JUSTICE ABHILASHA KUMARI\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 14\/07\/2008 \n\n \n\n \n \n ORAL\nORDER<\/pre>\n<p>\tA<br \/>\npreliminary objection regarding maintainability of the appeal is<br \/>\nraised by Mr. Pathak.  Deciding that issue would call for examining<br \/>\ncertain factual aspects and, therefore, keeping that issue open, the<br \/>\nappeal is admitted.\n<\/p>\n<p> ORDER<br \/>\nON CIVIL APPLICATION NO.4091 OF 2008<\/p>\n<p>\tRule.  Learned Advocate,<br \/>\nMr. Pathak, waives service of notice of Rule on behalf of the<br \/>\nopponent.\n<\/p>\n<p>\tHeard<br \/>\nlearned Senior Advocate, Mr. Trivedi, appearing with Mr. Abhishek<br \/>\nMehta for M\/s Trivedi &amp; Gupta, Advocates for the applicant.  It<br \/>\nis not in dispute that the opponent has been getting the benefit of<br \/>\nwages, as contemplated under Section 17-B of the Industrial Disputes<br \/>\nAct, during the pendency of the petition.  Learned Senior Advocate,<br \/>\nMr. Trivedi, states at the Bar that the applicant-appellant will<br \/>\ncontinue to extend the benefit to the opponent during the pendency of<br \/>\nthe appeal.  In that view of the matter, interim relief in terms of<br \/>\nparagraph 14(a) is granted.  In addition, the order of the Labour<br \/>\nCourt, Bharuch, dated 11th January, 2000 in Reference<br \/>\n(LCB) No.198 of 1990 shall stand stayed, though not specifically<br \/>\nprayed for in the Civil Application, as non-grant of this relief may<br \/>\ninitiate one more round of litigation.
