SHAH\n\t\t\n\t\n\n \n\nDate\n: 21\/01\/2011 \n\n \n\nORAL\nJUDGMENT<\/pre>\n<p>1.\t\tThe<br \/>\npresent First Appeal arises out of the impugned judgement and order<br \/>\npassed by learned Motor Accident Claims Tribunal (A), City Civil<br \/>\nCourt No.7, Ahmedabad City in Order below Exh-3 in Motor Accident<br \/>\nClaim Petition No.647\/2009 awarding Rs.50,000\/- to the original<br \/>\nclaimant by way of interim compensation under Section 140 of the<br \/>\nMotor Vehicles Act for No Fault Liability.\n<\/p>\n<p>2.\t\tHaving<br \/>\nheard Mr.Shelat, learned advocate appearing on behalf of the<br \/>\nappellant &#8211; original Opponent No.5 and as the impugned order is<br \/>\npassed under Section 140 of the Motor Vehicles Act, the same is not<br \/>\nentertained. However, it is observed that the same shall be without<br \/>\nprejudice to the rights and contentions of the respective parties in<br \/>\nthe main claim petition and all the defences and contentions, which<br \/>\nare available to the respective parties are kept open and the same<br \/>\nshall be considered by the Tribunal while deciding the main claim<br \/>\npetition. However, so far as the amount deposited by the appellant as<br \/>\nper the order passed by the Tribunal is concerned, it appears that<br \/>\nwhile passing operative portion of the order, the Tribunal has<br \/>\nmentioned that necessary order with respect to disbursement of the<br \/>\namounts of compensation shall be passed after depositing the same<br \/>\nwith the Tribunal.\n<\/p>\n<p>\t\tUnder<br \/>\nthe circumstances, it is directed that the amount so deposited and\/or<br \/>\nto be deposited by the appellant shall be invested in the Fixed<br \/>\nDeposit in the name of Nazir, initially for a period of three years<br \/>\nand the same shall be continued to be renewed  till  main  claim<br \/>\npetition  is  decided  and  disposed  of. The original claimant is<br \/>\nentitled to get periodical interest thereon.
