{"id":149906,"date":"2005-10-26T00:00:00","date_gmt":"2005-10-25T18:30:00","guid":{"rendered":"https:\/\/www.legalindia.com\/judgments\/union-of-india-vs-harinder-pal-singh-ors-on-26-october-2005"},"modified":"2019-02-02T07:04:12","modified_gmt":"2019-02-02T01:34:12","slug":"union-of-india-vs-harinder-pal-singh-ors-on-26-october-2005","status":"publish","type":"post","link":"https:\/\/www.legalindia.com\/judgments\/union-of-india-vs-harinder-pal-singh-ors-on-26-october-2005","title":{"rendered":"Union Of India vs Harinder Pal Singh &amp; Ors on 26 October, 2005"},"content":{"rendered":"<div class=\"docsource_main\">Supreme Court of India<\/div>\n<div class=\"doc_title\">Union Of India vs Harinder Pal Singh &amp; Ors on 26 October, 2005<\/div>\n<div class=\"doc_author\">Author: A Kabir<\/div>\n<div class=\"doc_bench\">Bench: Ashok Bhan, Altamas Kabir<\/div>\n<pre>           CASE NO.:\nAppeal (civil)  3343-3554 of 1999\n\nPETITIONER:\nUnion of India\t\t\t\t\t\t\t\n\nRESPONDENT:\nHarinder Pal Singh &amp; Ors.\t\t\t\t\n\nDATE OF JUDGMENT: 26\/10\/2005\n\nBENCH:\nAshok Bhan &amp; Altamas Kabir\n\nJUDGMENT:\n<\/pre>\n<p>J U D G M E N T<br \/>\nWITH<\/p>\n<p>CA NOS.2640-2642\/99, 3309 -3340\/99,<br \/>\n3341-3342\/99, 3555\/99, 3556 -3586\/99,<br \/>\n5163\/02, 3009 -17\/03, 3057-3059\/03,<br \/>\n3152-80\/03 AND 3060 -3061\/03<\/p>\n<p>ALTAMAS KABIR,J.\n<\/p>\n<p>\tApplications for substitution in Civil Appeal Nos. 3010\/03,3152-<br \/>\n80\/03  and in 3343-3554\/99 are allowed.\n<\/p>\n<p>\tAll these appeals relate to the acquisition  of  3512.33 acres of<br \/>\nland comprised  in five villages, namely, Hamidpur, Gumanpura,<br \/>\nKhurmania, Kathania  and Wadala Bhitewad  pursuant to several<br \/>\nnotifications dated 1st June, 1977, 22nd July, 1977, and 5th May, 1978,<br \/>\nissued under Section 4 of the Land Acquisition Act,1894 (hereinafter<br \/>\nreferred to as &#8216;the  Act&#8217;) for extension of the Cantonment at Amritsar.<br \/>\nThe   Collector  passed his award in respect of the acquired lands on<br \/>\n28.3.1978 after classifying the lands in question into four categories<br \/>\nnamely:\n<\/p>\n<p>(i)\tChahi;\n<\/p>\n<p>(ii)\tNehri;\n<\/p>\n<pre>(iii)\t    Barani;\n(iv)\t    Gair Mumkin.\n\n<\/pre>\n<p>In respect of  each of the categories, different rates of compensation<br \/>\nper acre were computed in the manner following:\n<\/p>\n<p>(i)\tChahi   &#8211;  Rs.16,500\/-\n<\/p>\n<p>(ii)\tNehri   &#8211;  Rs.16,500\/-\n<\/p>\n<p>(iii)\tBarani  &#8211;  Rs. 12,000\/-\n<\/p>\n<p>(iv)\tGair Mumkin  &#8211; Rs.5,000\/-\n<\/p>\n<p>Various references  were thereafter made to the District Court at the<br \/>\nrequest of  the  aggrieved  claimants against the said award of the Land<br \/>\nAcquisition Collector for enhanced compensation in respect of the<br \/>\nacquired  lands at different rates between Rs.50,000\/- to Rs.90,000\/-<br \/>\nper acre.   Following the belting method, the learned Additional District<br \/>\nJudge, Amritsar, fixed the market value of lands forming part of the<br \/>\nfirst belt at  a uniform  rate of Rs.50,000\/- per acre, irrespective of  the<br \/>\nquality of the lands.  Similarly, in respect of the  second belt, the<br \/>\nmarket value of the lands was fixed at Rs.40,000\/- per acre,<br \/>\nirrespective of the  quality of the lands.  In respect of the those<br \/>\nclaimants whose lands did not fall within   the two belts, the<br \/>\ncompensation was enhanced and fixed at  <\/p>\n<p>(i)\tRs. 25,000\/- per acre for Chahi-Nehri lands\n<\/p>\n<p>(ii)\t    Rs.18,000\/-  per acre for Barani lands and\n<\/p>\n<p>(iii)\t    Rs. 8000\/- per acre for Gair Mumkin lands.\n<\/p>\n<p>A batch of appeals  was filed against the decision of the Additional<br \/>\nDistrict Judge, Amritsar.  