RAMKUMAR, J.\n                    .........................................\n                      B.A. No. 34 of of 2011\n                    ..........................................\n\n                        Dated: 14-01-2011\n\n                                  ORDER\n<\/pre>\n<p>      Petitioner who is the second accused in OR 9 of 2010 of<br \/>\nPonganamkadu Forest Range, Thrissur District                       for offences<br \/>\npunishable under Sections 2 (2) , 2(16), 2 (20), 2 (36), 9, 39, 40<br \/>\n(2), 50 and 51 of the Wild Life Protection Act, seeks anticipatory<br \/>\n                                                              .\n<\/p>\n<p>bail.\n<\/p>\n<p>      2.    The learned Public Prosecutor opposed the application.\n<\/p>\n<p>      3.    After evaluating the factors and parameters which<br \/>\nare to be taken into consideration in the light of paragraph 122<br \/>\nof the verdict     dated      2-12-2010              of the Apex Court        in<br \/>\n<a href=\"\/doc\/1108032\/\">Siddharam Satlingappa Mhetre v. State of Maharashtra and<br \/>\nOthers<\/a> (2010 (4) KLT 930),,           I am of the view that anticipatory<br \/>\nbail cannot be granted in a case of this nature, since the<br \/>\ninvestigating officer has not had the advantage of interrogating<br \/>\nthe petitioner.   But at the same time, I am inclined to permit the<br \/>\npetitioner to surrender before the Investigating Officer for the<br \/>\npurpose of interrogation and then to have his application for bail<br \/>\nconsidered by the Magistrate or the Court                    having jurisdiction.\n<\/p>\n<p><span class=\"hidden_text\">B.A. No. 34 of 2011              -:2:-<\/span><\/p>\n<p>Accordingly,      the  petitioner   shall   surrender    before  the<br \/>\ninvestigating officer on 24-01-2011 or on 25-01-2011 for the<br \/>\npurpose of interrogation and recovery of incriminating material,<br \/>\nif any. In case the investigating officer is of the view that having<br \/>\nregard to the facts of the case        arrest of the    petitioner is<br \/>\nimperative he shall record his reasons for the arrest in the case-<br \/>\ndiary as insisted in paragraph 129 of Siddharam Satlingappa<br \/>\nMhetre&#8217;s case (supra). The petitioner shall thereafter be produced<br \/>\nbefore the Magistrate or the Court concerned and permitted to<br \/>\nfile an application for regular bail on the same day or the next<br \/>\nday. In case the interrogation of the petitioner is          without<br \/>\narresting him, the petitioner shall thereafter appear before the<br \/>\nMagistrate or the Court concerned       and apply for regular bail.<br \/>\nThe Magistrate or the Court on being satisfied that the petitioner<br \/>\nhas been      interrogated by the police    shall, after hearing the<br \/>\nprosecution as well, consider and dispose of his application for<br \/>\nregular bail preferably on the same date on which it is filed.\n<\/p>\n<p>      4.     In case the petitioner while surrendering before the<br \/>\nInvestigating Officer has deprived         the investigating officer<br \/>\nsufficient time for interrogation, the officer shall complete the<br \/>\ninterrogation even if it is beyond the time limit fixed as above<br \/>\nand submit a report to that effect to the Magistrate or the Court<\/p>\n<p><span class=\"hidden_text\">B.A. No. 34 of 2011              -:3:-<\/span><\/p>\n<p>concerned.
