JUSTICE DINESH MAHESHWARI\n\n\nMr.Arvind Samdariya, for the appellant.\n\n                                  ....\n\n      Learned    counsel    for   the    appellant   pleads   no\n\ninstructions.\n\n      The matter having been listed in default category for\n\nprocess fees and notices in relation to the sole respondent\n\nhaving not been filed since long, it was considered appropriate\n\nto examine the record before considering whether notices be\n\nissued to the appellant or not.\n\n      This appeal, though registered as a regular first appeal\n\nunder Section 96 of the Code of Civil Procedure (CPC), has in\n\nfact been filed against the order dated 10.10.2002 as passed\n\nby the Additional District Judge No.1, Bikaner while rejecting\n\nafter adjudication an objection petition (registered as Misc.\n\nCase No.32\/2002) as filed by the appellant purportedly under\n\nOrder XXI Rules 97 and 35 CPC in relation to the recovery of\n\npossession of immoveable property in Execution Case No.\n\n15\/1998.\n\n      This appeal was presented on a court fees of Rs.10\/-\n\nand with the note on valuation that the objection petition was\n                               2\n\nnot valued. While reporting on the matter, the office raised the\n\nobjections that the copy of decree has not been filed and\n\nvaluation has not been mentioned.\n\n      The matter was listed before the Court from the defects\n\nside on 29.10.2002. While waiving the office objection, this\n\nCourt ordered issuance of notice of appeal to the respondents.\n\nHowever, the matter was also considered by this Court on the\n\nprayer for interim relief and the same was declined after taking\n\ninto comprehension the relevant facts and the background of\n\nthe case with the following order:-\n\n\n            \"Office objection is waived. Issue notice of\n      the appeal to the respondents.\n\n             Heard the learned counsel for the\n      appellant on the question of stay. From the order\n      of the learned Additional District Judge No.1,\n      Bikaner, it is apparent that the decree in respect\n      of disputed land was passed more than 20 years\n      ago and still the decree-holder has not\n      succeeded to get the possession of the property.\n\n              Earlier one Jethi Devi came as an objector\n      with the contention that she was in possession of\n      the property for the last 50 years. The objection\n      petition, after enquiry, was dismissed on\n      22.11.2001. Thereafter, on 6.8.2002 when the\n      bailiff of the court went with the decree-holder for\n      delivery of possession, the person present\n      refused to deliver the possession and it was\n      reported to the court that Smt. Jethi Devi was not\n      prepared to part with possession and hence, in\n      order to maintain peace at the time of the\n      delivery of possession, help of a lady police\n      constable may be provided. This time the\n      appellant Smt. Gavara Devi came with a story\n      that she was in possession of the disputed\n      property for the last more than 20 years and the\n      property was used by her for the upkeep of the\n      cows and their offsprings. The petitioner\n      examined herself and one Rajeshwari Devi in\n                               3\n\n      support of her story. In rebuttal, Harbans Lal was\n      examined on behalf of the decree-holder. The\n      court heard the arguments and disbelieved the\n      story of the appellant. The court found that earlier\n      Jethi Devi used to object on the ground that her\n      possession was 50 years old. After her petition\n      was dismissed Gavara Devi surfaced and came\n      with a story that she was in possession for the\n      last 20 years. Learned court found that the\n      property was in active litigation for the last 30\n      years and the contention of Gavara Devi that she\n      was having peacefully possession for 20 years\n      was unacceptable. The contention raised by the\n      appellant was to the effect that adjacent to the\n      disputed property, her house which she\n      purchased in 1994, is situate in the West. The\n      contention was to the effect that a gate of the\n      said house opened on the disputed property\n      through which the objector was using the\n      property. Needless to say that the house was\n      purchased by Gavara Devi in the year 1994 and\n      this purchase itself is not 20 years old.\n\n              After going through the judgment of the\n      trial court, I find no good ground to grant any stay\n      in favour of the appellant. The stay application is,\n      therefore, dismissed.\"\n\n\n\n      Thereafter, the respondent No.2 was reported to have\n\nexpired and the appellant was exempted from the necessity of\n\nbringing on record his legal representatives; and, on\n\n26.08.2005, this appeal was ordered to be admitted for nobody\n\nhaving appeared on behalf of the respondent No.1 despite\n\nservice.\n\n      After admission, notices were again sent to the\n\nrespondent No. 1 that were received unserved, as reported on\n\n06.02.2006.   Thereafter,   fresh   notices   were issued    on\n\n07.02.2007 and they were also received unserved, as reported\n\non 09.07.2007. Ever since then, process fees and notices for\n                                          4\n\n         service on the respondent have not been filed despite\n\n         repeated listing of the matter before the Deputy Registrar\n\n         (Judicial) and the Registrar (Adm.); and now, when the case is\n\n         listed in the Court in default category, learned counsel has\n\n         pleaded no instructions.\n\n               Although this appeal has been registered as civil regular\n\n         first appeal but it relates to the order passed in rejection of the\n\n         objections as raised in execution proceedings; and hence, this\n\n         appeal is essentially an execution first appeal. As noticed by\n\n         the Trial Court and by this Court, there is not even a\n\n         semblance of right available with the appellant to raise\n\n         objections or to resist delivery of possession in the related\n\n         execution proceedings.\n\n               Having regard to the overall facts and circumstances,\n\n         and for want of merits in the case as already noticed in the\n\n         order dated 29.10.2002, and for the appellant having failed to\n\n         take requisite steps for prosecution of this appeal any further,\n\n         it does not appear appropriate to issue notice to the appellant\n\n         and to keep this appeal pending.\n\n               For all the reasons aforesaid, this Court is clearly of the\n\n         view that this appeal deserves to be dismissed for want of\n\n         prosecution.\n\n                        The appeal is, therefore, dismissed.\n\n\n\ns.soni                                       (DINESH MAHESHWARI), J.\n<\/pre>\n","protected":false},"excerpt":{"rendered":"<p>Rajasthan High Court &#8211; Jodhpur Gavara Devi vs Bikaner Golden Transport &#8230; on 16 September, 2008 1 S.B.
