      This writ petition is filed seeking the following reliefs:<\/p>\n
         “i)   To call for the records I.A.No.4153\/2008 in<\/p>\n
         O.S.No.885\/2007 on the files of the Principal Munsiff’s<\/p>\n
         Court, Alappuzha and set aside Ext.P8.\n<\/p>\n<\/p>\n
         ii)   To issue an interim order staying the proceeding<\/p>\n
         in O.S.No.885\/2007 on the files of the Principal<\/p>\n
         Munsiff’s Court, Alappuzha, pending disposal of the<\/p>\n
         writ proceedings.”\n<\/p>\n
      2.    Petitioners are the defendants in O.S.No.885\/2007 on<\/p>\n
the file of the Principal Munsiff Court, Alappuzha. Suit was one<\/p>\n
for injunction and the respondent is the plaintiff.              After<\/p>\n
commencement of the trial, the respondent moved an application<\/p>\n
to amend some mistakes in the description of the boundaries<\/p>\n
shown in the plaint schedule, which was objected to by the<\/p>\n
petitioners\/defendants. The learned Munsiff after hearing both<\/p>\n
sides allowed the amendment application. The amendment was<\/p>\n
carried out in the plaint. The respondent\/plaintiff gave a copy of<\/p>\n

the amended plaint to the petitioners\/defendants. It was noticed<\/p>\n
during the trial that in the copy of the amended plaint given to<\/p>\n
the defendants there was a mistake and the correction made was<\/p>\n
not truly reflected. Thereupon, petitioners\/defendants moved an<\/p>\n
application to strike out the amendment already carried in the<\/p>\n
plaint contending that the plaintiff has practiced a fraud on the<\/p>\n
court and also on the opposite party. Ext.P7 is the copy of that<\/p>\n
application. Learned Munsiff, after hearing both sides, found that<\/p>\n
it was only an inadvertent mistake on the part of the<\/p>\n
respondent\/plaintiff, which deserved to be condoned.          The<\/p>\n
plaintiff was directed to hand over a corrected copy of the<\/p>\n
amended plaint to the defendants and the defendants was<\/p>\n
provided with an opportunity to further cross examine the<\/p>\n
plaintiff, already examined as PW1. Ext.P8 is the copy of that<\/p>\n
order. Correctness and propriety of Ext.P8 order is impeached by<\/p>\n
the petitioners\/defendants invoking the supervisory jurisdiction<\/p>\n
vested with this Court under Article 227 of the Constitution of<\/p>\n
India.\n<\/p>\n

     3.     I heard the counsel on both sides.\n<\/p>\n
     4.     Learned counsel for the petitioner urged before me<\/p>\n
that even in the written statement a specific contention was<\/p>\n
taken, of the mis-description of the plaint schedule property in<\/p>\n
respect of which the decree for injunction was sought for. After<\/p>\n
the case came up in the list for trial and that too only after<\/p>\n
commencement of recording of evidence, the plaintiff took any<\/p>\n
steps for correcting the mis-description in the plaint schedule.<\/p>\n
The commissioner deputed to conduct a local inspection, it is<\/p>\n
submitted by the counsel, has also noted such mis-description in<\/p>\n
the plaint schedule.       There was culpable negligence and<\/p>\n
deliberate latches on the part of the plaintiff in moving for the<\/p>\n
amendment to correct the plaint schedule and, so much so, the<\/p>\n
learned Munsiff was not justified in allowing the amendment<\/p>\n
application. The further grievance of the counsel is that even if<\/p>\n
the amendment was permitted to be carried out in the plaint, the<\/p>\n
plaintiff practiced fraud upon the defendants by serving them a<\/p>\n
copy of the plaint carrying a mis-description of the plaint. Ext.P7<\/p>\n
application moved by the defendant to strike out the amendment<\/p>\n

carried in the plaint ought to have been given serious<\/p>\n
consideration, and according to the counsel, Ext.P8 order is liable<\/p>\n
to be set aside.\n<\/p>\n
      5.   The challenge raised in the writ petition is confined to<\/p>\n
Ext.P8 order and so much so, any question as to the propriety<\/p>\n
and correctness of the order passed by the learned Munsiff<\/p>\n
allowing the amendment application is outside the scope of this<\/p>\n
petition. Learned counsel for the petitioners fairly submitted that<\/p>\n
a challenge against the amendment was not taken in the present<\/p>\n
petition since it had been challenged earlier by way of a writ<\/p>\n
petition unsuccessfully, and this Court has upheld the order of the<\/p>\n
learned Munsiff, allowing the amendment.       The question now<\/p>\n
posed for consideration is very much limited and it is confined to<\/p>\n
whether the learned Munsiff in exercising her judicial discretion<\/p>\n
has flouted any principle of law or rules governing procedure. By<\/p>\n
filing Ext.P7 petition, defendants in the suit were seeking for<\/p>\n
striking out the amended portion from the pleadings. Striking<\/p>\n
out of pleadings by the court is covered by Order VI Rule 16 CPC<\/p>\n
and it is permissible only under the three circumstances<\/p>\n

enumerated thereunder. The case in hand does not come within<\/p>\n
any of the circumstances covered by Order VI Rule 16 CPC. Then<\/p>\n
the question is whether any prejudice had been caused to<\/p>\n
defendants by the copy of the amended plaint given by the<\/p>\n
plaintiff which contained some mistake with respect to the<\/p>\n
amendment carried out in the plaint filed before the court. In<\/p>\n
this context, it has to be taken note that before filing of an<\/p>\n
amendment application, the party moving for such amendment<\/p>\n
has to hand over a copy of such petition to the opposite party.<\/p>\n
But, there is no provision in the CPC mandating serving of a copy<\/p>\n
after amendment is carried out. It appears that the plaintiff was<\/p>\n
gracious enough to hand over an amended copy of the plaint to<\/p>\n
the opposite party, but, some mistakes were in the copy given.<\/p>\n
That cannot be taken as a serious lapse, and no fraud can be<\/p>\n
attributed to the plaintiff of deliberately misleading the defendant<\/p>\n
in any manner. Perusing Ext.P8 order, I find that the learned<\/p>\n
Munsiff has appreciated the situation rightly and correctly and<\/p>\n
exercised her discretion soundly. The learned Munsiff has taken<\/p>\n
care that no prejudice is caused to the defendant in serving of a<\/p>\n

copy of the plaint containing a mis-description, by ordering the<\/p>\n
plaintiff to serve a copy showing the correct amendment carried<\/p>\n
out in the plaint. The order further discloses that the defendant<\/p>\n
was given opportunity to cross examine PW1 again after<\/p>\n
corrected amended copy is given. No interference with Ext.P8<\/p>\n
order emerges for consideration in the facts and circumstances of<\/p>\n
the case, which is found to be proper and correct.<\/p>\n
     The writ petition is closed.\n<\/p>\n<\/p>\n
