They therefore raised a<br \/>\ndispute which was referred to Labour Court which resulted in the<br \/>\naforesaid judgment and award.\n<\/p>\n<p>3.\tHeard<br \/>\nthe learned Advocates for the respective parties and perused the<br \/>\nrelevant documents on record. As a result of this exercise it is<br \/>\nfound that the Labour Court has discussed in detail that the<br \/>\nrespondents were working with the petitioner continuously and that<br \/>\nthere is clear breach of provisions of the Act. There is a clear<br \/>\nfinding that the juniors of the  respondent were retained in service.<br \/>\nLearned Advocate for the  petitioners is not able to point out<br \/>\nanything from the record to show that the order of reinstatement is<br \/>\nperverse in any manner whatsoever.\n<\/p>\n<p>4.\tHowever,<br \/>\n there was no plea nor evidence or proof to show that from the<br \/>\nalleged discontinuation of his service till the date of award, the<br \/>\nrespondent was not in gainful employment. Therefore,  I am of the<br \/>\nview that there was no justification for grant of back wages,<br \/>\nespecially when the workman has not worked on the post during the<br \/>\ninterregnum period.\n<\/p>\n<p>5.\tIn<br \/>\nthe premises aforesaid the impugned judgment and award is quashed and<br \/>\nset aside qua back wages. The rest of the award is confirmed.
