Mukhopadhaya, A.C.J.<\/p>\n<p>1. Heard in party.\n<\/p>\n<p>2. On hearing the parties, the following order is being passed for the present:-\n<\/p>\n<p>(i) The parties to the case, including HEC, State of Jharkhand and Union of India are prohibited from selling\/acquiring\/leasing\/subleasing\/transferring any land\/buildings\/structure of HEC without prior permission of the Court.\n<\/p>\n<p>(ii) The State of Jharkhand is directed to file affidavit and state whether they will pay a sum of Rs. 500 crores to the HEC to clear off the dues of JSEB.\n<\/p>\n<p>(iii) The HEC is directed to file an affidavit and state whether they are inclined to sell about 2,500 acres of their disposable land in lieu of Rs. 500 crores, which it may receive from the State of Jharkhand.\n<\/p>\n<p>(iv) The JSEB is directed to file affidavit and state whether they will set off rest of the dues and settle the account of HEC towards arrears of dues on receipt of the amount of Rs. 500 crores which the Company may receive from the State of Jharkhand.\n<\/p>\n<p>(v) HEC and JSEB both are directed to complete the formalities of handing over and taking over of the power supply, distribution, infrastructure including line, transformers, substations etc. of HEC Township to the JSEB. The JSEB will supply electricity directly to the residential areas of HEC by 6th of December, 2004 and will reduce the load of HEC (Unit and Project) within the same period.\n<\/p>\n<p>(vi) The HEC is directed to pay a sum of Rs. 25 lacs by 6th December, 2004.\n<\/p>\n<p>3. Taking into consideration the submission made by Mr. Rajesh Kumar, counsel for the State Bank of India that they are considering the question of grant of further loan and on the basis of sovereign guarantee given by the Government of India, the State Bank of India is directed to expedite the matter and, if possible, will grant loan, within fifteen days from the date of receipt\/ production of a copy of this order.\n<\/p>\n<p>4. The Union of India, State of Jharkhand, HEC, and JSEB are directed to file their respective affidavits and progress report by the next date. The Advocate General is also requested to assist the Court in the matter in future.\n<\/p>\n<p>5. Let both the cases be listed for further hearing under the heading &#8216;For Orders&#8217; on 9th December, 2004.\n<\/p>\n<p>6.
