APPLICATION No. 8709 of 2010\n \n\n \n \n=========================================================\n\n \n\nKARSAN\nLAGDHIR MARAJ - Applicant(s)\n \n\nVersus\n \n\nSTATE\nOF GUJARAT - Respondent(s)\n \n\n=========================================================\n \nAppearance\n: \nMR\nBY MANKAD\nfor\nApplicant \nMR HL JANI APP for\nRespondent \n=========================================================\n \n\n\n \n\n\n \n\n\n \n\n\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t:\n\t\t\t\t\t\t\n\t\t\n\t\t \n\t\t\t \n\n HONOURABLE\n\t\t\tMR.JUSTICE Z.K.SAIYED    11th August 2010\n\t\t\n\t\n\n \n\n \n ORAL\nORDER<\/pre>\n<p>\tThis<br \/>\nApplication is filed by the applicant under Section 439 CrPC for<br \/>\nreleasing him on regular bail in connection with the offence<br \/>\nregistered vide M.Case No. 1\/2010 by the Rapar Police Station<br \/>\nfor the offences punishable under Secs. 406, 408, 420, 465, 467, 468,<br \/>\n471, 114 IPC.\n<\/p>\n<p>\tHeard<br \/>\nlearned advocate Mr. Mankad for the applicant and learned APP Mr.<br \/>\nJani  for the respondent-State.\n<\/p>\n<p>\tLearned<br \/>\nadvocate Mr. Mankad contended that there is no case against the<br \/>\npresent applicant and he has wrongly been booked by the police. He<br \/>\nhas further contended that the Court below has not considered his<br \/>\ncase in the proper manner.  He has also contended that this is a fit<br \/>\ncase where regular bail be grant to the applicant.\n<\/p>\n<p>As against this, learned APP Mr. Jani has strongly opposed this<br \/>\nApplication. He has contended that the applicant is witness in the<br \/>\nsaid forged document and no lenient view can be taken in the matter<br \/>\nof granting the bail.\n<\/p>\n<p>\t  I<br \/>\nhave gone through the order passed by the Court below as well as the<br \/>\npapers produced in the matter. Looking to the allegations levelled<br \/>\nagainst the applicant, I am inclined to release him on regular bail,<br \/>\nwithout entering into the merits of the case.\n<\/p>\n<p>Learned advocates for the parties do not press for the reasoned<br \/>\norder.\n<\/p>\n<p>Considering the submissions made on behalf of the parties, and having<br \/>\nregard to the facts and circumstances of the case, this Application<br \/>\nis allowed. Applicant is ordered to be released on bail in connection<br \/>\nwith M.Case No. 1\/2010 registered with Rapar Police Station for the<br \/>\noffences registered against him in this applicant, on his executing a<br \/>\nbond for Rs. 10,000\/= [Rupees Ten Thousand only] with one<br \/>\nsolvent surety of the like amount to the satisfaction of the lower<br \/>\nCourt, and subject to the conditions that he shall :\n<\/p>\n<p>[a]\tnot<br \/>\ntake undue advantage of his liberty, or abuse his liberty;\n<\/p>\n<p>[b]\tnot<br \/>\nact in a manner injurious to the interest of the prosecution;\n<\/p>\n<p>[c]\tnot<br \/>\nleave the local limits of the State of Gujarat without prior<br \/>\n\tpermission of the concerned Sessions Court;\n<\/p>\n<p>[d]\tmark<br \/>\npresence before Rapar Police Station, on \tevery 16th day<br \/>\nof \tthe English Calender month between 9.00 a.m\tto 2.00 p.m.;\n<\/p>\n<p>[e]\tfurnish<br \/>\naddress of his residence to the I.O and also to the Court \tat the<br \/>\ntime of execution of the Bond and shall not change the \tresidence<br \/>\nwithout prior permission of this Court; and <\/p>\n<p>[f]\tsurrender<br \/>\nhis passport; if any, to the lower Court within a week.\n<\/p>\n<p>  The authorities will release the applicant only if he is not<br \/>\nrequired in connection with any other offence for the time being.\n<\/p>\n<p> If  breach of any of the above conditions is committed, the<br \/>\nconcerned Sessions Judge will be at liberty to issue warrant or take<br \/>\nappropriate action in the matter.\n<\/p>\n<p>Bail bond to be executed before the lower Court having jurisdiction<br \/>\nto try the case.\n<\/p>\n<p>At the trial, the trial Court shall not be influenced by the<br \/>\nobservations of preliminary nature, qua the evidence at this<br \/>\nstage, made by this Court while enlarging the applicant on bail.\n<\/p>\n<p>Rule is made absolute to the aforesaid extent.\n<\/p>\n<p>Direct service is permitted.\n<\/p>\n<p>{Z.K<br \/>\nSaiyed, J.}<\/p>\n<p>Prakash*<\/p>\n<p>\t\t   \u00a0\u00a0\u00a0<\/p>\n<p>\t\t   Top<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Gujarat High Court Karsan vs State on 11 August, 2010 Author: Z.K.Saiyed,&amp;Nbsp; Gujarat High Court Case Information System Print CR.MA\/8709\/2010 2\/ 3 ORDER IN THE HIGH COURT OF GUJARAT AT AHMEDABAD CRIMINAL MISC.
