WADHWA\n\n\n\n\nACT:\n\n\n\nHEADNOTE:\n\n\n\nJUDGMENT:\n<\/pre>\n<p>\t\t\t O R D E R<br \/>\n     This special  leave petition has been filed against the<br \/>\norder of  the High Court of Delhi, made on 13.3.1997 in C.W.<br \/>\nNo. 1085\/97.\n<\/p>\n<p>     The predecessor  of the petitioner-Company had taken on<br \/>\nrent  the   disputed  premises,\t  fro  the   Life  Insurance<br \/>\nCorporation,  on   4th\tfloor\tof  Jeevan   Deep  Building,<br \/>\nParliament Street,  New Delhi.\tSince the petitioner had not<br \/>\nvacated the  premises, action  was taken  eviction under the<br \/>\nPublic Premises\t (Eviction of  Unauthorised Occupants)\tAct.<br \/>\nThe petitioner\tchallenged the\taction\tin  the\t High  Court<br \/>\ncontending that\t this Court  has issued\t directions in\tI.A.<br \/>\nNos. 4\tand 4  of 1992\tin Civil  Appeal Nos.  2058-59\/88 to<br \/>\nconstitute a  High-power Committee  to resolve\tthe disputes<br \/>\nbetween the  Public Sector Undertaking and the Government of<br \/>\nIndia of  the concerned Ministry, by a Committee composed of<br \/>\nCabinet\t Secretary,   Secretary\t in   Ministry\tof  Law\t and<br \/>\nSecretary in  the Bureau  of Public  Sector Undertakings  to<br \/>\ndecide the disputes without needless consumption of time and<br \/>\nwaste of  public funds. The petitioner has sought for such a<br \/>\nreference and  contends the High-power Committee should have<br \/>\nbeen constituted and decided the matter. We find no force in<br \/>\nthe contention.\n<\/p>\n<p>     The object of issuing direction in those matters was to<br \/>\ndecide the fiscal disputes in case of major policy matter to<br \/>\nsave the  public money and court valuable time, and disputes<br \/>\ncould  amicably\t  be  settled\tbetween\t the  Public  Sector<br \/>\nUndertaking  and  the  Government  of  India  or  the  State<br \/>\nGovernment. The\t intention was\tnot to\tresolve the disputes<br \/>\nlike eviction  of a  company  or  public  Undertaking  under<br \/>\nPublic Premises\t (Unauthorised Occupants)  Act;\t such  petty<br \/>\ndisputes are not directed to be dealt with by the High level<br \/>\nofficers whose\totherwise duty and time is of very important<br \/>\nnature.
