l”I.”hat. on 02.08.2007 when the claimant was<\/p>\n
 =  {Valking on Shivagange–Dabuspete road near<\/p>\n
 Gourapurada Muthaiah’s land an autorickshaw bearing<\/p>\n
No. KA 52 2224 came in a rash and negligent manner<\/p>\n
and dashed against him, as a result he sustained<\/p>\n
1n3uries. Hence he filed a claim petition  ,<\/p>\n
Bangalore seeking compensation of   <\/p>\n
Tribunal by the impugned jtidgrnent,  <\/p>\n
awarded a compensation of RsA.:8__I\/~ igwitliviiiterestllatg<\/p>\n
6% pa<\/p>\n
4. As there is regarding occurrence of
\naccident, negligence’ the Insurance
\nCompany’.   my consideration

\ncompensa.ti0n\u00bb-awarded by the Tribunal is<\/p>\n

\nV reduction?\n<\/p>\n
‘  — rehearing the learned Counsel for the parties<\/p>\n
  the award of the Tribunal, I am of the<\/p>\n
 View ‘that the compensation awarded by the Tribunal is<\/p>\n
 “onjfthe lower side and it is deserved to be enhanced.<\/p>\n

6. As per wound certi\ufb01cate Ex. P 3 claimant
\nsustained fracture of both bones of left leg. The injuries<\/p>\n
are also supported by discharge summary <\/p>\n
Outpatient record EX. P 8, X–ray Ex. P 9  <\/p>\n
sheet Ex. P 10 and supported”by*-\u00abOral  t1~1\u00e9V <\/p>\n
claimant and the doctor’ ‘lasll’P..WS \u00ab.1 ”<\/p>\n
respectively. He was..:’n:.n:”‘treated.. ‘has  innatielnt in
\nTumkur Govt. H0$Pi_tm I. 12\u00bb.-‘8,_v2O(\ufb01)’7VV”t0″V\u00a77.8.2007.
\nDr. B. Ramesh  has assessed
\ndisability  -iof  lower limb and<\/p>\n
7.  C–o’nsiderin:g “nature of injuries Rs.40,000\/-
\nawarded__bj,zf  towards pain and suffering is<\/p>\n
  pro’per___and it does not call for enhancement.<\/p>\n
  iVRs:..5,0O0\/– awarded by the Tribunal towards<\/p>\n
‘1ned\u00a7;cai.7~” expenses is based on the medical bills<\/p>\n
 .. Vprociulced by the claimant, there is no scope for<\/p>\n

9. Considering nature of injuries and duration of
\ntreatment Rs.4.000\/– awarded by the Tribunal towards
\nconveyance and nourishment is just and prc1p’er”p:’ar1d it<\/p>\n
does not call for enhancement.\n<\/p>\n
10. The Tribunal has assessedlthle..’in.corr1’\u00e9:~.te,_of’rthe \u00b0<\/p>\n
clairnant at Rs.3,OOO\/–Vp.’rn. arVid..lV2:3,OOG[–i’<\/p>\n
towards loss of income    which is<\/p>\n
just and proper and does cal}:f’o\u00abr_enhancement.<\/p>\n
11. Considering  by the doctor
\nand an  unhappiness he has
\nto  Rs.20,000\/– awarded by
\nthe of amenities is just and<\/p>\n
proper andit’ doestnot call for enhancement.<\/p>\n
   claims to be a coolie and the<\/p>\n
  it stated by the doctor at 40% to left lower limb<\/p>\n
aridto the whole body definitely affects his future<\/p>\n
 A. , earning to certain extent. He is aged about 22 years,<\/p>\n
i  “the multiplier applicable to his age group is 18. If so,<\/p>\n

13. Accordingly the appeal is allowed  <\/p>\n