In the R.F.As  involving  721.3837 acres in<br \/>\nHamidpur, after  taking into account the potentiality and the nature  of<br \/>\nthe lands, including their proximity to G.T. Road and other connecting<br \/>\nroads and the other sale deeds filed before him, the learned single<br \/>\nJudge of the Punjab and Haryana High Court fixed the market value of<br \/>\nthe  lands in question at a uniform rate of  Rs.16,500\/- per acre.  The<br \/>\nsame rate was fixed for the lands in Ghumanpura.  LPAs were filed<br \/>\nagainst the order of the learned single Judge in respect of  village<br \/>\nHamidpur and Ghumanpura.  The other RFAs in respect of the lands<br \/>\ncomprised in village Kathania and  Wadala Bhitewad were pending<br \/>\nconsideration when the LPAs were taken up for consideration by the<br \/>\nDivision Bench.      Considering the fact  that the appeals  all related to<br \/>\nmore or less simultaneous acquisition of the lands  comprised   in the<br \/>\nfive villages for extension of the Amritsar Cantonment, the Division<br \/>\nBench  took up the RFAs for consideration along with the LPAs and<br \/>\ndisposed of all the matters by its findings and judgment in the leading<br \/>\ncase being LPA No.729\/85.\n<\/p>\n<p>\tWhile considering the matter, the Division Bench concluded that<br \/>\nthe lands comprised in the five villages were more or less of similar<br \/>\nnature and character and well connected by roads  and that there was a<br \/>\ngood deal of potentiality  for development of the locality.  It  was<br \/>\nobserved that the areas in question  contained houses and factories and<br \/>\nwere also close to the Guru Nanak Dev University.  The Division Bench<br \/>\nalso took particular note of the fact that the lands comprised  in the<br \/>\nadjoining village of Kala Ghanu  Pur,  which  had also  been acquired,<br \/>\nunder  notifications dated  1st June, 1977 and  10th June, 1977,   were<br \/>\nvalued uniformly at Rs.40,000\/- per acre.  The Division Bench observed<br \/>\nthat  the market value of the acquired lands was being determined<br \/>\nkeeping in view their potentiality for  industrialization or urbanization.<br \/>\nIt was observed further that it had been  fairly conceded by counsel for<br \/>\nthe parties that the market value of the nehri lands in the same locality<br \/>\nis  the same irrespective  of whether they  were nearer or  farther  away<br \/>\nfrom the town.   On such  consideration, the Division Bench in keeping<br \/>\nwith the  market value of the lands comprised in  village Kala Ghanu<br \/>\nPur, was of the view that the market value of the  lands  under<br \/>\nacquisition in the five villages should  also  be  fixed at  a uniform rate<br \/>\nof Rs.40,000\/- per acre, irrespective of  their nature or quality and<br \/>\nwhether the same was situated  nearer to the road or at some distance<br \/>\ntherefrom.\n<\/p>\n<p>\tIn keeping with the aforesaid determination, the awards passed<br \/>\nby the learned Reference Court were all modified to the extent that the<br \/>\nclaimants of the five villages  would be entitled to compensation at the<br \/>\nrate of Rs.40,000\/-, per acre irrespective of the nature of the land.  The<br \/>\nclaimants  would also be entitled to statutory interest and solatium at<br \/>\nthe rate of 30 per cent.  In particular, the claimants of village Kathania<br \/>\nand Wadala Bhitewad would also  be entitled to the benefit of Section 23<br \/>\n(1-A) of the Act.\n<\/p>\n<p>As indicated hereinbefore,  by virtue of   the  said  judgment<br \/>\ndelivered in  LPA No.729\/85, the Division Bench disposed of all the<br \/>\npending appeals, including the RFAs  concerning the lands comprised in<br \/>\nKathania and Wadala Bhitewad.