JUSTICE ABHILASHA KUMARI\n\t\t\n\t\n\n \n\n\t\t\t\tDate\n: 27\/01\/2011 \n\n \n\nORAL\nORDER<\/pre>\n<p>1.\tNotice.\n<\/p>\n<p>Mr. Pranav Trivedi, learned Assistant Government Pleader waives<br \/>\nservice of Notice for the respondents.\n<\/p>\n<p>2.\tThis<br \/>\npetition, under Article 226 of the Constitution of India, has been<br \/>\nfiled with the following prayers:-\n<\/p>\n<p>&#8220;(A)\tYour<br \/>\nLordships may kindly be pleased to issue a writ of Mandamus and\/or<br \/>\nany other appropriate writ, direction and\/or order to quashed and set<br \/>\naside the impugned communication\/letter dated 06.12.2010 passed by<br \/>\nthe present respondent authorities at Annexure-D to this petition.\n<\/p>\n<p>(B)\tYour<br \/>\nLordships may kindly be pleased to direct the present respondent<br \/>\nauthorities to give the appointment to the present petitioner on the<br \/>\npost of Asst. Police Sub Inspector (unarmed) w.e.f. 28.11.2010 with<br \/>\nall consequential benefit to which the present petitioner is entitled<br \/>\ntoo.\n<\/p>\n<p>(C)\tPending<br \/>\nhearing and final disposal of this petition, your Lordships may<br \/>\nkindly be please to direct the present respondent authorities to give<br \/>\nthe appointment to the present petitioner to the post of Asst. Police<br \/>\nSub Inspector(unarmed pursuance to his selection.\n<\/p>\n<p>(D)\tAny<br \/>\nsuch other and further order which deems to fit, just and proper in<br \/>\nthe interest of justice.&#8221;\n<\/p>\n<p>3.\tBriefly<br \/>\nstated, the case of the petitioner  is that he has the requisite<br \/>\nqualifications for appointment to the post of Assistant Police Sub<br \/>\nInspector (unarmed) and he has appeared and cleared examinations<br \/>\nconducted by respondent No.3 on 05.06.2010 and 06.06.2010. According<br \/>\nto the petitioner, he was called for personal interview on 11.08.2010<br \/>\nand has been found medically fit for the post of Assistant Police Sub<br \/>\nInspector(unarmed) in the physical test by the Medical Officer. The<br \/>\ngrievance of the petitioner is that though his name has been included<br \/>\nin the select-list prepared by the respondents, he has not been<br \/>\nconsidered for appointment to the post of Assistant Police Sub<br \/>\nInspector(unarmed), on the ground that F.I.R. No.45 of 2003 had been<br \/>\nregistered against him in Police Station, Bhaktinagar, Rajkot City,<br \/>\nunder sections 506(2) 504 and 114 of the Indian Penal Code. The<br \/>\npetitioner has been acquitted by judgment dated 14.12.2010 passed in<br \/>\nCriminal Case No.4206 of 2003 by the competent Court, which fact has<br \/>\nbeen communicated to the respondents by the petitioner, by letter<br \/>\ndated 21.12.2010. Subsequently, the petitioner has also made<br \/>\nrepresentation dated 28.12.2010 to respondent No.2 in this regard,<br \/>\nwhich is still pending.\n<\/p>\n<p>4.\tMr.\n<\/p>\n<p>Prabhakar Upadhyay, learned advocate for the petitioner submits that<br \/>\nthe interest of justice would be met, if the concerned respondent is<br \/>\ndirected to consider and decide representation dated 28.12.2010 made<br \/>\nby the petitioner, within a stipulated period of time.\n<\/p>\n<p>5.\tUpon<br \/>\nthe above statement being made by the learned advocate for the<br \/>\npetitioner, the following order is passed:-\n<\/p>\n<p>(a)\tRespondent<br \/>\nNo.2 shall consider and decide representation dated 28.12.2010 made<br \/>\nby the petitioner, taking into consideration the judgment of<br \/>\nacquittal passed by the concerned Criminal Court.\n<\/p>\n<p>(b)\tThe<br \/>\ndecision shall be taken, as expeditiously as possible, and preferably<br \/>\nwithin a period of three months from the date of receipt of a copy of<br \/>\nthis order.\n<\/p>\n<p>6.\tThe<br \/>\npetition is disposed of, in the above terms.\n<\/p>\n<p>\tDirect<br \/>\nService of this order is permitted.\n<\/p>\n<p>\t\t\t\t\t(Smt.\n<\/p>\n<p>Abhilasha Kumari, J.)<\/p>\n<p>Safir*<\/p>\n<p>\t\t   \u00a0\u00a0\u00a0<\/p>\n<p>\t\t   Top<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Gujarat High Court Chavda vs State on 27 January, 2011 Author: Abhilasha Kumari,&amp;Nbsp;
