SHAH\n\t\t\n\t\n\n \n\nDate\n: 14\/10\/2010 \n\n \n\n \nORAL\nORDER<\/pre>\n<p>1.\t\tThe<br \/>\nprayer in the petition is to issue appropriate writ, order and\/or<br \/>\ndirection, directing the respondent to consider request of the<br \/>\npetitioner for &#8220;continuity of service&#8221; from 1985-86.<br \/>\nHowever, considering the order dated 21\/11\/2005 passed by learned<br \/>\nSingle Judge in Special Civil Application No.8166 of 2003, by which,<br \/>\nlearned Single Judge modified the judgement and award passed by the<br \/>\nLabour Court, it appears that the learned Single Judge has<br \/>\nspecifically held that the respondent shall grant the benefit of<br \/>\ncontinuity of service from the date of the award i.e. 31\/07\/2002.<br \/>\nUnder the circumstances, no relief can be granted to the petitioner<br \/>\nas prayed for in the present petition. If the petitioner is aggrieved<br \/>\nby the order of the leaned Single Judge and\/or is of the view that<br \/>\nthere is some mistake while passing the final operative portion of<br \/>\nthe order, the petitioner can approach the learned Single Judge for<br \/>\nmodification and\/or clarification of the order passed in Special<br \/>\nCivil Application No.8166 of 2003. However, so far as the present<br \/>\npetition is concerned, so long as order of learned Single Judge<br \/>\nstands, which provides for continuity of service from the date of<br \/>\naward, no relief can be granted to the petitioner as prayed for in<br \/>\nthe present petition. If the petitioner so chooses, he can approach<br \/>\nthe learned Single Judge for modification and\/or clarification of the<br \/>\norder passed in Special Civil Application No.8166 of 2003.\n<\/p>\n<p>2.\t\tAt<br \/>\nthis stage, Mr.Bukhari, learned advocate appearing on behalf of the<br \/>\npetitioner does not press the present petition reserving liberty in<br \/>\nfavour of the petitioner to prefer an appropriate application before<br \/>\nlearned Single Judge for modification and\/or clarification of the<br \/>\norder dated 21\/11\/2005 passed in Special Civil Application No.8166 of<br \/>\n2003.\n<\/p>\n<p>3.\t\tUnder<br \/>\nthe circumstances, the present petition is dismissed as not pressed<br \/>\nwith above liberty.
