The petitioner is accused No.2 in<\/p>\n<p>Crime No.127 of 2009 of Sasthamcotta Excise Range.<\/p>\n<p>      2. The offence alleged against the petitioner is under Section<\/p>\n<p>8(1) and (2) of the Abkari Act.\n<\/p>\n<\/p>\n<p>      3. The prosecution case is that on 27.8.2009, the accused<\/p>\n<p>and his wife were found engaged in the sale of coloured arrack. A<\/p>\n<p>quantity of 4.4 litres of coloured arrack was seized.               The first<\/p>\n<p>accused was arrested on 28.8.2009. The petitioner could not be<\/p>\n<p>arrested as he ran away. The wife of the petitioner was in judicial<\/p>\n<p>custody for a few days. The petitioner prays for anticipatory bail.<\/p>\n<p>      4. Taking into account the facts and circumstances of the<\/p>\n<p>case, I do not think that this is a fit case where anticipatory bail can<\/p>\n<p>B.A. NO. 7218 OF 2009<\/p>\n<p>                                     :: 2 ::\n<\/p>\n<p>be granted to the petitioner.