\n<\/p>\n<p>        All these appeals  have  been preferred by the Union of India<br \/>\nagainst the said judgment  and order of the Division Bench of the  High<br \/>\nCourt of Punjab and Haryana.\n<\/p>\n<p> Appearing in support of the appeals, Mr. R. Mohan, learned<br \/>\nAdditional Solicitor General, firstly  urged that the  Division Bench of the<br \/>\nPunjab and Haryana High Court  had erred in  abandoning the  belting<br \/>\nsystem and taking  recourse to a uniform rate  for all the lands<br \/>\ncomprised in the five different villages on account of  the fact that all<br \/>\nthe lands were not similar in nature and did not enjoy  the same<br \/>\nprivileges.\n<\/p>\n<p>It was also contended by Mr. Mohan that the market value of the<br \/>\nlands comprised in village Kala Ghanu Pur had been wrongly taken  as a<br \/>\nyardstick for the lands involving  in the instant  appeals on account of<br \/>\nthe fact that the lands comprised in village Kala Ghanu Pur and those in<br \/>\nthe five villages involved in the instant acquisition  proceedings could<br \/>\nnot be taken  to be  comparable units.  According to Mr. Mohan, while<br \/>\nvillage Kala Ghanu Pur was situated on the road between G.T. Road and<br \/>\nthe bye pass road, the situation  of the lands comprised  in the other<br \/>\nvillages was not similar and they did not enjoy  the same advantages.<br \/>\nFurthermore, village  Kala Ghanu Pur was closer to Amritsar and was  in<br \/>\nthe immediate vicinity  of  Guru Nanak Dev University and the Khalsa<br \/>\nCollege at Amritsar whereas Hamidpur and Kathania were situated at<br \/>\nsome distance away from the city  and  the main roads.\n<\/p>\n<p>Mr. Mohan lastly contended that the lands comprised in village<br \/>\nKala Ghanu Pur were too little to  be used as a comparative unit in<br \/>\nrespect of  a larger area of land  which had been acquired having<br \/>\nparticular regard     to their location as well as potentiality  for<br \/>\ndevelopment.  In support of the said submission, Mr. Mohan  firstly<br \/>\nrelied on a decision of this Court in the case of Union of India  &amp; Anr. Vs.<br \/>\nRam Phool &amp; Anr, (2003) 10 SCC 167 wherein the aforesaid principle<br \/>\nwas noticed and it was observed that it had been held  in a  catena   of<br \/>\ndecisions of this Court that the sale price in respect of a small bit of<br \/>\ntransaction would not be the determinative factor for deciding the<br \/>\nmarket value  of a vast stretch of land.\n<\/p>\n<p>Reference was also made to another decision of this Court in  the<br \/>\ncase of  Ranvir Singh &amp; Anr. Vs.  Union of India., 2005 (7) Scale  238<br \/>\nin which  the decision in Ram Phool&#8217;s case (supra) was  noticed.<br \/>\n\tMr. Mohan urged that having regard to the aforesaid principle, the<br \/>\nimpugned decision of  the Division Bench of the Punjab and Haryana<br \/>\nHigh Court was  not  capable of being sustained and in the absence  of<br \/>\nany proper comparable unit the decision of the learned single Judge was<br \/>\nliable to be restored.\n<\/p>\n<p>\tAppearing in support of the claimants, Mr. P.C. Jain, senior<br \/>\nadvocate, on the other hand, contended that the decision of the Division<br \/>\nBench of the Punjab and Haryana High Court  impugned in these appeals<br \/>\nwas just and based on the materials available,  namely, the  rate of<br \/>\ncompensation  fixed  in  respect of the  lands comprising village Kala<br \/>\nGhanu Pura which were adjacent to the lands comprising the five villages<br \/>\nforming the subject matter of the present appeals.  