KRISHNAN, J.\n                   ...........................................\n                   M.A.C.A.No.2081 OF 2008\n                  .............................................\n          Dated this the 26th day of November, 2009\n\n                         J U D G M E N T\n<\/pre>\n<p>     This is an appeal preferred against the award of the<\/p>\n<p>Claims Tribunal, Irinjalakkuda in OP(MV)No.950\/2002.                 The<\/p>\n<p>claimant sustained injuries in a road accident and he has<\/p>\n<p>been awarded      a compensation of Rs.34,000\/=                   and the<\/p>\n<p>insurance company has been exonerated from the liability on<\/p>\n<p>the ground that no additional premium is paid as the<\/p>\n<p>comprehensive policy will not cover the risk of a pillion<\/p>\n<p>rider. It is against that decision, the claimant has come up<\/p>\n<p>in appeal for enhancement as well as for challenging the<\/p>\n<p>finding of exoneration of the liability.<\/p>\n<p>     2. Heard the learned counsel for the appellant as well<\/p>\n<p>as the insurance company. A perusal of the award coupled<\/p>\n<p>with copy of the disability certificate would reveal that the<\/p>\n<p>claimant had sustained fracture of the clavicle as well as<\/p>\n<p>fracture of distal end of left radial and ulnar styloid. The<\/p>\n<p>disability certificate would reveal that clinically there is a<\/p>\n<p>gap in the lateral third of the left clavicle and partial<\/p>\n<p><span class=\"hidden_text\">                              : 2 :<\/span><br \/>\nM.A.C.A.No.2081 OF 2008<\/p>\n<p>ankylosis. Radiologically there is non union of the fracture<\/p>\n<p>of the clavicle. Considering all these facts, the doctor had<\/p>\n<p>assessed the disability. It may not be proper to throw out the<\/p>\n<p>disability certificate on the ground that the doctor has not<\/p>\n<p>been examined. At least the Tribunal should have taken a<\/p>\n<p>minimum percentage of disability and I take it as 3% and<\/p>\n<p>calculate the compensation.        The Tribunal has fixed the<\/p>\n<p>income at Rs.24,000\/= per annum.        When the disability is<\/p>\n<p>taken as 3% and the multiplier to be used as per <a href=\"\/doc\/837924\/\">Sarla<\/p>\n<p>Verma v. Delhi Transport Corporation<\/a> (2009 ACJ 1298) is<\/p>\n<p>18, the disability compensation would come to Rs.12,960\/=<\/p>\n<p>which I round as Rs.13,000\/=. I feel Rs.2,000\/= more has<\/p>\n<p>to be given towards loss of amenities thereby enhancing<\/p>\n<p>the compensation by Rs.15,000\/=.\n<\/p>\n<p>      3. The next point for consideration is regarding the<\/p>\n<p>liability of the insurance company. Admittedly it is a package<\/p>\n<p>policy.    The package policy contains a condition under<\/p>\n<p>Section II(i) that the insurance company has undertaken to<\/p>\n<p>cover the liability of a person in case of death or bodily injury<\/p>\n<p>arising out of the use of motor vehicle other than for hire or<\/p>\n<p><span class=\"hidden_text\">                               : 3 :<\/span><br \/>\nM.A.C.A.No.2081 OF 2008<\/p>\n<p>reward. Subsequent to 2001, an additional clause is<\/p>\n<p>incorporated &#8220;except so far as it is necessary to meet the<\/p>\n<p>requirements of the the Motor vehicles Act&#8221;. Both these<\/p>\n<p>clauses had come up for consideration before two Division<\/p>\n<p>Benches of this Court in the decision reported in New India<\/p>\n<p>Assurance      Co. Ltd. Hydrsoe (2008 (3) KLT 778) and<\/p>\n<p><a href=\"\/doc\/1457758\/\">Mathew V. Shaji Mathew<\/a> (2009(3) KLT 813). In both these<\/p>\n<p>cases the Division Benches took the view that since the<\/p>\n<p>contract of insurance by virtue of the conditions cover the<\/p>\n<p>risk of a person travelling in the motor vehicle other than<\/p>\n<p>for hire or reward, no separate premium is necessary to cover<\/p>\n<p>such risks. In the light of these authoritative pronouncements<\/p>\n<p>it has to be held that the insurance company is liable to pay.<\/p>\n<p>     4. In the result, the MACA is partly allowed and the<\/p>\n<p>claimant    is  awarded      an  additional   compensation    of<\/p>\n<p>Rs.15,000\/= with 7% interest on the said sum from the date<\/p>\n<p>of the petition till realisation and the insurance company is<\/p>\n<p>directed to deposit the said amount as well as the original<\/p>\n<p>amount awarded within a period of 60 days from the date of<\/p>\n<p>receipt of a copy of this judgment.\n<\/p>\n<p><span class=\"hidden_text\">                            : 4 :<\/span><br \/>\nM.A.C.A.No.2081 OF 2008<\/p>\n<p>    Disposed of accordingly.\n<\/p>\n<\/p>\n<p>                               M.N.
