SIRI JAGAN, J.\n                 ------------------------------------\n                    W.P.(C)No.5350 OF 2009\n              ----------------------------------------\n                Dated this the 11th day of March, 2009\n\n                            JUDGMENT\n<\/pre>\n<p>     The petitioner was an applicant for allotment of LPG<\/p>\n<p>dealership of the 1st respondent company.           In the interview<\/p>\n<p>conducted, the petitioner obtained the highest marks. Despite<\/p>\n<p>the same, the petitioner was not awarded the distributorship. It<\/p>\n<p>is under the above circumstances, the petitioner approached this<\/p>\n<p>Court seeking the following the reliefs:\n<\/p>\n<blockquote><p>            &#8220;(i)   Issue a writ of mandamus or any other<br \/>\n      appropriate writ or direction directing the respondents to<br \/>\n      act upon Ext.P5 rank        list at once and appoint the<br \/>\n      petitioner as the LPG distributor for HPC at Perumbavoor;\n<\/p><\/blockquote>\n<blockquote><p>            (ii)   declare that respondent cannot go behind the<br \/>\n      rank list Ext.P5;\n<\/p><\/blockquote>\n<blockquote><p>            (iii)  issue a writ of mandamus or any other<br \/>\n      appropriate writ or direction directing the respondents<br \/>\n      not to issue LOI or appoint any person other than the<br \/>\n      petitioner as LPG distributor at Perumbavoor pending final<br \/>\n      hearing and disposal of the above Writ Petition; and\n<\/p><\/blockquote>\n<blockquote><p>            (v)    award to the petitioner the cost of this Writ<br \/>\n      Petition&#8221;.<\/p><\/blockquote>\n<p>     2.   The matter came up on 18.2.2009 before another<\/p>\n<p>learned Judge, who avoided the writ petition. It came up again<\/p>\n<p><span class=\"hidden_text\">W.P.(c)No.5350\/09                 2<\/span><\/p>\n<p>on 19.2.2009 on which date, the Standing Counsel took time<\/p>\n<p>to get instructions and I adjourned it by two weeks for that<\/p>\n<p>purpose. The same again came up on 5.3.2009. On that date,<\/p>\n<p>the learned Standing Counsel for the respondents submitted<\/p>\n<p>that the petitioner had been disqualified for having submitted<\/p>\n<p>wrong information in the application form regarding the land<\/p>\n<p>offered for the dealership.       They also submitted that a<\/p>\n<p>communication had been issued to the petitioner regarding the<\/p>\n<p>same.\n<\/p>\n<p>      3.    The learned counsel for the petitioner now submits<\/p>\n<p>that on the next day namely, 6.3.2009, a pre-dated<\/p>\n<p>communication dated 2.3.2009 was forwarded to the petitioner<\/p>\n<p>stating that the petitioner is not eligible for distributorship.<\/p>\n<p>      4.    The learned Standing Counsel for the Corporation<\/p>\n<p>refutes the allegation. He would submit that the respondents<\/p>\n<p>were under the impression that no communication need be<\/p>\n<p>issued in this regard, since once it is found that the<\/p>\n<p>information supplied by the petitioner in the application form is<\/p>\n<p>incorrect, the disqualification is automatic. He also points out<\/p>\n<p><span class=\"hidden_text\">W.P.(c)No.5350\/09                 3<\/span><\/p>\n<p>a Clause in the instructions to the applicants in the application<\/p>\n<p>form itself to that effect.\n<\/p>\n<p>      5.    I have considered the rival contentions in detail.<\/p>\n<p>      6.    I am of opinion that the respondents cannot<\/p>\n<p>unilaterally decide the question as to whether the person is<\/p>\n<p>disqualified or not, that too a person, who had obtained the<\/p>\n<p>highest marks in the interview. When the respondents are of<\/p>\n<p>opinion that any information supplied in the application form is<\/p>\n<p>wrong, the petitioner is entitled to an opportunity to controvert<\/p>\n<p>the same or explain the same appropriately, without an<\/p>\n<p>opportunity for which, the respondents could not have taken<\/p>\n<p>action against the petitioner for disqualification. In the above<\/p>\n<p>circumstances, the writ petition is disposed of with the<\/p>\n<p>following directions:\n<\/p>\n<p>      The communication now issued to the petitioner shall be<\/p>\n<p>treated as a show cause notice. The petitioner shall file his<\/p>\n<p>reply to the same within one week from today.            The 2nd<\/p>\n<p>respondent shall afford an opportunity of being heard to the<\/p>\n<p>petitioner and decide the matter finally. Needless to say, it<\/p>\n<p><span class=\"hidden_text\">W.P.(c)No.5350\/09                 4<\/span><\/p>\n<p>would be open to the petitioner to challenge any adverse<\/p>\n<p>orders in that regard. Till such orders are passed, the award<\/p>\n<p>of dealership shall not be finalised.\n<\/p>\n<\/p>\n<p>                                     S.