Mr. Jain contended<br \/>\nthat  from the inspection reports it would be amply clear that all the lands<br \/>\ninvolved in the acquisition proceedings  had similar potential for<br \/>\ncommercial exploitation and could be consolidated into a single unit<br \/>\nwhere the process of development and improvement had already<br \/>\ncommenced.  Mr. Jain pointed out that there were several mills and<br \/>\nfactories along with residential accommodation which had come up in the<br \/>\narea and there was  little to  differentiate  between the lands comprised<br \/>\nin either village Kathania  or  village Hamidpura and those comprised in<br \/>\nthe adjacent  village of Kala Ghanu Pur they were  equally well connected<br \/>\nby arterial roads.   It was urged that since there was little  to differentiate<br \/>\nbetween the lands comprised in village Kala Ghanu Pur and those<br \/>\ninvolved in the present  acquisition proceedings, the judgments referred<br \/>\nto  and relied upon by Mr. Mohan would be of  little or no relevance.  It<br \/>\nwas urged that, in any event, the lands comprised in  village Kala Ghanu<br \/>\nPur could not be said to be a small unit since it comprised an area of<br \/>\n208.2625 acres.\n<\/p>\n<p>Mr.Jain  contended that the appeals were  misconceived  and were<br \/>\nliable to be dismissed.\n<\/p>\n<p>\tWe have carefully considered the submissions made on behalf  of<br \/>\nthe respective parties  and we see no justification to interfere with the<br \/>\ndecision of the Division Bench of the  Punjab and Haryana High Court<br \/>\nwhich, in our view, took a  pragmatic approach in fixing the market<br \/>\nvalue of the lands forming  the subject matter of the  acquisition<br \/>\nproceedings at a uniform rate.  From the  sketch plan of the area in<br \/>\nquestion, it appears  to us that while  the lands in question are  situated<br \/>\nin five different villages, they can be consolidated into one single unit<br \/>\nwith little to choose between one stretch of land and another.  The<br \/>\nentire area  is in a  stage of development   and the different villages are<br \/>\ncapable of being developed in the same manner as the lands comprised<br \/>\nin  Kala Ghanu Pur where  the market value of  the acquired lands was<br \/>\nfixed at a uniform rate of Rs.40,000\/- per acre.  The Division Bench of<br \/>\nthe Punjab and Haryana High Court  discarded the  belting method of<br \/>\nvaluation  having regard to the local circumstances  and features and<br \/>\nno cogent ground has been made out to interfere with the same.<br \/>\n\tIn our view, in the absence of any contemporaneous document,<br \/>\nthe market value   of  the acquired lands of village Kala Ghanu Pur<br \/>\nwhich were acquired  at the same time  as the lands in the other five<br \/>\nvillages was correctly taken to be a comparative unit  for determination<br \/>\nof the market value of the lands comprising the lands forming the<br \/>\nsubject matter of the  acquisition proceedings under consideration.  No<br \/>\ninterference is, therefore, called for in these appeals and they are all<br \/>\ndismissed without any order as to costs.\n<\/p>\n<p>\tAlthough, it has been duly mentioned in  the judgment under<br \/>\nappeal, we reiterate that as far as the benefits under Section 23 (1-A)<br \/>\nof the Act  are concerned, the same will be confined to  the lands<br \/>\ncomprised in village Kathania  and Wadala Bhitewad only where the<br \/>\nCollector made his award after 30th April, 1982.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Supreme Court of India Union Of India vs Harinder Pal Singh &amp; Ors on 26 October, 2005 Author: A Kabir Bench: Ashok Bhan, Altamas Kabir CASE NO.: Appeal (civil) 3343-3554 of 1999 PETITIONER: Union of India RESPONDENT: Harinder Pal Singh &amp; Ors.
