SHAH\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 16\/04\/2010 \n\n \n\n \n \n\n\n \n\nORAL\nJUDGMENT<\/pre>\n<p>1.\tRULE.\n<\/p>\n<p> Shri Mehul Shah, learned advocate waives service of notice of<br \/>\nrule on behalf of contesting opponent no. 1.\n<\/p>\n<p>2.\tWith<br \/>\nthe consent of the learned advocates appearing on behalf of the<br \/>\nrespective parties, the present application is taken up for final<br \/>\nhearing today.\n<\/p>\n<p>3.\tThe<br \/>\npresent application has been preferred by the applicants-original<br \/>\nrespondents nos. 1 to 6 to review\/recall and\/or modify the order<br \/>\npassed by this Court dated 01\/09\/2008 in Special Civil Application<br \/>\nNo. 10858\/2008 to the extent that instead of   four release deed not<br \/>\nto be tentatively exhibited it should be  eleven release deeds and<br \/>\none declaration as they are viewed to be insufficiently stamped.\n<\/p>\n<p>4.\tHaving<br \/>\nheard Shri Dhaval Dave, learned advocate appearing on behalf of the<br \/>\napplicants and Shri Mehul Shah, learned advocate appearing on behalf<br \/>\nof the contesting opponent no. 1, the order passed by this Court<br \/>\ndated 01\/09\/2008 in Special Civil Application No. 10858\/2008 is<br \/>\nhereby modified to the extent that  in place of &#8220;except four<br \/>\nrelease deeds&#8221; mentioned in paragraph 8 it should be read as<br \/>\n&#8220;except eleven release deeds produced at Mark 165\/11 to Mark<br \/>\n165\/16, Mark 165\/19, 165\/22, 165\/25, 165\/28, 165\/31 and the<br \/>\ndeclaration produced at Mark 165\/38&#8221;.\n<\/p>\n<p>5.\tWith<br \/>\nthis, the present application is allowed.  Rule is made absolute to<br \/>\nthe aforesaid extent.  No cost.\n<\/p>\n<p>6.\tRegistry<br \/>\nis directed to issue fresh order accordingly.\n<\/p>\n<p>\t\t\t\t\t\t\t\t(M.\n<\/p>\n<p>R.
