JOSHI - Petitioner(s)\n \n\nVersus\n \n\nPRINCIPAL\nSECRETARY &amp; 3 - Respondent(s)\n \n\n=========================================================\nAppearance : \nMR\nAJ YAGNIK for\nPetitioner(s) : 1, \nMR JK SHAH AGP for Respondent(s) : 1, \nRULE\nSERVED for Respondent(s) : 1 -\n4. \n=========================================================\n\n\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE KS JHAVERI\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 04\/05\/2010 \n\n \n\nORAL\nJUDGMENT<\/pre>\n<p>1.\tBy<br \/>\nway of this petition under Article 226 of the Constitution of India,<br \/>\nthe petitioner has prayed for the following reliefs;\n<\/p>\n<p> (A)\tTo<br \/>\nadmit and allow the present petition.\n<\/p>\n<p>(B)\tTo<br \/>\ndirect the respondents to pay to the petitioner amount of respective<br \/>\nrate of interest applicable vide resolutions and notifications of the<br \/>\nState of Gujarat issued from time to time on the amount of gratuity<br \/>\nand commutated pension totaling about Rs.2,44,404\/- with effect from<br \/>\n03.09.1990 till actual date of payment;\n<\/p>\n<p>(C)\tIn<br \/>\nthe alternative, be pleased to direct the respondents to pay to the<br \/>\npetitioner compound interest at the very rates prescribed by the<br \/>\nrespondent State of Gujarat applicable from time to time with effect<br \/>\nfrom 03.09.1990 till the actual date of payment on the total amount<br \/>\nof Rs.2,44,404\/-.\n<\/p>\n<p>(D)\tIn<br \/>\nthe alternative, be pleased to direct respondents and respondent no.1<br \/>\nin particular to pay interest @ 12% per annum on the delayed payment<br \/>\nof amount of gratuity and pension to the tune of Rs.2,44,404\/- from<br \/>\n03.09.1990 till the actual payment.\n<\/p>\n<p>(E)<br \/>\nto (G) &#8230;&#8230;\n<\/p>\n<p>2.\tThe<br \/>\nfacts in brief are that on 01.04.1968 the petitioner was appointed as<br \/>\na Mamlatdar in the Revenue Department of the State Government. He<br \/>\nwas, thereafter, permanently absorbed in the Gujarat Communications &amp;<br \/>\nElectronics Ltd., Vadodara, a wholly owned Company of the Government<br \/>\nof Gujarat, w.e.f. 03.03.1990. On 30.09.2000 the petitioner retired<br \/>\nfrom service.\n<\/p>\n<p>3.\tIt<br \/>\nis the case of the petitioner that he is entitled for commutated<br \/>\npension, gratuity, etc. for the service rendered by him with<br \/>\nrespondent-Revenue Department for the period 1968   1990. However,<br \/>\nhe was paid the same only on 16.01.2007. Therefore, he is entitled<br \/>\nfor interest to the tune of Rs.2,44,404 on the amount of commutated<br \/>\npension and gratuity for the period between 1990 to 16.01.2007. The<br \/>\npetitioner had made several representations to the respondents.<br \/>\nHowever, none were considered. Hence, this petition.\n<\/p>\n<p>4.\tHeard<br \/>\nlearned counsel for the respective parties and perused the documents<br \/>\non record. It is stated at the bar by the learned AGP that the<br \/>\npetitioner has been paid the amount of Gratuity, which he is entitled<br \/>\nunder the relevant Rules. The said fact is not disputed by learned<br \/>\ncounsel for the petitioner. Now, so far as the issue regarding<br \/>\ninterest on the amount of commutated pension is concerned, in my<br \/>\nopinion, the same could not be granted. No interest could be paid on<br \/>\nthe amount of commutated pension. Hence, the relief claimed by the<br \/>\npetitioner, being devoid of any merits, deserves to be rejected.\n<\/p>\n<p>5.\tIn<br \/>\nview of the above, the petition is dismissed.
