There is regular testing of materials in Mpl Lab and by a<br \/>\n         been any revision of estimated third party. The record of material testing report is voluminous<br \/>\n         expenditure with reasons for such which may be inspected in Project Division Karol Bagh Zone.<br \/>\n         revision. Copy of reports of proper<br \/>\n         checks about the quality of the<br \/>\n         materials used.\n<\/p>\n<p>Query    Copies of letter(s), etc. seeking No reply.\n<\/p>\n<p> 7.      cooperation from other concerned<br \/>\n         departments\/authorities, and position<br \/>\n         about these matters, especially for<br \/>\n         Karol Bagh area and also for other<br \/>\n             areas concerned<\/p>\n<p>Grounds for first appeal:\n<\/p>\n<p>Unsatisfactory information provided by the PIO.\n<\/p>\n<p>The First Appellate Authority ordered:\n<\/p>\n<p>        During the hearing PIO\/SE(Project) and APIO\/EE(Project) were directed to give the requisite<br \/>\ndetailed and complete information to the appellant alongwith a copy of the report within 10 days.\n<\/p>\n<p>Grounds for second appeal:\n<\/p>\n<p>Unsatisfactory information provided by the PIO and order of the FAA not complied with.\n<\/p>\n<p>Relevant Facts emerging during Hearing:\n<\/p>\n<p>The following were present<br \/>\nAppellant: Mr. Shyam Budhiraja;\n<\/p>\n<p>Respondent: Mr. Rajesh Wadhwa, Public Information Officer &amp; Superintending Engineer (Pr.);\n<\/p>\n<p>              Mr. B. B. Agrawal, Executive Engineer(Pr.) &amp; APIO;\n<\/p>\n<p>        The PIO claims that he has sent the information to the appellant but has no proof of having sent<br \/>\nit. The appellant states that he has not received the information. the respondent appears to be treating his<br \/>\njob very casually since he has no proof to show that he has sent the information to the appellant even<br \/>\nwhen he comes in the hearing before the Commission. Since the appellant has not received the<br \/>\ninformation so far it appears that the information was not sent to him. The respondent ha snot even<br \/>\nbother to bring the information which he claims to have sent to the appellant.\n<\/p>\n<p>Decision:\n<\/p>\n<p>The appeal is allowed.\n<\/p>\n<p>      The PIO is directed to send the information to the appellant by speed post before<br \/>\n05 November 2010.\n<\/p>\n<p>The issue before the Commission is of not supplying the complete, required information by the<br \/>\nPIO within 30 days as required by the law.\n<\/p>\n<p>From the facts before the Commission it is apparent that the PIO is guilty of not furnishing information<br \/>\nwithin the time specified under sub-section (1) of Section 7 by not replying within 30 days, as per the<br \/>\nrequirement of the RTI Act. He has further refused to obey the orders of his superior officer, which<br \/>\nraises a reasonable doubt that the denial of information may also be malafide. The First Appellate<br \/>\nAuthority has clearly ordered the information to be given.\n<\/p>\n<p>It appears that the PIO&#8217;s actions attract the penal provisions of Section 20 (1). A showcause notice is<br \/>\nbeing issued to him, and he is directed give his reasons to the Commission to show cause why penalty<br \/>\nshould not be levied on him.\n<\/p>\n<p>He will present himself before the Commission at the above address on 15 December 2010 at 3.00pm<br \/>\nalongwith his written submissions showing cause why penalty should not be imposed on him as<br \/>\nmandated under Section 20 (1).
