[ORAL)<\/p>\n<p>             The petitioner society seeks a direction to allow it to run a<\/p>\n<p>Mobile Dispensary in Gurgaon.\n<\/p>\n<p>             As per its case, the petitioner is a Charitable Society<\/p>\n<p>registered with the District Registrar of Firms and Societies, Gurgaon<\/p>\n<p>since 28.10.2003. The Society has arranged funds to purchase a<\/p>\n<p>Mobile Dispensary in order to provide medical services to the people<\/p>\n<p>irrespective of any caste, race, sex or religion. On its part, the<\/p>\n<p>Government of India through its Ministry of Social Justice and<\/p>\n<p>Empowerment has introduced a Scheme in June, 2006 for providing<\/p>\n<p>grant-in-aid to voluntary and other organizations for carrying out<\/p>\n<p>Charitable activities. The eligibility conditions prescribed by the<\/p>\n<p>Government of India for claiming grant-in-aid under the Scheme are<\/p>\n<p>as under:-\n<\/p>\n<blockquote><p>             &#8220;[a] Registered under the Societies Registration Act,1860<br \/>\n                   [XXI of 1860] or any relevant Act of the State\/Union<br \/>\n                  Territory; or<\/p>\n<p>            [b]   A public trust registered under the law for the time<br \/>\n                  being in force; or<\/p>\n<p>            [c]   A charitable company licensed under Section 25 of<br \/>\n                  the Companies Act, 1956; or<\/p>\n<p>            [d]   Indian Red Cross Society or its branches; and or<\/p>\n<p>            [e]   Any other public body or institution having a legal<br \/>\n                  status of its own;\n<\/p><\/blockquote>\n<blockquote><p>            [f]   The voluntary organization should have been<br \/>\n                  registered for, at least two years, at the time of<br \/>\n                  applying for grant under the Scheme. This can,<br \/>\n                  however, be waived by the Secretary, Ministry of<br \/>\n                  Social Justice and Empowerment, for reasons to be<br \/>\n                  recorded in writing, in exceptional cases.\n<\/p><\/blockquote>\n<blockquote><p>            [g]   Number of Scheduled Caste beneficiaries is not<br \/>\n                  less than 60% in cases of voluntary organizations.\n<\/p><\/blockquote>\n<blockquote><p>            [h]   Any other organization or training institution of<br \/>\n                  repute, which may be approved by the Secretary,<br \/>\n                  Ministry of Social Justice and Empowerment&#8221;.\n<\/p><\/blockquote>\n<p>Notwithstanding the fact that the petitioner Society fulfills the<\/p>\n<p>conditions reproduced above, the State of Haryana is not according<\/p>\n<p>its permission on the ground that the petitioner Society has failed to<\/p>\n<p>hold its election during last three years.\n<\/p>\n<p>            Having heard learned State Counsel and on perusal of<\/p>\n<p>the Scheme launched by the Government of India, I am of the<\/p>\n<p>considered view that the objection raised by the State Government is<\/p>\n<p>totally irrational and alien to the Scheme. The only requirement is<\/p>\n<p>that the voluntary organization should be registered for two years at<\/p>\n<p>the time of application. The petitioner was registered on 28.10.2003<\/p>\n<p>and by now it is more than five years old. In this view of the matter,<\/p>\n<p>the reason assigned by the State of Haryana and its authorities for<\/p>\n<p>refusing the necessary permission to the petitioner to run the Mobile<br \/>\n Dispensary is per-se illegal and can not sustain.<\/p>\n<p>            The writ petition is accordingly allowed and respondents<\/p>\n<p>No. 2 to 4 are directed to re-consider the petitioner&#8217;s case for<\/p>\n<p>according necessary approval\/permission in the light of the<\/p>\n<p>observations made here-in-above. Let the needful be done within a<\/p>\n<p>period of two months from the date a certified copy of this order is<\/p>\n<p>received.\n<\/p>\n<p>            Disposed of.<\/p>\n<pre>\n\nFebruary 12, 2009.
