Learned counsel for the petitioner submitted that the<br \/>\n     petitioner is claiming ownership upon the properties,<br \/>\n     which are referred at Annexure 1\/A to the memo of<br \/>\n     present petition. There are several plots upon which the<br \/>\n     petitioner is claiming ownership and title on the basis of<br \/>\n     various documents and it is submitted that a Public<br \/>\n     Interest Litigation was preferred by some persons and a<br \/>\n     writ petition bearing W.P.(PIL) No. 2561 of 2007 was<br \/>\n     instituted   before    this   Court     for    removal    of   the<br \/>\n     encroachments upon the properties, upon which the<br \/>\n     petitioner is claiming ownership and the following order<br \/>\n     was passed in the said Public Interest Litigation, by this<br \/>\n     Court:\n<\/p>\n<blockquote><p>                 &#8220;In view of the fact that the Deputy<br \/>\n           Commissioner has filed affidavit mentioning the<br \/>\n           steps taken, we do not find any reason to keep<br \/>\n           this PIL pending. The Deputy Commissioner is<br \/>\n           directed to continue the steps undertaken by<br \/>\n           taking action and pass orders in accordance<br \/>\n           with law as expeditiously as possible.\n<\/p><\/blockquote>\n<blockquote><p>                 With this direction, this PIL is disposed of.<br \/>\n                 Let copies of this order be given to the<br \/>\n           counsel appearing for the parties.&#8221;\n<\/p><\/blockquote>\n<p>2.   The aforesaid order was passed on 10th January, 2008. It<br \/>\n     is submitted by the learned counsel for the petitioner that<br \/>\n     thereafter a direction has also been given by the Deputy<br \/>\n     Commissioner,         Dhanbad,    for         removal    of    the<br \/>\n     encroachment with the help of the police force, but, the<br \/>\n<span class=\"hidden_text\">                                       2.<\/span><br \/>\n     petitioner is residing on the properties, which are<br \/>\n     narrated at Annexure 1\/A to the memo of present<br \/>\n     petition, as the owner of the properties and, therefore, a<br \/>\n     detailed representation dated 27th June, 2008 has been<br \/>\n     filed, which is at Annexure 4 to the memo of present<br \/>\n     petition, and it is submitted that without deciding the<br \/>\n     said representation, the Deputy Commissioner, Dhanbad,<br \/>\n     cannot remove the petitioner, as the petitioner is not an<br \/>\n     encroacher at all. It is further submitted that under the<br \/>\n     excuse      of    removal     of      encroachment,     the     Deputy<br \/>\n     Commissioner, Dhanbad, may not remove even the<br \/>\n     owners of the properties and, therefore, this petitioner<br \/>\n     has been preferred, with a prayer that let the Deputy<br \/>\n     Commissioner, Dhanbad, decide the claim of the present<br \/>\n     petitioner upon the properties, narrated at Annexure 1\/A<br \/>\n     to the memo of present petitioner and, thereafter, action<br \/>\n     may    be     initiated,    in     accordance    with    law,    rules,<br \/>\n     regulations, policies and the government enforceable<br \/>\n     orders, applicable in the facts of the present case.\n<\/p>\n<p>3.   I have heard learned counsel for the State Mr. Lal, who<br \/>\n     has submitted that the respondents are duty bound to<br \/>\n     remove the encroachment, as per the order of this Court.<br \/>\n     Nonetheless, if the petitioner is claiming title and<br \/>\n     ownership upon the properties, as stated hereinabove, the<br \/>\n     representation of the petitioner at Annexure 4 to the<br \/>\n     memo of present petition dated 27th June, 2008 will be<br \/>\n     decided by the Deputy Commissioner, Dhanbad, in<br \/>\n     accordance with law, rules, regulations, policies and the<br \/>\n     government enforceable orders, applicable in the facts of<br \/>\n     the present case. It is also submitted by the learned<br \/>\n     counsel Mr. Lal that the contentions raised in the memo<br \/>\n     of present petition are not accepted by the respondents<br \/>\n     and they are denied in totality.\n<\/p>\n<p>4.   Learned counsel Mr. Lal on behalf of the State submitted<br \/>\n     that     as      expeditiously        as   possible,    the     Deputy<br \/>\n     Commissioner, Dhabnad, will decide the claim of the<br \/>\n     present petitioner, upon the properties, narrated at<br \/>\n     Annexure 1\/A to the memo of present petition.\n<\/p>\n<p>5.   Learned counsel for the submitted that the petitioner will<br \/>\n     cooperate        with   the      hearing     before     the     Deputy<br \/>\n<span class=\"hidden_text\">                                          3.<\/span><br \/>\n             Commissioner,         Dhanbad,        and     no      unnecessary<br \/>\n             adjournment will be asked for.\n<\/p>\n<p>      6.     In view of the aforesaid submissions and looking to the<br \/>\n             order, passed by this Court in W.P.(PIL) No. 2561 of 2007<br \/>\n             dated 10th January, 2008, as stated hereinabove, and<br \/>\n             looking to the representation at Annexure 4 to the memo<br \/>\n             of present petition, I hereby direct respondent no.2, the<br \/>\n             Deputy Commissioner, Dhanbad, to hear the petitioner or<br \/>\n             his representative and decide the representation at<br \/>\n             Annexure    4   to    the   memo      of    present   petition,   in<br \/>\n             accordance with law, rules, regulations, policies and the<br \/>\n             government enforceable orders, applicable to the facts of<br \/>\n             the present case and such decision will be taken by the<br \/>\n             Deputy Commissioner, Dhanbad, as expeditiously as<br \/>\n             possible, preferred within a period of twelve weeks from<br \/>\n             the date of receipt of a copy of the order of this Court and<br \/>\n             the petitioner will cooperate with the hearing and will not<br \/>\n             ask for unnecessary adjournment, so that the time<br \/>\n             schedule be scrupulously adhered to by respondent no.2.\n<\/p>\n<p>      7.     Meanwhile, the Deputy Commissioner, Dhanbad, is<br \/>\n             hereby restrained from demolishing the super-structure,<br \/>\n             which may be of the nature of Kachha construction,<br \/>\n             Pucca construction or shade in nature etc. or the like, on<br \/>\n             the properties, narrated at Annexure 1\/A to the memo of<br \/>\n             present petition, till the decision is taken by the Deputy<br \/>\n             Commissioner,        Dhanbad,    on    the    representation      at<br \/>\n             Annexure 4 to the memo of present petition.\n<\/p>\n<p>      8.
