No.1196 of 2011\n                                RAJIV RANJAN KUMAR\n                                           Versus\n                        THE STATE OF BIHAR THROUGH THE\n                                         -----------\n<\/pre>\n<p>4   21.04.2011            Heard learned counsel for the petitioner as well as<\/p>\n<p>                 learned counsel for the Vigilance.\n<\/p>\n<p>                          Counter affidavit is filed on behalf of the Vigilance.<\/p>\n<p>                          It is the case of Vigilance that District Magistrate,<\/p>\n<p>                 Nawada called for comments of SDO on the file of allegationist<\/p>\n<p>                 and allegedly, demand of Rs 50,000\/- was made to give<\/p>\n<p>                 comments on the file of the allegation maker and subsequently,<\/p>\n<p>                 the petitioner who was working as steno of the aforesaid SDO,<\/p>\n<p>                 was caught red handed taking the bribe amount from the<\/p>\n<p>                 allegation maker.\n<\/p>\n<p>                          Learned counsel appearing for the Vigilance has fairly<\/p>\n<p>                 conceded that uptill now, the concerned SDO has not been<\/p>\n<p>                 made accused in this case.\n<\/p>\n<p>                          The contention of learned counsel for the petitioner is<\/p>\n<p>                 that the Vigilance lodged this false case against the petitioner to<\/p>\n<p>                 save the above-said SDO.\n<\/p>\n<p>                          It would appear from perusal of the record that after<\/p>\n<p>                 trap of the petitioner, he was questioned by the Vigilance<\/p>\n<p>                 officials and the petitioner replied that he worked on behalf of<\/p>\n<p>                 the SDO and under his compulsion, he took the amount in<\/p>\n<p>                 question as the concerned SDO had threatened him to get him<br \/>\n<span class=\"hidden_text\">                                -2-<\/span><\/p>\n<p>        transfer to the remote place.\n<\/p>\n<p>                 Taking into consideration the aforesaid facts and<\/p>\n<p>        circumstances as well as submission of the parties, let the<\/p>\n<p>        petitioner, namely, Rajiv Ranjan Kumar be released on bail on<\/p>\n<p>        furnishing bail bonds of Rs 10,000\/- (ten thousand) with two<\/p>\n<p>        sureties of the like     amount each in connection with Special<\/p>\n<p>        Case No. 48 of 2010 arising out of Vigilance P.S.
