After receipt<br \/>\nof the amount the goods were not supplied and, therefore it is<br \/>\nalleged in the complaint that the accused had dishonest intention of<br \/>\nappropriating the amount from the very beginning, hence alleged<br \/>\noffence has been committed.\n<\/p>\n<p>2.\t\tLearned<br \/>\nMagistrate initially examined the complainant and issued process.<br \/>\nThereafter, the accused appeared before the learned Magistrate and<br \/>\nfiled an application for discharge on the ground that the order was<br \/>\nplaced with the broker and there are earlier transactions with the<br \/>\ncomplainant and therefore no offence is committed. Learned Magistrate<br \/>\nvide order dated 10\/03\/2003 below the said application for discharge<br \/>\nfound that unless the evidence is recorded it would not be a case to<br \/>\ndischarge the accused at this stage and therefore dismissed the<br \/>\napplication.  Under these circumstances the present petition for<br \/>\nquashing of the complaint.\n<\/p>\n<p>3.\t\tHeard<br \/>\nMs.Avni Mehta, learned Counsel for the applicant and Mr.Shashtri<br \/>\noriginal complainant   respondent No.1 and Mr.L.B.Dabhi, learned<br \/>\nAPP for respondent No.2-State of Gujarat.\n<\/p>\n<p>4.\t\tThe<br \/>\naccusation made in the complaint for acceptance of the money and not<br \/>\nsupplying of the goods, prima-facie cannot be said as no offence<br \/>\nwhatsoever has been committed.  The defence as to be canvassed either<br \/>\nbefore the learned Magistrate or before this Court in the present<br \/>\nproceedings cannot be gone into in a petition under the provisions of<br \/>\nSection 482 of the Code of Criminal Procedure at the time of quashing<br \/>\nof the complaint.  No material is produced to show any abuse of<br \/>\nprocess of law.  The only contention raised is that it is essentially<br \/>\na civil dispute for which the criminal complaint could not have been<br \/>\nfiled. It is not necessary that if civil wrong is committed there<br \/>\nwould not be any criminal wrong.  Certain action may be such which<br \/>\nmay attract both the proceedings.  If criminal proceedings are<br \/>\ninitiated by way of a substitution of civil proceedings or with a<br \/>\nview to pressurize in the civil proceedings or with a view to short<br \/>\ncircuit the civil proceedings, it may result into abuse of process of<br \/>\nlaw and this Court may discourage the same.  Such does not appear to<br \/>\nbe in the present case.\n<\/p>\n<p>5.\t\tHence,<br \/>\nthe petition is merit-less, therefore dismissed.
