THE DEPUTY TREASURY OFFICER HILSA, NALANDA\n                                              -----------\n<\/pre>\n<p>                     For the Petitioner:- Mr. Dinu Kumar, Adv.\n<\/p>\n<p>                                           Mr. Arvind Kumar Sharma, Adv.\n<\/p>\n<p>                     For the Union of India:- Mr. Gopesh Kumar, C.G.C.<br \/>\n                     For the State:- J.C. to S.C.-10\n<\/p>\n<p>                                      &#8212;&#8212;&#8212;&#8212;-\n<\/p>\n<p>2.   6.12.2010             At   the   outset   learned   counsel   for   the<\/p>\n<p>                  petitioner submits that he does not seriously press the<\/p>\n<p>                  writ petition in personal capacity against the District<\/p>\n<p>                  Magistrate but only against the office concerned.<\/p>\n<p>                           The petitioner is aggrieved by the order<\/p>\n<p>                  dated 30.9.2009 passed by the District Magistrate,<\/p>\n<p>                  Nalanda stopping payment of his Freedom Fighter<\/p>\n<p>                  Pension vide P.P.O. No. 31188.\n<\/p>\n<p>                           Learned counsel for the petitioner submits<\/p>\n<p>                  that the order suffers from complete non application of<\/p>\n<p>                  mind and the proceedings have been initiated at the<\/p>\n<p>                  behest of a busy body. The petitioner was sanctioned<\/p>\n<p>                  Freedom Fighter Pension in 1998 after due enquiry<br \/>\n<span class=\"hidden_text\">                     2<\/span><\/p>\n<p>and continued to receive the same till issuance of the<\/p>\n<p>impugned order.         It is further pointed out that the<\/p>\n<p>allegations and enquiry as discussed in the impugned<\/p>\n<p>order appears to be related to Pension Payment Order<\/p>\n<p>No. 31188.\n<\/p>\n<p>          Learned counsel for the petitioner refers to<\/p>\n<p>the pleadings in Paragraph-10 of the writ application<\/p>\n<p>to submit that the pension payment order number of<\/p>\n<p>the petitioner is MHAFF-9804703. He has nothing to<\/p>\n<p>do with Pension Payment Order No. 31188.<\/p>\n<p>          Unfortunately,       the   petitioner   has    not<\/p>\n<p>annexed his original Pension Payment Order to the<\/p>\n<p>writ petition to enable the Court to satisfy itself what<\/p>\n<p>is the correct Pension Payment Order number. If the<\/p>\n<p>impugned order dated 30.9.2009 refers to another<\/p>\n<p>Pension Payment Order then that of the petitioner, it<\/p>\n<p>may have a vital bearing on the impugned order.<\/p>\n<p>          Let the petitioner appear before the District<\/p>\n<p>Magistrate along with his original Pension Payment<\/p>\n<p>Order number. The District Magistrate shall verify the<\/p>\n<p>correct   Pension       Payment   Order   number    of   the<\/p>\n<p>petitioner.   If it is not 31188, the impugned order<\/p>\n<p>dated 30.9.2009 obviously cannot be an impediment<\/p>\n<p>or justification for withholding of the Freedom Fighter<\/p>\n<p>Pension Payment of the petitioner.\n<\/p>\n<p><span class=\"hidden_text\">                                 3<\/span><\/p>\n<p>                     If   the       Pension   Payment    Order   of   the<\/p>\n<p>           petitioner is 31188, in view of the statement made in<\/p>\n<p>           Paragraph-7 of the counter affidavit of the Union of<\/p>\n<p>           India that it had already sought details from the<\/p>\n<p>           District Magistrate, Nalanda, the writ petition shall<\/p>\n<p>           stand disposed in the aforesaid terms of the statement<\/p>\n<p>           made by the Union of India when the enquiry is<\/p>\n<p>           expected to be concluded expeditiously.<\/p>\n<p>                     The writ application stands disposed with<\/p>\n<p>           the aforesaid directions.\n<\/p>\n<\/p>\n<pre>P.
