KURDUKAR\n\n\n\n\nACT:\n\n\n\nHEADNOTE:\n\n\n\nJUDGMENT:\n<\/pre>\n<p>\t\t      J U D G M E N T<br \/>\n     Nanavati, J.\n<\/p>\n<p>     The  appellant  is\t challenging  his  conviction  under<br \/>\nSection 25  of the  Arms Act read with Section 5 of the TADA<br \/>\nAct.\n<\/p>\n<p>     The Designated  Court believed  the evidence  of  Ganga<br \/>\nRam, the  Investigator and held that the appellant possessed<br \/>\na country made pistol and three live cartidges.\n<\/p>\n<p>     The State\thas not thought it fit to prepare the paper-<br \/>\nbooks containing  evidence in  this case. Therefore, neither<br \/>\nthe learned  counsel for  the State  nor the learned counsel<br \/>\nfor the appellant was in a position to render any assistance<br \/>\nto us.\n<\/p>\n<p>     We have  ourselves gone  through the  evidence  of\t the<br \/>\nthree eye  eye-witnesses. We find that in view of what Nathu<br \/>\nRam stated before the court, the evidence of Ganga Ram ought<br \/>\nnot to\thave been  accepted by the Court and it ought not to<br \/>\nhave been  held that  the accused was found in possession of<br \/>\nthe  weapon   and  three   cartidges  which  were  sent\t for<br \/>\nexamination to Forensic Science laboratory, Karnal.\n<\/p>\n<p>     We,  therefore,   allow  this  appeal,  set  aside\t the<br \/>\nconviction of  the appellant  and acquit  him of the offence<br \/>\nwith which he was charged.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Supreme Court of India Subhash vs State Of Haryana on 21 July, 1998 Author: Nanavati Bench: G.T.
