Nangesh for the applicant submitted that the<br \/>\napplicant is an innocent person and he has not prima facie committed<br \/>\nany offence alleged against him. He is not the main culprit who has<br \/>\ncommitted the alleged offence  punishable under Secs. 363, 366 and<br \/>\n114 of IPC. Considering the role attributed to the applicant, the<br \/>\napplication deserves to be allowed and the applicant be granted<br \/>\nanticipatory bail as prayed for in the application.\n<\/p>\n<p>\tLearned<br \/>\nAPP Mr U.A. Trivedi, representing the opponent State, while opposing<br \/>\nthe anticipatory bail application submitted that considering the role<br \/>\nattributed to the applicant and the manner in which he has aided and<br \/>\nabetted the main culprit in the alleged commission of offence, no<br \/>\ndiscretionary relief be granted to the applicant, the application<br \/>\ndoes not call for interference and the same deserves to be rejected<br \/>\nout of hand.\n<\/p>\n<p>\tI<br \/>\nhave heard the learned advocates of both the sides at length and in<br \/>\ngreat detail. On perusal of the role attributed to the applicant<br \/>\nwhich is reflected in the FIR at Annexure:A to the application, I am<br \/>\nof the view that the applicant deserves to be granted anticipatory<br \/>\nbail as he has not prima facie committed the offence in question.\n<\/p>\n<p>\t  In<br \/>\nview of the above facts and circumstances of the case and without<br \/>\nentering into merits of the case, I am inclined to exercise my<br \/>\ndiscretion in favour of the applicant. The application is allowed.\n<\/p>\n<p>\tIn the<br \/>\nevent of arrest of the applicant in connection with CR No. I 207\/09<br \/>\nregistered with Jhagadia Police Station for the offences punishable<br \/>\nunder Sections 363, 366 and 114 of IPC, he shall be released on bail<br \/>\non executing a bond of Rs.10,000\/- [Rupees ten thousand only] with<br \/>\none surety of the like amount on the following conditions that he<br \/>\nshall:\n<\/p>\n<p>[a]\tco-operate<br \/>\nwith the investigation and make himself available for interrogation<br \/>\nwhenever and wherever required.\n<\/p>\n<p>[b]\tshall<br \/>\nremain present at the concerned Police Station on 16th<br \/>\nFebruary, 2010 between 9.00 AM to 3.00 PM.\n<\/p>\n<p>[c]\tshall<br \/>\nnot hamper the investigation in any manner nor shall directly or<br \/>\nindirectly make any inducement, threat or promise to any person<br \/>\nacquainted with the facts of the case so as to dissuade them from<br \/>\ndisclosing such facts to the Court or to any police officer;\n<\/p>\n<p>[d]\tat<br \/>\nthe time of execution of bond, furnish his residential address to the<br \/>\ninvestigating officer and the Court concerned and shall not change<br \/>\nthe residence till the final disposal of the case or till further<br \/>\norders;\n<\/p>\n<p>[e]\tnot<br \/>\nleave India without the permission of the Court and, if holding a<br \/>\npassport, he shall surrender the same before the Trial Court within a<br \/>\nweek;\n<\/p>\n<p>[f]\tnot<br \/>\nobstruct or hamper the police investigation and not play mischief<br \/>\nwith the evidence collected or yet to be collected by the police;\n<\/p>\n<p>\tIt would<br \/>\nbe open to the Investigating Officer to file an application for<br \/>\nremand if he considers it proper and just; and the competent Court<br \/>\nwould decide it on merits.\n<\/p>\n<p>\tThis<br \/>\norder will hold good, if the applicant is arrested at any time within<br \/>\n90 days from today.  The order for release on bail will remain<br \/>\noperative only for a period of ten days from the date of his arrest.<br \/>\nThereafter, it will be open to the applicant to make a fresh<br \/>\napplication for being enlarged on bail in usual course, which, when<br \/>\nit comes up before the competent Court, will be decided in accordance<br \/>\nwith law, having regard to all the attending circumstances and the<br \/>\nmaterials available at the relevant time, without being influenced by<br \/>\nthe fact that anticipatory bail was granted.\n<\/p>\n<p>\tWith<br \/>\nthese directions, this application is allowed.\n<\/p>\n<p>\tRule is<br \/>\nmade absolute.
