(C) No.17165 &amp; 17177 OF 2009\n                - - - - - - - - - - - - - - - - - - - - - - - - - - - -\n                 Dated this the 22nd day of June, 2009\n\n                               J U D G M E N T\n<\/pre>\n<p>            Almost identical facts are involved in these two writ<\/p>\n<p>petition.   Therefore they have been heard together and are<\/p>\n<p>disposed of by a common judgment.\n<\/p>\n<p>      2.    I will refer to the facts in writ petition 17165 of 2009 for<\/p>\n<p>the sake of convenience.\n<\/p>\n<p>      3.    The petitioner, a partnership firm was carrying on<\/p>\n<p>business of dealers of engineering, Survey, Drawing, Scientific<\/p>\n<p>instruments, Stationery and allied products.                       First respondent<\/p>\n<p>called for tender for supply of some Tools and Equipments as<\/p>\n<p>evidenced by Ext.P1 and P2. P3 to P5 quotations were submitted<\/p>\n<p>by the petitioner. The terms were found to be acceptable and P6<\/p>\n<p>to P8 purchase orders were placed by first respondent. Certain<\/p>\n<p>materials in terms of the supply orders were supplied as well.<\/p>\n<p>According to the petitioner, the first respondent then proceeded to<\/p>\n<p>cancel all the orders as per Ext.P12. This has been challenged in<\/p>\n<p>the writ petition.\n<\/p>\n<p>WPC. 17165 &amp; 17177 OF 2009<br \/>\n<span class=\"hidden_text\">                                   : 2 :<\/span><\/p>\n<p>      4.     Ext.P12 has been challenged in the writ petition on<\/p>\n<p>various grounds. I am of the view that the petitioner shall first<\/p>\n<p>approach the first respondent for revocation of Ext.P12. The first<\/p>\n<p>respondent shall then consider the question of revoking Ext.P12.<\/p>\n<p>If a revival of the original purchase orders can be brought about,<\/p>\n<p>then it is open to the first respondent to do so.<\/p>\n<p>      5.     Accordingly     if  the    petitioners file a   detailed<\/p>\n<p>representation before the first respondent, in the manner<\/p>\n<p>aforementioned, the first respondent shall look into the same and<\/p>\n<p>after notice to the petitioner take appropriate decision on such<\/p>\n<p>representation within one month from the date of receipt of the<\/p>\n<p>representation along with copy of the judgment and copy of the<\/p>\n<p>writ petitions.\n<\/p>\n<p>      Writ petition is disposed of as above.\n<\/p>\n<\/p>\n<p>                                                    (V.GIRI, JUDGE)<\/p>\n<p>jma<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court Arvind Engineering Co.
