/p>\n<p>petitioner&#8217;s further grievance is that his claim has been turned<\/p>\n<p>down by the respondents on the solitary ground that though he<\/p>\n<p>had applied along with 10% earnest money, but his application<\/p>\n<p>was not for allotment of the plot in the same sector for which the<\/p>\n<p>land was acquired.\n<\/p>\n<p>           Relying upon a decision taken by the Apex Appellate<\/p>\n<p>Body of HUDA in the case of &#8220;Om Prakash vs. Haryana Urban<br \/>\n<span class=\"hidden_text\"> C.W.P NO. 2029 OF 2009                                   -2-<\/span><\/p>\n<p>Development Authority&#8221; dated 06.02.2008 (Annexure P-7),<\/p>\n<p>learned counsel for the petitioner states that the objection taken<\/p>\n<p>against the petitioner&#8217;s eligibility, is no longer a valid ground to<\/p>\n<p>deny him the allotment under the Oustees Policy. He also relies<\/p>\n<p>upon an order dated 21.08.2008 passed by a Division Bench of<\/p>\n<p>this Court in &#8220;C.W.P No. 2065 of 2006 <a href=\"\/doc\/73410139\/\">(Ashok Kumar vs.<\/p>\n<p>State   of    Haryana          and    others<\/a>)&#8221;   (Annexure       P-9).
