No. 33 OF 2008\n\n              ````````````````````````````````````````````````````\n\n            Dated this the 8th day of February, 2008\n\n\n                                O R D E R\n<\/pre>\n<p>              This revision petition is directed against a direction<\/p>\n<p>under section 125  Cr.P.C. to pay maintenance  at the  rate  of<\/p>\n<p>Rs.1,250\/-   and   Rs.1,000\/-   respectively   to   the   claimants,<\/p>\n<p>admittedly, the wife aged 34 years and child aged 8 years of<\/p>\n<p>the petitioner herein.\n<\/p>\n<\/p>\n<p>      2.      Marriage   is   admitted.     Separate   residence   is<\/p>\n<p>admitted.  The court below found the wife entitled for separate<\/p>\n<p>maintenance and accordingly issued the impugned direction.<\/p>\n<p>      3.      The   petitioner   claims   to   be   aggrieved   by   the<\/p>\n<p>impugned   order.       Called   upon   to   explain   the   nature   of<\/p>\n<p>challenge   which   the   petitioner   wants   to   raise   against   the<\/p>\n<p>impugned   order,     the   learned   counsel   for   the   petitioner<\/p>\n<p>contends   that   the   quantum   of   maintenance   awarded   is<\/p>\n<p>excessive.\n<\/p>\n<\/p>\n<p>      4.      The   amount   ordered   as   stated   earlier   is   only<\/p>\n<p>Rs.1,250\/-   and   Rs.1,000\/-   respectively   to   the   wife   and   child<\/p>\n<p>RPFC.33\/08<\/p>\n<p><span class=\"hidden_text\">                                     : 2 :<\/span><\/p>\n<p>from   the   date   of   the   petition.     The   petitioner   is   admittedly<\/p>\n<p>employed   abroad.     There   is   nothing   to   show   that   the<\/p>\n<p>claimants   have   any   other   means.                I   am,   in   these<\/p>\n<p>circumstances,   satisfied   that   the   challenge   against   the<\/p>\n<p>quantum   of   maintenance   awarded   is   without   any   merit   and<\/p>\n<p>the   revision   petition   only   deserves   to   be   dismissed.     The<\/p>\n<p>inability   of   the   wife   to   produce   any   documents   to   show   the<\/p>\n<p>income   of   her   husband   employed   abroad   cannot   persuade<\/p>\n<p>this   Court   to   conclude   that   there   is   no   sufficient   evidence<\/p>\n<p>about the means of the husband.  Reasonable inferences and<\/p>\n<p>deductions   have   to   be   made.     Admittedly,   the   petitioner   is<\/p>\n<p>employed   abroad.     That   premise   is,   according   to   me,   more<\/p>\n<p>than   sufficient   to   justify   the   direction   to   pay   the   meagre<\/p>\n<p>amounts of Rs.1,250\/- and Rs.1,000\/- respectively to the wife<\/p>\n<p>and   child.     This   revision   does   not   deserve   admission   to<\/p>\n<p>consider   the   contentions   raised.     I   am   satisfied   that   the<\/p>\n<p>revision petition only deserves to be dismissed.
